Extinguishment. If circumstances arise in the future such as render the purpose of this Easement impossible to accomplish, this Easement can only be terminated or extinguished, whether in whole or in part, by judicial proceedings in a court of competent jurisdiction, and the amount of the proceeds to which Grantee shall be entitled, after the satisfaction of prior claims, from any sale, exchange or voluntary conversion of all or any portion of the Property subsequent to such termination or extinguishment, shall be determined, unless otherwise provided by Florida law at the time, in accordance with paragraph 18. Grantor believes that any changes in the use of neighboring properties will increase the benefit to the public of the continuation of this Easement, and Grantor and Grantee intend that any such changes shall not be deemed to be circumstances justifying the termination or extinguishment of this Easement. In addition, the inability of Grantor to conduct or implement any or all of the uses allowed under the terms of this Easement, or the unprofitability of doing so, shall not impair the validity of this Easement or be considered grounds for its termination or extinguishment. 18. Proceeds. This Easement constitutes a real property interest immediately vested in Grantee, which, for the purposes of paragraph 17,the parties stipulate to have a fair market value determined by multiplying the fair market value of the Property unencumbered by the Easement (minus any increase in value after the date of this grant attributable to improvements) by the ratio of the value of the Easement at the time of this grant to the value of the Property, without deduction for the value of the Easement, at the time of this grant. For the purposes of this paragraph, the ratio of the value of the Easement to the value of the Property unencumbered by the Easement shall remain constant. TO HAVE AND TO HOLD unto Grantee forever. The covenants, terms, conditions, restrictions and purposes imposed with this Conservation Easement shall be binding upon Grantor, and shall continue as a servitude running in perpetuity with the Property. The property is identified by the St. Lucie County Property Appraiser as parcel identification number (PIN): 2309-210-0000-000-9. The parcel is further generally located at Latitude 27° 26' 58.76" N and Longitude 080° 26' 28.63" W. See Appendix A, Figures 1 & 2 for site and location maps. The site's natural features consist of two (2) state jurisdictional isolated herbaceous wetlands and pine flatwoods upland habitat, encompassing the majority of the property. The onsite wetlands include a ±8.16-acre isolated vegetated non-forested wetland, classified as a Category II Wetland, and a small non county regulated ±0.17-acre vegetated non-forested wetland. Onsite wetlands have been verified by the South Florida Water Management District (SFWMD). See Appendix B for the SFWMD approved wetland jurisdictional determination. Remaining areas on the property include two (2) ponds/lakes, classified by the SFWMD as other surface waters (OSW's), improved pasture for cattle grazing and equestrian use, a barn, and the property access road. Additionally, water conveyances/swales permitted by the North St. Lucie River Water Control District (NSLRWCD) are located along the east and west sides of the access road. See Appendix A, Figure 3 for the site FLUCCS/Habitat Map. The proposed project is for the subdivision of the property into nine (9) individually platted lots. No development of the property beyond what currently exists is proposed. The project is solely a lot split with entrance road improvements. Each individual lot owner will be required to apply for land clearing and development approvals and shall be subject to all applicable County regulations with regards to preservation of trees, native uplands, and wetlands. This Preserve Area Management Plan (PAMP) shall apply to the ±8.16-acre Category II isolated vegetated non-forested wetland and associated upland buffer, as well as the littoral and upland transitional zones areas surrounding the two (2) onsite lakes to be referenced as Lot 3 Lake and Lot 7 Lake. Based on the development intent of a lot split and entrance road improvements only, no further preservation areas are required in association with the platting of the Palmetto Flats nine (9) lot subdivision. The vegetative success criteria for the ±8.16-acre wetland preserve area and lake vegetative areas (littoral and upland transitional zones) includes the goal of 80% aerial coverage of native vegetation within 2 years, exotic vegetation at zero percent and nuisance vegetation limited to five percent or less within the preservation areas. Page 3 of 8 171quatic BESMIRCH Monitoring. _ui_ment, oe lo_meant. Llc PIN:2309-210-0000-000-9 Tindall Holdings April 2021 These areas should undergo periodic maintenance to support native conditions including, but not limited to, hand removal and herbicidal treatment of exotic and invasive plant species. Maintenance of the preserve areas will be perpetual and ultimately the responsibility of the property owner. 