LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence presented, including, but not limited to the staff report, has made the following determinations: 1. The Petition of Phyllis K. Holtzclaw and Layton A. Durrence Jr., for a Variance from the provisions of St. Lucie County Land Development Code Section 7.04.01 — Area, Yard, Height & Open Space Requirements (Table7-10), to allow a detached garage to encroach into the minimum required 30-foot rear yard setback by 3.5-feet, providing a total rear yard setback of 26.5-feet, within the AG-2.5 (Agricultural— 2.5) Zoning District. 2. On January 26, 2022, the Board of Adjustment held a public hearing on the petition, after publishing a notice of such hearing in the St. Lucie News Tribune, installing a sign on property, and notifying by mail all owners of property within 500 feet of the subject property. .Zlor-m mzir=D c)Wn2I 3. After consideration of the testimony presented during the public hearing, o A including staff comments, exhibits, and the standards of review for granting Z A,9 01 variances set out in Section 10.01.02 of the St. Lucie County Land Development A 0 Code, the Board of Adjustment has made the following determinations: D N Z omw ! There are no foreseeable plans to construct the unimproved right-of-way to N N the west of the subject parcel because it would not provide the access N w originally intended; and thus, the variance requested arises from a condition o N that is unique and peculiar to the land involved. b. The adjacent property owner does not have any objections to the proposed Io Variance. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. The Petition of Phyllis K. Holtzclaw and Layton A. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THE WEST 30.00 FEET FOR ROAD RIGHT-OF-WAY. PARCEL CONTAINS 2.278 ACRES TOGETHER WITH: PARCEL B: THE SOUTH 168.00 FEET OF THE NORTH 870.60 FEET OF BLOCK "C" OF THE PLAT OF "FORT PIERCE GARDENS", AS RECORDED IN PLAT BOOK 5, PAGE 61, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THE WEST 30.00 FEET FOR ROAD RIGHT-OF-WAY. PARCEL CONTAINS 2.274 ACRES TOGETHER WITH: PARCEL C: THE SOUTH 168.0 FEET OF THE NORTH 702.60 FEET OF BLOCK "C" OF THE PLAT OF "FORT PIERCE GARDENS", AS RECORDED IN PLAT BOOK 5, PAGE 61, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THE WEST 30.00 FEET FOR ROAD RIGHT-OF-WAY. Based on the evidence presented, this Variance is approved with the condition that the property owner obtain a building permit. C. This variance shall expire twelve (12) months from the date of adoption, unless a building permit is issued or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code. D. This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action must be filed with the courts of the State of Florida within thirty (30) days following the rendition of the decision of this order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. E. This Order shall be recorded in the public records of St. Lucie County.
