WHEREAS,the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. Pursuant to Section 401.25, Florida Statutes, every person, firm, corporation, association, or governmental entity which provides prehospital, or interfacility advanced life support services or basic life support transportation services must be licensed by the State of Florida Department of Health before offering such services to the public. 1 Struck through passages deleted. Subsection 401.25(2)(d), Florida Statutes, requires an applicant for a State of Florida advanced life support or basic life support transportation certificate to provide proof of having obtained a certificate of public convenience and necessity from each county in which it intends to operate as a part of the application process. 3. On February 20, 1996, the Board of County Commissioners adopted Ordinance No. 96-04 which created Chapter 1-12.5, "Life Support Services" of the St. Lucie County Code of Ordinances and Compiled Laws to establish procedures and criteria for issuing County certificates of convenience and public necessity ("COPCN") as provided in Subsection 401.25(2)(d), Florida Statutes. 4. On March 15, 2008, the Board of County Commissioners adopted Ordinance No. 08-011 which further amended Chapter 1-12.5. 5. On August 12, 2014, the Board of County Commissioners adopted Ordinance No. 14-020 which recodified Chapter 1-12.5 as Chapter 18 of the St. Lucie County Code of Ordinances. 6. The Board has determined it is appropriate to amend Chapter 18 to clarify certain provisions, provide for an annual determination of whether a need for additional life support services exists in the County, and reduce the term of a COPCN from two years to one year in order to develop greater oversight of the level of service provided to the residents of St. Lucie County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: PART A. AMENDING OF SECTION 18-52 (APPLICATION-INFORMATION AND FEE REQUIRED) OF CHAPTER 18, EMERGENCY MANAGEMENT AND EMERGENCY SERVICES,ARTICLE III (LIFE SUPPORT SERVICES) Section 18-52 (Application-information and fee required)of the Code of Ordinances of St. Lucie County, Florida, is hereby amended as follows: Section 18-52. Initial Application COPCN Required annual needs assessment; initial application and fee. faaj No person,firm, governmental entity, agency, corporation, partnership or association shall operate any of the services as described in the classification of service in Section 18-51 unless it has first obtained a certificate of public convenience and necessity issued by the Board. ll On or before May 1 of each year, the Public Safety Director shall conduct a needs survey to determine whether there exists a need for additional life support services in the county. Following the conclusion of the survey, the public safety director shall recommend to the Board of County Commissioners whether to issue a notice for the submission of new COPCN applications. If the Board determines to issue such notice, public notice of the application period for COPCNs shall be given by the County no earlier than July 1. Completed �,. applications shall be submitted to the public safety director no earlier than September 1 and no later than September 30. j1 Each application for a certificate of public convenience and necessity shall be accompanied by a non-refundable filing fee to be approved by resolution of the Board and payable to the County at the time the application is submitted to the County to cover the costs and expenses incurred by the County in processing the application. All applications for an initial Certificate shall be submitted only during the application period. An applicant for an initial certificate of public convenience and necessity shall apply to the Board in writing and complete a form provided by the Public Safety Director which shall contain the following information: +++++++++++++++++++++++++++++++++++++++++ (18) A completed survey of local need for the proposed service using the form approved by the Public Safety Director. The date of the survey shall be no earlier than six (6) months prior to the date of the application. (19) An outline of the annual employee training protocols. PART B. AMENDMENT OF SECTION 18-53(SAME-REVIEW AND INVESTIGATION BY PUBLIC SAFETY DIRECTOR) Section 18-53 (Same-review and investigation by public safety director) of the Code of Ordinances of St. Lucie County, Florida, is hereby amended to read as follows: Section 18-53. Same-review and investigation by public safety director. (a) Upon receipt of an application for a certificate of public convenience and necessity, the public safety director shall review the application for completeness and consistency with the standards of review set forth in section 18-56. The public safety director may require additional information as maybe necessary to adequately review the application. The public safety director shall also conduct an investigation to determine whether a public need exists for the proposed services in the service area identified in the application. As part of his investigation, the public safety director shall contact the applicant's medical director, all other service providers in the county, any municipality in which the applicant desires to provide service, and the