2.0 Marking and Barricades The proposed wetland preservation area and Lot 3 and Lot 7 lakes will be protected from possible non-natural surface water flows and sediment runoff by the placement of silt screens, or other turbidity control measures, at or outside of the area perimeter, prior to land clearing/site development. Preserve areas will not be fenced off permanently, rather appropriate preserve area signage will be placed at the corners and every 120-feet along the wetland preserve area border only. Preservation signs will not be necessary around the lakes. The locations of preserve area signs are indicated on the preservation area map (Appendix A, Figure 4). A sample preserve area sign is also included in the Appendix C. 3.0 Preservation The wetland preservation area, which includes the ±8.16-acre jurisdictional wetland and associated pine flatwoods upland buffer, will be enhanced, preserved, and maintained in perpetuity. The specific activities include eradication of nuisance and exotic vegetation, and preservation. A native littoral and upland transitional zone shall be created around the Lot 3 and 7 lakes. These zones shall encompass 10 sq ft of planting for every linear foot of existing shoreline. Existing native vegetation, if present, shall be incorporated into these zones. Each of these activities is described in detail as follows. 3.1 Eradication of Nuisance and Exotic Vegetation All nuisance and exotic vegetation listed by the Florida Exotic Pest Plant Council, as may be updated or revised, will be eradicated from the wetland and lake preserves. The primary exotic vegetation that occurs within the wetland preserve is Melaleuca and Brazilian pepper. It is present in densities that vary from 20 percent coverage up to nearly 100 percent spot coverage in areas. No significant amounts of exotic vegetation are currently present around the lakes. • All Brazilian pepper trees and other woody exotics will be eradicated by cutting of the trunk and treatment of the stump with an appropriately labeled herbicide. All vegetative debris will be removed from the preserves and disposed of offsite. Page 4 of 8 quatic HESCH Monitoring. -- Equ iimment tDeolo ment. Lic PIN: 2309-210-0000-000-9 Tindall Holdings April 2021 • The criterion for completion of the woody exotic eradication will be 100 percent kill. If initial eradication efforts do not achieve this criterion, follow up treatment will be conducted. • Any debris removed will be handled in accordance with the disposal specifications. • All eradication of non-woody exotic vegetation such as Old-World Climbing Fern will be through application of appropriately labeled herbicide. • The criterion for acceptance of eradication for all non-woody exotic vegetation will be 100 percent kill. If initial eradication efforts do not achieve this criterion, follow up treatment will be conducted. The exotic vegetation eradication in the preserve areas will generate vegetative debris that requires disposal. There will be a staging and storage area provided adjacent to the preserves on the proposed project site, outside the limits of the preserves. Transport of vegetative debris from the preserves to the staging area will be conducted in a fashion that minimizes the distribution and dispersal of seeds from such debris. • No cut exotic or nuisance vegetative material will be left in the preservation areas. • All vegetative debris, either whole or chipped/mulched will be hauled off site and disposed of at a landfill or other such appropriately licensed facility. Herbicides are required for the treatment of all stumps of woody vegetation to prevent re-growth, and for eradication of non-woody exotic and nuisance vegetation. • All herbicide application activity will be conducted under the supervision of a Florida Department of Agriculture licensed applicator, licensed for application of aquatic herbicides. • All herbicides applied within the preserve must be properly labeled for application in near waterbodies. • All herbicide applied must