AN ORDER APPROVING A LOT SPLIT FOR A PROPERTY
CONSISTING OF 72.54-ACRES LOCATED ON THE NORTH SIDE OF
MIDWAY ROAD, WEST OF SHINN ROAD, FOR DEAN DEKKER
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the application for a Lot Split submitted by Dean Dekker, evaluated the comments
of the St. Lucie County Development Review Committee, and made the following
determinations:
1. The Lot Split application is approved for the property consisting of 72.54-acres, which
holds a zoning designation of AG-5 (Agricultural - 5), located on the north side of
Midway Road, and west of Shinn Road, and legally described as follows:
LEGAL DESCRIPTION (Subject Property):
ALL THAT PART OF THE NORTHWEST 1/4 OF SECTION 6, TOWNSHIP 36
SOUTH, RANGE 39 EAST, ST. LUCIE COUNTY, FLORIDA LYING SOUTH OF
STATE ROAD NO. 70, LESS AND EXCEPT RIGHT-OF-WAY FOR C.R. 712
(MIDWAY ROAD) AND LESS AND EXCEPT RIGHT-OF-WAY FOR C.R. 609A
(SHINN ROAD).
DIVIDED AS FOLLOWS:

2. The Development Review Committee has reviewed the lot split application for the
subject property and found it to meet the technical requirements of the St. Lucie
County Land Development Code and has satisfied the standards of review set forth in
Section 11.03.04(D) of the St. Lucie County Land Development Code.
3. Planning staff has provided an analysis of the eligibility for a one-time split of Parcel
ID: 3306-210-0002-000-7, pursuant to Section 11.03.04 of the St. Lucie County Land
Development Code. The analysis can be found in the memorandum dated September
16, 2021, entitled Dekker, Dean Lot Split- LS-7202025786.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director
of St. Lucie County, Florida:
A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the
Dekker, Dean Lot Split is hereby approved by the Planning and Development Services
Director as shown on the boundary survey prepared by John J. Rice, P.S.M.,
Tradewinds Surveying Group, LLC, dated February 17, 2020, and revised through
August 2, 2021, subject to the following conditions:

1. Within ninety (90) days of Lot Split approval or prior to the submittal of a Building
Permit, whichever occurs first, the applicant, property owner, developer, their
successors or assigns, shall submit an updated survey identifying the ultimate one
hundred sixty (160) foot right-of-way width along Midway Road.
2. Within ninety (90) days of Lot Split approval or prior to the submittal of a Building
Permit, whichever occurs first, the applicant, property owner, developer, their
successors or assigns, shall convey to St. Lucie County in a manner or form
acceptable to the County Attorney, fifteen (15) feet of right-of-way along Midway
Road.
3. Within 30 days of Lot Split approval, the applicant shall record two (2) warranty
deeds in the public records, in accordance with the survey dated February 17,
2020, and revised through August 2, 2021, prepared by John J. Rice, P.S.M.,
Tradewinds Surveying Group, LLC, and as follows:
a. Parcel "A": Warranty Deed shall reflect the newly created 58.38-acre tract
of land.
b. Parcel "B": Warranty Deed shall reflect the newly created 14.16-acre tract
of land.
4. No further division of the property is permitted unless a final record plat is
submitted in accordance with Section 11.03.04 of the Land Development Code.
B. St. Lucie County is not responsible for the maintenance, up-keep, or improvement of
any private drives, roads, streets, easements, or rights-of-way providing ingress and
egress or drainage service to the subject property.
C. A copy of this Order shall be attached to the boundary survey described in Part "A"
and shall be placed on file in the Planning and Development Services Department.
D. This Order shall be recorded in the Public Records of St. Lucie County.