any local or regional trauma agency created under F.S. ch. 395. The public safety director shall complete his review and investigation within 60 days of the date of receipt of the application. (b) If the public safety director determines the application to be complete and consistent in accordance with the standards of review set forth in section 18-56, the public safety director shall present the application and the results of his investigation at the next regularlyregtharlythcathltheci meeting of the emergency medical services advisory council for the purpose of reviewing the 3 5'- hcoogh passages deleted. The public safety director shall provide notice of the meeting to the applicant, all other service providers in the county, and any municipality in the requested service area. ll If the public safety director determines the application to be incomplete and/or inconsistent with the standards of review set forth in section 18-56, the public safety director shall return the application to the applicant, noting the items which are not complete or have been determined to be inconsistent with the standards of review. The applicant shall have 344 7 days to submit a revised or corrected application. Any application that has been returned to the applicant for correction and/or revision and is not resubmitted to the public safety director within this period shall be considered withdrawn and the filing fee forfeited. PART C. AMENDMENT OF SECTION 18-54 (SAME-REVIEW AND INVESTIGATION BY EMERGENCY MEDICAL SERVICES ADVISORY COUNCIL) Section 18-54 (Same-review and investigation by emergency medical services advisory council) of the Code of Ordinances of St. Lucie County, Florida, is hereby amended to read as follows: Section 18-54. Same-review and investigation by emergency medical services advisory council. (a) The council will review the application, consider the recommendations—of the public '" safety director as well as recommendations of the fire chief, other service providers, and any affected municipality if any, and forward a recommendation on the application to the board. (b) In making its recommendation to the board, the council shall consider the following factors: (1) Compliance with the appropriate license requirements set forth in F.S. ch. 401 and F.A.C. ch. 641-1. This shall not apply to applicants for a Class F certificate. (2) The population density and composition of the areas within which the proposed service will operate. (3) The need of the people in the proposed service area for such service. (4) A comparison of estimated annual requests for service in the particular certificate category with the current number of vehicles permitted for operation and operating in the proposed service area. (5) The recommendation of any municipality located within the proposed service area. (6) The recommendation of the a local or regional agency created under F.S. ch. 395. This shall not apply to applicants for a Class F certificate. 4 Struck through passages deleted. Underlined passages added. (7) Such other factors related to the standards of review set forth in section 18-56, as the council shall deem appropriate. PART D. AMENDMENT OF SECTION 18-55 (SAME-BOARD OF COUNTY COMMISSIONERS REVIEW) Section 18-55 of Chapter 18 of the Code of Ordinances of St. Lucie County, Florida, is hereby amended to read as follows: Section 18-55. Same-Board of county commissioners' review. (a) Upon receipt of a recommendation from the emergency medical services advisory council regarding an application for a certificate of public convenience and necessity,the board shall consider the application of a public hearing held no sooner than 14 days following publication at the applicant's expense of a legal notice in a newspaper of general circulation in the county. Such notice shall be in substantially the following form: NOTICE OF APPLICATION FOR CLASS " " CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY Notice is hereby given that, pursuant to Chapter 18, Article III,of the Code of Ordinances of St. Lucie County, Florida, (name of applicant) whose business address is , has made application to the Board of N` County Commissioners for a Class certificate of public convenience and necessity. PART E. AMENDMENT OF SECTION 18-56 (SAME-STANDARDS OF REVIEW) Section 18-56 of Chapter 18 of the Code of Ordinances of St. Lucie County, Florida, is hereby amended to read as follows: Section 18-56. -Same—Standards of review. The board shall apply the following standards of review in determining whether to approve an application for certificate of public convenience and necessity: (1) Whether the application is complete and meets the minimum requirements of this article, F.S. ch. 401 and F.A.C. ch. 641-1. This shall not apply to applicants for a Class F certificate. (2) Whether a need for the proposed service exists in the proposed service area. (3) Whether the municipality, if any, located in the proposed service area has recommended that the board approve the application. (4) Whether the local or regional trauma agency created under F.S. ch. 395, if any, has recommended that the board approve the application. This shall not apply to applicants for a Class F certificate. PART F. AMENDMENT OF SECTION 18-59 (EXEMPTIONS) Section 18-59 of Chapter 18 of