LUCIE COUNTY, FLORIDA, TO PROHIBIT PARKING ON INDUSTRIAL AVENUE 1 (NORTH SIDE) FROM N. 25TH STREET TO JEFFERSON PARKWAY; OLEANDER AVENUE FROM ITS INTERSECTION WITH EDWARDS ROAD TO ITS INTERSECTION WITH DIGIORGIO ROAD; AND DIGIORGIO ROAD (BOTH SIDES) FROM ITS INTERSECTION WITH OLEANDER AVENUE TO THE WEST END APPROXIMATELY 1900 FEET; PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING PENALTIES; PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR ADOPTION; AND PROVIDING FOR CODIFICATION WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. DiGiorgio Road is a 60 ft. wide two-way east-west street from Oleander Avenue on the west and dead-ending in an industrial zoned parcel. 2. Industrial Avenue 1 is an 80 ft. wide dirt road that runs approximately east west from 25th Street to Jefferson Parkway. 3. Oleander Avenue is an 85 ft. wide to 70 ft. wide two land road w/posted speed limit of 45 miles per hour. 4. After reviewing complaints of vehicles parked on Digiorgio Road, a No Parking Study was conducted, which included speed and volume on Digiorgio Road (both sides) from its intersection with Oleander Avenue to the west end approximately 1900 feet, the week of June 28, 2021, through July 2, 2021. In addition, traffic crash reports were reviewed for the past three years. 5. After reviewing complaints of vehicles parked on Oleander Avenue, a No Parking Study was conducted, which included speed and volume on Oleander Avenue from its intersection with Edwards Road to its intersection with Digiorgio Road, the week of July 19, 2021, through July 26, 2021. In addition, traffic crash reports were reviewed for the past three years. 6. After reviewing complaints of vehicles parked on Industrial Avenue 1, Code Enforcement investigated the location on six occasions from December 19, 2019, through February 25, 2021, and found up to fifteen vehicles ranging from Commercial semis to -i- Underlined passages are added. St-r-tiek-44-r-fatig14 passages are deleted. unserviceable vehicles parked in this location as shown in the attached photographs. No Parking Signs were installed on March 8, 2021. A No Parking Study was conducted, which included speed and volume on Industrial Avenue 1 (North Side) from N. 25th Street to Jefferson Parkway the week of June 28, 2021, through July 2, 2021. In addition, traffic crash reports were reviewed for the past three years. 7. In order to provide adequate clear zone for the motorist in the event of mechanical failure or the need for evasive maneuvers, and the lack of adequate sight distance combined with the road speed, parking will be prohibited on Digiorgio Road. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida, as follows: PART A. Chapter 46 - "Traffic and Vehicles " of the Code of Ordinances of St. Lucie County is amended to revise Section 46-80 as follows: Section 46.80 Parking Restricted on Certain Streets Section 46.80(b) Angle Road through Darter Court. - no changes. Digiorgio Road (both sides) from its intersection with Oleander Avenue to the west end approximately 1900 feet. Parking is prohibited on both sides. Edwards Road through Indrio Road — no changes Industrial Avenue 1 from 25th Street to Jefferson Parkway, from its intersection with 25th Street west for a distance of two hundred fifty (250) feet. Parking is prohibited on the north side of Industrial Avenue 1 from 25th Street to Jefferson Parkway. Jenkins Road through Oleander Avenue (east side) from West 1st Street to just south of the White School property— no changes. Oleander Avenue (both sides) from its intersection with Edwards Road South to Digiorgio Road. Parking is prohibited on both sides. PART B. PENALTIES Penalties for violation of this section shall be in accordance with State law. -2- Underlined passages are added. Struck through passages are deleted. PART C. CONFLICTING PROVISIONS. Special acts of the Florida legislature applicable only to unincorporated areas of St. Lucie County, County ordinances and County resolutions, or parts thereof, in conflict with this ordinance are hereby superseded by this ordinance to the extent of such conflict. PART D. SEVERABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property, or circumstance, such holding shall not affect its applicability to any other person, property, or circumstance. PART E. APPLICABILITY OF ORDINANCE. This ordinance shall be applicable in the unincorporated area of St. Lucie County. PART F. FILING WITH THE DEPARTMENT OF STATE. The Clerk is hereby directed forthwith to send a certified copy of this ordinance to the Bureau of Administrative Code and Laws, Department of State, The Capitol, Tallahassee, Florida 32304. PART G. EFFECTIVE DATE. This ordinance shall take effect upon filing with the Department of State. PART H. ADOPTION.
