LUCIE COUNTY, FLORIDA, REGARDING THE DESIGNATION OF -A o STRUCTURES SITUATED AT 9809 SOUTH INDIAN RIVER DRIVE AS o m HISTORICALLY SIGNIFICANT 0 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on t r testimony and evidence, including but not limited to the staff report, has made the followi ° determinations: 73 1. Linda Ash-Jackson and Paul Jackson, represented by Brian Anderson, Esq., request to demolish three (3) structures situated at 9809 South Indian River Drive, as depict on Exhibit A and described in Part B. 2. On March 15, 2022, this Board held a public hearing on the petition, for which public notice was published in the St. Lucie News Tribune, the property posted (notice on the primary structure's door) and a notice was mailed to all property owners within 1,000 feet at least 15 days prior to the hearing, with additional notice provided to the property owner and representative. 3. On August 9, 2021, the Historic Preservation Officer notified the Historical Commission of the proposed demolition. After discussion, the Historical Commission voted to examine the historical significance of the structures further. 4. On January 4, 2022, the Historical Commission held a Public Hearing regarding the potential Historic Designation of the subject structures. After discussion, the Historical Commission passed a motion to recommend the Board of County Commissioners disapprove designation of the structure as a locally significant resource. • 7. Planning Staff has performed a detailed analysis of the site and determined it to be eligible for designation of the structure as a locally significant resource, however the condition of and notable alterations to the structures present dimmish their historical significance, with a report published and causing review proceedings in accordance with Sections 4.11.06 A. and B. of the St. Lucie County Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Sections 4.11.06 A. and B. of the St. Lucie County Land Development Code, the structures present on land described in Part B and located on as shown in Exhibit"A" shall not be designated as locally significant historic structures. B. The subject property on which this designation is considered is described as follows: LEGAL DESCRIPTION: All land East of the Florida East Coast Railroad Right-of-Way of the following described tract of land: The North 300 feet of the South 950 feet of the following described tract of March 15, 2022 Resolution No. 2022-046 Page 1 • land: COMMENCING at the water's edge of Indian River and at the Northeast corner of land of Albert Ernest Schaef, and running thence West along the North line of Schaefs land and parallel with the 25 1/2 chains South of the Northern lines of Sections 29 and 30, Township 36 South, Range 41 East, St. Lucie County, Florida, 40.20 chains, more or less, to the West line of the East 1/2 of the Northeast 1/2 of Section 30, same Township and Range; thence North along the West line of the East 1/2 of the Northeast 1/4 of said Section 30, a distance of 22.38 chains, more or less, to a point which is 3.12 chains South of the Northern line of Section 30; thence East parallel with the Northern lines of Sections 30 and 29 of said Township and Range, 29 chains, more or less, to the Indian River; thence along the water's edge of the Indian River in a Southeasterly direction, 34 chains, more or less, to the Point of Beginning; together with the submerged lands lying between the upland and the channel of the Indian River; but reserving out of and excepting from the above described property a right of way 100 feet in width, being 50 feet in width on each side of the center of the track of the F.E.C. Railroad Company is constructed through said lands. Less and except all rights of way for public roads and the Florida East Coast Railroad Company. A more modern description of said lands being described as follows: From the Northwest corner of Section 29 Township 36 South Range 1 East, St. Lucie County, Florida, run South 733 feet; thence East to Easterly right of way of F.E.C. Railroad and Point of Beginning; then continue East to the Indian River, and then run Southeasterly along Indian River 220 feet; then run South 801 degrees 15 minutes West 244 feet to a concrete monument; thence run West to a point on the Easterly right of way of F.E.C. Railroad; then run Northwesterly along F.E.C. Railroad; then run Northwesterly along F. E. C. railroad right of way to Point of Beginning, Less Indian River Drive. Parcel Idefitification Number: 3529-223-0001-000-5 Location: 9809 S. Indian River Drive. C. The action determined by this Resolution shall not have an expiration date. D. The developer is advised as part of this action, that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable demolition or development permits and construction authorizations for future site actions from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works (including an exception to a Mining Permit), and Building Departments prior to the commencement of any demolition or development activities on the property described in Part B. G. This Resolution shall become effective upon the date of recording. Should the property owner, developer or authorized agent wish to appeal, all such appeals must be filed with the applicable Court. Should an appeal to this Resolution be filed, no permitting reviews March 15, 2022 Resolution No. 2022-046 Page 2 • or further administrative action shall take place on the processing of this development project until the appeal is resolved. H. A recorded copy of this Resolution shall be placed on file with the St. Lucie County Planning & Development Services Department Director. I.
