AN ORDER GRANTING APPROVAL TO A USE DETERMINATION
RECOGNIZING A SINGLE-FAMILY DETACHED DWELLING UNITAS
A CONFORMING USE AFTER A PROPOSED LOT SPLIT WITHIN
THE IL (INDUSTRIAL, LIGHT) ZONING DISTRICT FOR CERTAIN
PROPERTY LOCATED AT 3105 HAMMOND ROAD, FORT PIERCE,
SITUATED IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the request to allow a Single Family Detached Dwelling Unit to remain a
conforming and permitted use after a proposed lot split within the IL (Industrial, Light)
Zoning District for a site located at 3105 Hammond Road, Fort Pierce, FL, and made the
following determinations:
1. On August 1, 1990, the Board of County Commissioners of St. Lucie County,
Florida, adopted the St. Lucie County Land Development Code and has adopted
amendments to the Land Development Code through certain ordinances.
2. St. Lucie County Land Development Code (LDC) Section 3.01.03 (T)2. v. permits a
single-family detached dwelling unit where located on an existing lot or parcel of
record, as defined in LDC Section 2.00.00 and existing since on or before August 1,
1990. The subject parcel has existed on or before August 1, 1990, and is an
existing lot or parcel of record as defined in LDC Section 2.00.00.
3. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida,
adopted Ordinance 12-003 granting the Planning and Development Services
Director the authority to make the determination after full analysis of all potential
impacts that a proposed use is in compliance with the provisions of the Land
Development Code and the St. Lucie County Comprehensive Plan. The analysis
was provided by staff in the memorandum titled Selph Property Use Determination
dated March 4, 2022, and attached to this Order.

4. On January 21, 2020, Robert V. Schwerer of Hayskar, Walker, Schwerer, Dundas&
McCain, P.A., representing Denice M. Selph, submitted a letter requesting a use
determination to the Planning & Development Services (PDS) Department
requesting an existing Single Family Detached Dwelling Unit be determined as a
permitted use in this zoning district at a site located at 3105 Hammond Road, Fort
Pierce, FL, after a Lot Split that would affect the status as a "Lot of Record."

5. The determination to allow a Single Family Detached Dwelling Unit as a conforming
and permitted use within the IL (Industrial, Light)zoning district is consistent with the
general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan
and the Land Development Code, is in the best interest of the health, safety and
public welfare of the citizens of St. Lucie County, Florida.
6. The proposed determination will not have an undue adverse effect on adjacent
property, the character of the neighborhood, traffic conditions, parking, utility
facilities, or other matters affecting the public health, safety, and general welfare
within the IL (Industrial, Light) zoning district.
NOW, THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT
SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA:
Following a proposed lot split, the existing single family residential use, has been
determined to be consistent with similar permitted uses in the IL (Industrial, Light) Zoning
District, and, as such, is determined to be a permitted use in this Zoning District at a site
located at 3105 Hammond Road, Fort Pierce, FL, with the following conditions:
1. Any future reduction in the parcel size beyond the current Lot Split application
(except for right-of-way acquisition(s)) will invalidate this Use Determination.
2. Before approval of Lot Split, the purchaser of the +1.65-acre western portion
of the parcel shall:
• Provide a Unity of Title connecting the ±1.65 acres with no legal road
frontage with the existing Custom Built Marine site at 3119 Hammond Road.
• File a complete site development plan and zoning compliance for the site(s)
to incorporate the +1.65 acres to be purchased from the Selph
Property, to establish a permitted Industrial Light, IL, use and accessory
Security Quarters.
• Submit a complete building permit application(s) for site
improvements using the +1.65 acres for stormwater retention and/or
other uses consistent with the IL District.
3. Hammond Road is a 60ft County Owned and Maintained Right-of-way. This
Right-of-Way dimension is not uniform to the County's standard dimensions.A five
ft. Right-of-Way dedication is requested with the Lot Split approval.
4. Water service is available at this location via Fort Pierce Utilities Authority (FPUA).
An approved utility construction plan will be required before water service can be
provided.

5. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive
species shall be eradicated from the site.
PART A. SEVERABILITY
If this Order or any provision thereof shall be held to be inapplicable to any person, property,
or circumstances, such holding shall not affect its applicability to any other person, property,
or circumstances.
PART B. APPLICABILITY OF ORDER
This Order shall only constitute approval of an existing Single Family Detached Dwelling
Unit as a permitted use within the IL (Industrial, Light) zoning district for a site located at
3105 Hammond Road, Fort Pierce, FL, with conditions.
PART C. FILING WITH THE CLERK OF COURT
This Order shall be recorded in the Public Records of St. Lucie County.
