LUCIE COUNTY GRANTING PB HOLDCO LLC A FIFTH MAJOR ADJUSTMENT TO THE PURSUIT BOATS MAJOR SITE PLAN (FKA S- 2 YACHTS) ON +/- 89.63 ACRES OF PROPERTY LOCATED GENERALLY AT 3901 ST. LUCIE BOULEVARD IN ST. LUCIE COUNTY, FL. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Pursuit Boats, represented by Culpepper and Terpening, Inc., presented a petition for a fifth Major Adjustment to a previously approved Major Site Plan known as Pursuit Boats (FKA S-2 Yachts) to reflect the development completed to-date, improve site functionality during construction, and refine the previously approved site plan to better serve final operations, including the following: document the transfer of 42 acres to St. Lucie County for Habitat Preservation , update and clarify the expansion phases, provide additional parking to serve the completed Phase I expansion and a temporary guard station, reconfigure the Boat Mold Production Building in Phase 2, provide additional Phase 2 parking; and memorializing miscellaneous clarifications including the compressor shed and resin tank locations, to support the expansion of the boat manufacturing facility, up to 784,312 sq. ft., of finished space, located generally at 3901 St. Lucie Boulevard in the IL (Industrial, Light) Zoning District on approximately 89.63 acres of land as described in Part A. 2. On April 16, 1996, the Board of County Commissioners approved Resolution 96- 022 granting a Major Adjustment to the existing Major Site Plan for the facility providing for the addition of 52,513 sq. ft. to the existing 88,364 sq. ft. boat manufacturing facility. 3. On August 24, 2004, the Board of County Commissioners approved Resolution 04-211 granting a second Major Adjustment to the existing Major Site Plan for the facility providing for the addition of 26,200 sq. ft. of manufacturing space to this facility. 4. On October 18, 2016, the Board of County Commissioners approved Resolution 2016-178 granting a third Major Adjustment to the existing Major Site Plan for the facility, providing for the addition of 17,200 sq. ft. of building area with associated parking/vehicular use areas, to the existing S-2 Yachts (Pursuit Boats) manufacturing facility, bringing the total allowable square footage of the facility to 208,672 sq. ft. On April 2, 2019, the Board of County Commissioners approved Resolution 2019-061 granting a fourth Major Adjustment to the Major Site Plan to add 111.42 +/- acres to the original 20.81 project site and provide for a 569,430 sq. ft. expansion, totaling nearly 785,000 sq. ft., at build-out of multiple phases. 6. In 2020, Pursuit Boats completed the Phase 1 expansion that included a 181,800 sq. ft. facility, parking, stormwater and preserve land transfers to St. Lucie County. The completed Phase included compliance with several binding conditions of approval. 7. On August 17, 2021 this Board considered this petition at their public meeting. 8. The St. Lucie County Development Review Committee has reviewed the Major Adjustment to the Major Site Plan, as depicted on Exhibit C, for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Resolution. 9. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 10. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 11. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 12. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. The property on which the Major Adjustment to Major Site Plan is being granted is described as follows: Two parcels of land lying in Section 32, Township 34 South, Range 40 East, St. Lucie County, Florida and being more particularly described as follows; The Northwest 1/4 of Section 32, Township 34 South, Range 40 East, less the following portions thereof: the West 1/2 of the Northwest 1/4 of the Northwest 1/4; and less August 17, 2021 Resolution No. 2021-329 Page 2 File No.: SPMj-6202126075 the North 40 feet of the Northwest 1/4; and less the South 125 feet of the Northwest 1/4; and less the West 1,174.41 feet of the Southwest 1/4 of the Northwest 1/4; and less the West 700 feet of the East 3/4 of the North 1/2 of the Northwest 1/4, and less that parcel of land more particularly described as follows; Begin at the intersection of the North right-of-way of Fort Pierce Farms Water Management District (FPFWMD) Canal No. 1 and the Southwest corner of Lot 28, Block 15C, according to the plat of SAN LUCIE PLAZA, as recorded in Plat Book 5, Page 57, Public Records of St. Lucie County, Florida; thence S89°58'03"W, a distance of 1493.54 feet; thence N00°09'35"E, a distance of 291 .75 feet; thenceN89°58'03"E, a distance of 1493.51 feet; thence SOO°09'35"W, a distance of 291.75 feet to the North right-of-way line of Canal No. 1 and the POINT OF BEGINNING. and less that parcel of land for additional right-of-way as recorded in Official Records Book 4407, Page 1903, Public Records of St. Lucie County, Florida Containing 69.166 acres of land, more or less. TOGETHER WITH: The West 700 feet of the East 3/4 of the North 1/2 of the NW 1/4 of Section 32, Township 34 South, Range 40 East Less the North 40 feet thereof, all in St. Lucie County, Florida. Less and Except all that parcel of land described by deed recorded in Official Record Book 4080 at page 2379, public records of said St. Lucie County, Florida for right-of-way purposes. Containing 20.460 acres of land, more or less. Containing 89.626 total acres of land, more or less. PARCEL IDENTIFICATION NUMBER(S): 1432-221-0001-000-6 & 1432-211-0002- 000-2 B. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Major Adjustment #5 to the existing Major Site Plan project to be known as Pursuit Boats, as depicted in Exhibit C, is hereby approved as shown on the site plan drawings for the project prepared by Culpepper & Terpening, Inc. dated August 9, 2021 and date stamped received by the St. Lucie County Planning & Development Services Department on August 9, 2021, subject to the following conditions: Planning and Development Services — Planning Division 1. Within 90 days, the property owner(s), the developer, his successors or assigns shall record a unity of title in a manner and scope acceptable to St. Lucie County to ensure exclusive functionality of the primary parcels of development (Parcels 1432-221-0001-0006 & 1432-211-0002-0002). 2. The property owner(s), the developer, his successors or assigns shall install or extend the ingress turn lanes (eastbound right-turn lane and westbound left-turn lane) within the right-of-way at the intersection of St. Lucie Boulevard and August 17, 2021 Resolution No. 2021-329 Page 3 File No.: SPMj-6202126075 Industrial 33rd Street and modify the western (primary) driveway to provide exclusive left and right turn egress lanes in order to decrease the amount of internal queuing during the peak hours, prior to a Certificate of Occupancy for Phase 4 development as depicted on the site plan. 3. All boat manufacturing activities shall occur within an enclosed structure, with exception of designated covered and screened space(s). Public Works Department, Engineering & Water Quality Divisions 4. Prior to issuance of the Site Development Permit for the next development phase, the Site Plan shall demonstrate compliance with required dimensional standards for the new angled parking and applicable ADA requirements. C. The approvals and authorizations granted by this Resolution shall expire on August, 17, 2023 unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. D. The developer is advised as part of this Major Adjustment approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non-severable part of the site plan approval granted by this Resolution. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. F. A revised Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on August 17, 2021. G. This Resolution shall become effective upon the date of recording. Should the property owner, developer or authorized agent wish to appeal any condition August 17, 2021 Resolution No. 2021-329 Page 4 File No.: SPMj-6202126075 described in Part B above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Resolution, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Resolution be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. H. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. I.
