LUCIE COUNTY GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO THE MAXWELL ACRES MINOR SITE PLAN WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Minor Site Plan submitted by Harry D. Maxwell, evaluated the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Harry D. Maxwell presented a petition for a Minor Adjustment to the Maxwell Acres Minor Site Plan approval for the deletion of Condition of Approval #1 that required the construction of offsite sidewalks at time of building permit for individual lots located on Sneed Road. The overall subject 38.19-acre property is located within the AG-5 (Agricultural — 1 du/5ac) Zoning District and described in Part A. 2. On March 1, 2007, the Growth Management Director through GM Order 07-006 granted approval for a five (5) lot subdivision subject to five (5) conditions of approval. 3. GM Order 07-006 included a condition of approval for the construction of offsite sidewalks at time of building permit for said lots. Pursuant to Section 7.05.04 of the Land Development Code sidewalk requirements are based upon local needs and existing conditions and are not required for development outside the Urban Service Boundary (USB). 4. The Development Review Committee has reviewed the proposed Minor Adjustment to the Maxwell Acres Minor Site Plan and found it to meet the standards of review as set forth in Section 11.02.07 of the St. Lucie County Land Development Code. 5. Planning staff performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning and Development Services Department memorandum titled Maxwell Acres-Minor Adjustment to Minor Site Plan (SPMN- 2202125944), dated July 19, 2021. 6. The proposed Minor Adjustment will not have an undue adverse effect on adjacent properties, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.02.03(C) of the St. Lucie County Land Development Code, the Minor Adjustment to Maxwell Acres Minor Site Plan to remove the condition of approval requirement for the construction of sidewalks along Sneed Road is hereby approved for the property described below. Page 1 PDS No. 2021-037 File No. SPMN-2202125944 LEGAL DESCRIPTION THE SOUTH 1313.42 FEET OF THE WEST 1/2 OF THE SOUTHWEST 1/4 OF SECTION 10, TOWNSHIP 35 SOUTH, RANGE 38 EAST, LESS THE WEST 13 FEET AND THE SOUTH 49 FEET OF CANAL RIGHT-OF-WAY. ALL OF THE ABOVE SITUATE IN ST. LUCIE COUNTY, FLORIDA. PARCEL CONTAINING 1,663,624.4 SQ. FT. OR 38.19 ACRES MORE OR LESS.
