JENKINS ROAD, FORT PIERCE, FL WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for the second Minor Adjustment to the Minor Site Plan for the project known as Miller 193 North (AKA Freightliner), the recommendation of the Development Review Committee, and has made the following determinations: 1. Joseph G. Miller JR), Turner Trust Properties LLC., with representative, Brad Currie, AICP of Engineering Design and Construction Inc., filed an application requesting a Minor Adjustment (#2)to the Minor Site Plan to modify lot lines between the approved 22,422 sq. ft. (24,705 gross sq. ft.) Freightliner complex and a future development tract created by the Miller 193 Plat, Plat Book 85 — Pages 1-2. The subject 6.3-acre property is located at 193 N. Jenkins Road, Fort Pierce, within the IL (Industrial, Light) Zoning District. 2. On July 7, 2019, the Planning and Development Services Director approved PDS Order 19-028, granting Minor Site Plan approval for a 17,600 square foot industrial building to support the sale and service of industrial-size trucks. 3. On September 9, 2019, the Board of County Commissioners granted Final Plat approval for a two (2) lot subdivision with Lot 1 totaling 4.2-acres and Lot 2 two totaling 2.06-acres. 4. On June 10, 2020, the Planning and Development Services Director approved PDS Order 2020-037, granting a Minor Adjustment to the Minor Site Plan for 2,283 gross square feet (GSF) building addition, enlarging the approved 17,600 square foot building footprint (22,422 GSF) to 18,530 square feet (24,705 GSF), resulting in a 930 square foot building footprint increase. 5. On October 14, 2020, Joseph G Miller quit claimed the western 131 ft. of Tract A, MILLER 193 NORTH (PB 85-1), to Darby Baird JR), without St. Lucie County approval for a land division. On November 10, 2020, Darby Baird JR) transferred said subset of Tract A to Turner Trust Properties LLC., with said entity joining in the subject Minor Adjustment to Minor Site Plan and corresponding Replat petitions. 6. The Development Review Committee reviewed the proposed Site Plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is in the Planning and Development Services Department memorandum titled Miller 193 North (FKA Freightliner) — Minor Adjustment (#2) to the Minor Site Plan (SPMn-11202126222), dated February 18, 2022. 8. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 9. All reasonable steps have been taken to minimize any adverse effects of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 10. A final record plat (replat) associated with the Minor Adjustment to the Minor Site Plan has been certified by the Development Review Committee. This companion petition will require approval by the Board of County Commissioners prior to recording the replat in public records. NOW,THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: A. Pursuant to Section 11.02.03(C) of the St. Lucie County Land Development Code, the Minor Adjustment to the Minor Site Plan is hereby approved as shown on the Site Plan drawings prepared by Engineering Design and Construction Inc., date stamped by the Planning & Development Services Department on January 11, 2022, subject to the following conditions: 1) Prior to Certificate of Occupancy, include the hedge screening around all proposed dumpster areas. 2) Prior to issuance of a Vegetation Removal Permit or Exemption, a gopher tortoise survey may be required per appropriate state and federal protocols. 3) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive species shall be eradicated from the site. B. The property on which this Minor Adjustment to the Minor Site Plan is being granted is described as follows: LEGAL DESCRIPTION: E, All of Tracts A& B, Miller 193 North, according to the plat thereof, recorded in Plat Book 85 Pages 1-2, Public Records of St Lucie County, Florida. Parcel Identification Numbers:2312-500-0002-000-3, 2312-500-0001-010-9, & 2312-500-0001-000-6 Addresses: 193 North Jenkins Road & TBD Loop Road, Fort Pierce, FL 34947 SPMn-11202126222 Page 2 of 6 PDS 2022-009 C. This Minor Adjustment to the Minor Site Plan shall expire within twenty-four (24) months of the effective date of this Order, unless a building permit is issued or an extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Adjustment to the Minor Site Plan approval for Joseph G. Miller (TR) & Turner Trust Properties LLC., including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. A copy of this Order shall be attached to the Site Plan drawings described in Part A, which then shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the Site Plan application. F. The conditions set forth in Part A are an integral non-severable part of the Minor Adjustment to the Minor Site Plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Site Plan approval granted by this Order shall become null and void. G. The previously issued Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning and Development Services Department Director, and shall remain valid for the period of Site Plan approval.
