AN ORDER GRANTING A MINOR ADJUSTMENT TO THE MINOR
SITE PLAN FOR THE PROJECT KNOWN AS HILLCREST
MEMORIAL GARDENS LOCATED IN ST. LUCIE COUNTY,
FLORIDA
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the request for a Minor Adjustment to the Minor Site Plan for the project known as Hillcrest
Memorial Gardens including the comments of the Development Review Committee, and has
made the following determinations:
1. SCI Funeral Services of Florida Inc. presented a petition for a Minor Adjustment to the
Minor Site Plan for the project known as Hillcrest Memorial Gardens. The adjustment
includes the addition of a 908 square foot mausoleum measuring fifteen (15) feet in
height. The subject property is located at 6194 N US Highway 1, Fort Pierce, as
described in Part B below.
2. On November 17, 1994, the Community Development Director granted CD 94-015
approving a Minor Site Plan to construct a 11,950 square foot funeral home.
3. On November 18, 1997, the Community Development Director approved a Minor
Adjustment to construct a Memorial Garden east of the established funeral home.
4. On November 9, 2006, the Growth Management Director approved a Minor Adjustment
to a Minor Site Plan for the construction of an 867 square foot mausoleum.
5. The Development Review Committee reviewed the proposed site plan for the project
and found it meets the technical requirements of the St. Lucie County Land
Development Code and has satisfied the standards of review set forth in Section
11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development
Code.
6. Planning Staff has performed a detailed analysis of the project and determined it to be
consistent with the St. Lucie County Land Development Code and Comprehensive Plan.
The analysis is located in the Planning and Development Services Department
memorandum titled Hillcrest Memorial Gardens — Minor Adjustment to the Minor Site
Plan (SPMn-42020257298), dated January 24, 2022.
7. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
8. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through site design, landscaping, and screening.

9. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with St. Lucie
County Land Development Code requirements.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.04(C) of the St. Lucie County Land Development Code, the
Minor Adjustment to the Minor Site Plan is hereby approved as shown on the site plan
prepared by Jose Gonzalez, A.I.A., dated November 11, 2021, and date stamped by the
Planning & Development Services Department on November 29, 2021, subject to the
following conditions:
1) Within 30 days of the recorded order of approval, the applicants, property owners,
developers, successors, or assigns, shall record warranty deeds for a Unity of Title
or a parcel combination within the St. Lucie County Public Records to combine three
(3) contiguous parcels (Parcels Ds: 1405-330-0003-000-1, 1405-330-0002-000-4,
1406-444-0002-000-7) owned by Sci Funeral Services of Florida Inc.
2) Within 90 days of the recorded order of approval, the applicants, property owners,
developers, successors, or assigns, shall convey to St. Lucie County, in a manner
and form acceptable to the County Attorney for a narrow triangle-shaped portion of
land, approximately 1,200 linear feet in length to south on the east side of Old Dixie
Highway totaling approximately 1.77 acres within a parent tract of approximately
26.88 acres of land located at 6194 N US Highway 1 in Section 5, Township 34
South, and Range 40 East in St. Lucie County, Florida.
3) Within 90 days of building permit approval, all Category I listed invasive plants shall
be eradicated from the site.
4) Prior to issuance of a vegetation removal permit or exemption, a 100 percent survey
per Florida Fish and Wildlife Conservation Commission (FWCC) protocol for gopher
tortoises may be required. If any construction activities are proposed within 25 ft. of
any gopher tortoise burrows a relocation permit shall be provided in accordance with
FWCC requirements.
B. The property on which this Minor Adjustment to the Minor Site Plan is being granted is
described as follows:

481.38 FEET NORTH OF THE SOUTH LINE OF SAID SECTION 5: THENCE TURN
AND RUN NORTHWESTERLY ALONG THE WEST RIGHT OF WAY LINE OF
FLORIDA EAST COAST RAILWAY A DISTANCE OF 913 FEET; THENCE TURN AND
RUN WEST 477.3 FEET TO THE WEST LINE OF SECTION 5; THENCE TURN AND
RUN SOUTH ALONG THE SECTION LINE 855.81 FEET TO THE POINT OF
BEGINNING. EXCEPTING THEREFROM RIGHT OF WAY FOR OLD DIXIE HIGHWAY.

C. This Minor Adjustment to the Minor Site Plan shall expire within twenty-four (24) months
of the effective date of this Order, unless a building permit is issued or an extension is
granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County
Land Development Code.
D. The developer, including any successors in interest, is advised as part of this Minor
Adjustment approval, all applicable development permits and construction authorizations
shall be obtained from the appropriate State and Federal and Local regulatory agencies
including, but not limited to, the United States Army Corps of Engineers, the Florida
Department of Environmental Protection, and South Florida Water Management District,
and the St. Lucie County Environmental Resources, Public Works, and Building
Departments prior to the commencement of any development activities on the property
described in Part B. Issuance of this permit by the County does not in any way create
any rights on the part of the developer to obtain a permit from a state or federal agency
and does not create any liability on the part of the County for issuance of this permit if
the developer fails to obtain requisite approvals or fulfill the obligations imposed by a
state or federal agency or undertake actions that may result in a violation of state or
federal law.
E. A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Planning and Development
Services Department and mailed to the developer and agent of record as identified on
the site plan application.
F. This order shall be recorded in the Public Records of St. Lucie County.