the Code of Ordinances of St. Lucie County, Florida, is hereby amended to read as follows: Sec. 18-59. - Exemptions; certificate holder responsibilities. (a) Any vehicle rendering services as an ambulance in the event of a major catastrophe or emergency when ambulance with permits based in the locality of the catastrophe or emergency as defined in the statewide mutual aid agreement are incapacitated or insufficient in number to render the services needed and any ambulance owned and operated by the federal government shall be exempt from the provisions of this article. (13) Attend the annual certificate holder meeting conducted by the public safety director or designee. PART G. AMENDMENT OF SECTION 18-60 (INSPECTIONS) Section 18-60 of Chapter 18 of the Code of Ordinances of St. Lucie County, Florida, is hereby amended to read as follows: Section 18-60. - Inspections. (a) The public safety director, or his designee, shall inspect each applicant and certificate holder during review of the application, and thereafter on or before October 1 as a continuing part of the certification process. This inspection shall determine the continuing compliance with this article and all state laws, rules and regulations by the certificate holder as a condition of certificate issuance. (b) Inspections may be conducted with or without prior notice to the certificate holder and shall be conducted whenever such inspection is deemed necessary by the public safety director in order to determine compliance with this article and a certificate holder's certificate of public convenience and necessity. Inspections shall be conducted without impeding patient care. (c) If during the course of an inspection, a situation is found which, in the determination of the public safety director, may jeopardize the safety or welfare of the service personnel or patient care, the public safety director shall issue a deficiency correction notice or exercise the powers necessary to ensure the certificate holder's compliance with its certificate and this article. The deficiency correction notice shall state the nature of the deficiency and specify a time for correction of the deficiency. Failure to correct the deficiency in the time specified in the deficiency correction notice may result in action pursuant to section 18-63. AMENDMENT OF SECTION 18-62 (RENEWAL AND AMENDMENT OF CERTIFICATE) OF CHAPTER 18 EMERGENCY MANAGEMENT AND EMERGENCY SERVICES, ARTICLE III (LIFE SUPPORT SERVICES). Section 18-62 of the Code of Ordinances of St. Lucie County, Florida, is hereby amended to read as follows: Section 18-62. Renewal and amendment of certificate. (a) A-Any certificate holder whose certificate will expire on or after December 31, 2022 shall submit an application for renewal of its certificate to the public safety director at last 90 day prior to the date of expiration of the certificate on or before August 1, 2022. Thereafter every certificate holder shall submit an application for renewal of its certificate annually on or before August 1. Each application for renewal of a certificate of public convenience and necessity shall be accompanied by a nonrefundable fee in an amount to be approved by resolution of the board. The application for renewal shall be reviewed by the emergency medical services advisory council of compliance with the terms of the certificate and the requirements of section 18-59 and the results of any inspections conducted pursuant to section 18-60. Following its review, the council shall forward a recommendation on the renewal application to the board of county commissioners. The board of county commissioners shall renew a certificate upon a determination that the certificate holder remains in compliance with the terms of its certificate and this article. The term of a renewed certificate shall be two (2) years, subject to suspension alteration, or revocation as provided in Section 18-63. (b) In the event a certificate holder desires to amend its certificate to increase the maximum number of permitted transport vehicles, it shall submit an application to the public safety director prior to placing the vehicle into service indicating the proposed increase in permitted vehicles,the type of additional vehicles proposed,and documented justification for the proposed increase based upon its monthly service reports and such other factors as the certificate holder may deem relevant. Upon receipt of the application for an increase in permitted transport vehicles, the public safety director shall traasaait forward the application to the emergency medical services advisory council for review and recommendation to the board of county commissioners. The emergency medical services advisory council shall review the recommendation in accordance with the provisions of section 18-54 and forward a recommendation to the board of county commissioners.The board shall consider the application in accordance with the procedures and standards of review as set forth in sections 18-55 and 18- 56. PART I. SEVERABI LITY AND APPLICABILITY. It is declared to be the intent of the Board of County Commissioners of St. Lucie County, that if any section, subsection, sentence, clause, or provision of this ordinance be held invalid, the remainder of the ordinance shall not be affected.
