LUCIE COUNTY GRANTING A MAJOR ADJUSTMENT TO THE FAIRWINDS GOLF COURSE MAJOR SITE PLAN ON +/- 248 ACRES OF PROPERTY LOCATED GENERALLY AT 4400 FAIRWINDS DRIVE IN ST. LUCIE COUNTY, FL. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Fairwinds Golf Course presented a petition for a Major Adjustment the Major Site Plan known as Fairwinds Golf Course, known as the "Fairwinds Golf Course Cart Barn Replacement & Overflow Parking", to replace the existing 3,300 sq. ft. golf "cart barn" with a 7,500 sq. ft. replacement and add 20-25 overflow parking spaces, located generally at 4400 Fairwinds Drive in the I (Institutional) Zoning District on an approximate 248-acre subset of land as described in Part A. 2. In 1990, Fairwinds Golf Course was established by St. Lucie County, featuring as an 18-holegolf course designed atop a former public landfill. The course features a clubhouse, restaurant and bar, golf pro shop, screened patio, golf cart storage "barn" and maintenance shop. 3. On September 7, 2021 this Board considered this petition at their public meeting. 4. The St. Lucie County Development Review Committee has reviewed the Major Adjustment to the Major Site Plan, as depicted on Exhibit C, for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Resolution. 5. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 7. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. The property on which the Major Adjustment to Major Site Plan is being granted is described as follows (portion of): 20 34 40 S 1/2 OF SEC (325.01 AC) (AS PER HB 4029 EFF 10/1/98) & 19 34 40 SE 1/4 AND E 1/2 OF SE 1/4 OF SW 1/4 AND SW 1/4 OF SE 1/4 OF SW 1/4 AND 4.70 AC IN SE COR OF SW 1/4 OF SW 1/4 (197.94 AC) (ASPER HB 4029 EFF 10/1/98) (OR 3129-1017) Containing 523 acres of land, more or less. PARCEL IDENTIFICATION NUMBER(S): 1420-311-0001-000-5 & 1419-334-0001- 000-2 B. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Major Adjustment to the Major Site Plan project to be known as Fairwinds Golf Course, as depicted in Exhibit C, is hereby approved as shown on the site plan drawings for the project prepared by St. Lucie County Staff date stamped received by the St. Lucie County Planning & Development Services Department on August 2, 2021, subject to the following conditions: Planning & Development Services — Planning Division 1. The Planning Director shall review the final architectural design for the cart barn. Environmental Resources Department 2 Prior to issuance of the Site Development Permit, the Parking Lot Landscape Plan shall be updated, to comply with the Landscape Development Code, featuring all native tree species for required plantings. 3. Prior to issuance of a Vegetation Removal Permit or Exemption, listed species surveys may be required per state and/or federal survey protocol. Should any listed species be found as a result of these updated surveys appropriate permits from state and federal agencies shall be required. 4. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive species shall be eradicated from the site. September 7, 2021 Resolution No. 2021-349 Page 2 C. The approvals and authorizations granted by this Resolution shall expire on September 7, 2023 unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. D. The developer is advised as part of this Major Adjustment approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non-severable part of the site plan approval granted by this Resolution. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. F. A revised Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on September 7, 2021. G. This Resolution shall become effective upon the date of recording. Should the property owner, developer or authorized agent wish to appeal any condition described in Part B above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Resolution, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Resolution be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. H. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. I.