include a visible tracer dye in the mix to facilitate observation of treated vegetation. • Herbicide application will be done as a spot treatment throughout the preserve and not utilizing a broadcast methodology. PIN:2309-210-0000-000-9 Tindall Holdings April 2021 3.2 Replanting with Native Vegetation The wetland preservation area contains sufficient wetland and upland transitional vegetation; therefore, no supplemental planting will be required post exotic removal. The Lot 3 Lake has 399 linear feet of shoreline and the Lot 7 Lake has 503 linear feet of shoreline. Based on the St. Lucie County Land Development Regulations (6.1.4.4 and 6.02.03 F) and Comprehensive Plan (CP Policy 6.1.2.5 and 6.1.4.4) 10 sq ft of upland and littoral zone plantings are required for every linear foot of lake. Existing native vegetation may be utilized towards fulfillment of the planting requirements. Plantings must encompass at least 50% of the lake's shoreline. No native vegetation is currently present within the immediate vicinity of the Lot 3 Lake. Therefore, sufficient plants to provide a minimum of 80% coverage across 3990 sq ft of the littoral and upland transitional zones shall be installed. See Appendix A, Figure 8 for Lot 3 Lake Planting Plan. The Lot 7 Lake has existing native littoral and upland transitional vegetation along the north side of the lake, consisting of 800 sq ft of littoral zone and 1,900 sq ft of uplands. See Appendix A, Figure 10 Lot 7 Lake Existing Native Vegetation. Therefore, sufficient plants shall be installed adjacent to this area to provide a minimum of 80%cover of native vegetation across 4,230 sq feet of the littoral and 3130 sq ft of upland transitional zones. See Appendix A, Figure 9 for Lot 7 Lake Planting Plan. The success criteria for both Lake 3 and 7 includes the goal of 80% aerial coverage of native vegetation within 2 years, exotic vegetation at zero percent and nuisance vegetation limited to five percent or less within the preservation areas. Please see the enclosed monitoring station map (Appendix A, Figures 5, 6, & 7). Vegetative coverage will be documented at each of the data collection stations. The vegetative coverage will be measured as absolute coverage within an area of approximately 100 square feet at each monitoring station. The vegetation will be measured in percent coverage of the canopy/understory layer and ground cover. The total percent cover will not exceed 100 percent, and each species documented will be reported in both common and Latin names. The coverage will be measured by visual observation in each of four quadrants from the fixed monitoring point. Observations will extend approximately five (5) feet from the observer in each direction thus covering approximately 100 square feet at each station. The data from each quadrant observation will be combined to calculate the vegetative coverage. Page 7 of 8 quatic RESEARCH Monitoring. u----- -- Die Ioat._ . Llc PIN:2309-210-0000-000-9 Tindall Holdings April 2021 At least four (4) photos will be collected from each of the established photo stations to provide documentation of vegetative coverage. Monitoring will be conducted annually for a period of two (2) years. The applicant will submit to inspections of the preserves post planting, exotic vegetation removal and/or permit issuance. 6.0 Maintenance Each monitoring report will include recommendations for maintenance if necessary. The threshold for maintenance requirements will be any area that has five percent or more total vegetative coverage by nuisance or exotic vegetation at any time during the monitoring period. Furthermore, the reports will contain a discussion regarding the percent coverage and apparent success of both lakes' littoral and upland transitional zone plantings. If plantings are trending towards failure recommendations for the installation of supplemental planting will be made. Maintenance will be provided in perpetuity in accordance with permit requirements and County approvals. 7.0 Monitoring/Maintenance Work Schedule The following schedule is based on months after permit issuance Event Months After Permit Issuance Initiate Exotic Removal 1 month Initiate Lake Plantings l month Complete Exotic Removal 2 months Complete Lake Plantings 2 months County Inspection 2 months Conduct Baseline Monitoring/Report Submission 2 months l St Annual Monitoring/Report Submission 14 months 2nd Annual Monitoring/Report Submission 26 months Request County Inspection of Preserve Areas 26 months Page 8 of 8 7quatic RESEARCH Monitoring. ,1111A-- E ui mennt H.REployment.
