LUCIE COUNTY, FLORIDA: ARTICLE I Short Title This Ordinance shall be known as County Ordinance No. 2021-031, "Economic Development Ad Valorem Tax Exemption — PB Holdco, L.L.C." ARTICLE II Procedure After consideration of the report of the Property Appraiser and in accordance with the procedure set forth in County Ordinance 92-24, "Economic Development Ad Valorem Tax Exemption Regulations of St. Lucie County, Florida." The Board grants and establishes an exemption from ad valorem taxation of the assessed value of PB Holdco, L.L.C., 3901 St. Lucie Boulevard, Fort Pierce, Florida, in accordance with the following exemption phase out schedule for the tax years listed below: Year 1 - 100% Year 2 - 100% Year 3 - 100% Year 4 - 100% Year 5 - 100% Year 6 - 90% Year 7 - 80% 1 Year 8 - 60% Year 9 - 40% Year 10 - 20% No exemption shall be granted on the land on which improvements are made by PB Holdco, L.L.C. ARTICLE III Ad Valorem Tax Revenues Total revenues are available to the County for the current fiscal year from ad valorem tax sources is$200,647,554.15. Revenues lost to the County for the current fiscal year by ad valorem tax exemptions under this section currently in effect are $460,536.81. Revenues to be lost by granting of this exemption for the current fiscal year are estimated to be $201,137.60. ARTICLE IV Expiration Date The Economic Development Ad Valorem Tax Exemption granted to PB Holdco, L.L.C., an expanding business, shall be for ten (10) years from the date the exemption is applied. ARTICLE V Findin The Board of County Commissioner of St. Lucie County, Florida,finds that PB Holdco, L.L.C. is an expansion of an existing business as defined by the St. Lucie County Ordinance No. 92-24 and Section 196.012(15), Florida Statutes. The Board reserves the right to repeal the exemption if PB Holdco, L.L.C. no longer satisfies the criteria set out above. ARTICLE VI Severability If any section, subsection, paragraph, sentence, clause, phrase, or portion of this Ordinance is for any reason found void, invalid, unlawful, or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, independent, and severable provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Related to the Expansion of its Existing Facility at 3901 St. Lucie Boulevard BACKGROUND: PB Holdco, L.L.C., a local boat manufacturer, has a applied for a real and personal property economic development ad valorem exemption related to the recent expansion of its facility located at 3901 St. Lucie Boulevard. As a result of this expansion, the company has added an additional 200 jobs to its workforce bring the total number in Florida to 558. The Property Appraiser has reviewed the application and determined the company is eligible for the exemption. If approved, the company would receive the exemption on a sliding scale for no more than a ten (10) year period. The estimated taxable value of the improvements to the real property is $18,352,411.00. The estimated taxable value of the additional personal property is $2,668,397.00. The value of the real property itself would not be subject to the exemption. Copies of the proposed ordinance, exemption application, and economic incentives resolution are attached. PREVIOUS ACTION: On March 19, 2019, the Board of County Commissioners adopted Resolution No. 19-045 which approved certain economic incentives for PB Holdco, L.L.C. which included direction to staff to assist the company in applying for an economic development ad valorem tax exemption related to the proposed expansion. FINANCIAL IMPACT: The estimated lost tax revenue if the exemption is applied using the current millage rate is $201,137.60. RECOMMENDATION: Staff recommends the Board grant permission to advertise the proposed ordinance for public hearing on August 17, 2021 at 9:00 a.m., or as soon thereafter as may be heard. The Company is expanding its current operations with the construction of a new production facility with a capital investment of eighteen million and five hundred thousand dollars ($18,500,000)-adjacent to its existing facility and employee base. 5. In conjunction with its planned expansion and growth, the Company has worked with both County staff and the St. Lucie Economic Development Council to not only enable it to retain 402 existing jobs but create 200 new jobs. 7. In recognition of the Company's desire to expand locally, St. Lucie County is offering an economic incentive package to the Company for the benefit of the residents of St. Lucie County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida, that in consideration of the benefits gained by the residents of St. Lucie County through the expansion of PB HOLDCO, LLC's manufacturing facilities, the following incentives are offered: A. St. Lucie County Job Growth Incentive Grant (JGIG) — The Board authorizes County staff to prepare a JGIG agreement with the Company or its successors for the creation of 200 new jobs pursuant to the Job Growth Investment Grant guidelines. St. Lucie County Ad-Valorem Tax Exemption on New Real Property and Tangible Personal Property: The Board hereby makes a preliminary finding that the nature of the Company's expansion of its existing manufacturing facility meets the requirements for an Economic Development Ad Valorem Tax Exemption as set forth in Section 196.1995, Florida Statutes, and Section 42-28, St. Lucie County Code of Ordinances, subject to submission and review of an Economic Development Ad Valorem Tax Exemption application and adoption of an ordinance granting such exemption. The Board authorizes County staff to assist the Company or its successors in the application for a 10-year ad valorem tax exemption as described in the County's Economic Development Ad Valorem Tax Exemptions program.
