MILLER, CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE # 5034515 05/05/2022 09:06:56 AM DR BOOK 4819 PAGE 519 - 524 Doc Type: ORD RECORDING: $52.50 PDS ORDER 2022-016 File No.: SPMn- 12202025906 AN ORDER GRANTING A MINOR ADJUSTMENT TO THE MAJOR SITE PLAN FOR THE PROJECT KNOWN AS FIRST SOURCE COMMERCE PARK FOR PROPERTY LOCATED AT 873 S KINGS HIGHWAY WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Major Site Plan for the project known as First Source Commerce Park, the recommendation of the Development Review Committee, and has made the following determinations: Rhonda Counes of the First Source Commerce Park Condominium, property owner, and representative, Shane Munson, PE, of Munson Design & Consulting, Inc. filed an application requesting a Minor Adjustment to the Major Site Plan to improve an additional fifty-six (56) parking spaces. This adjustment encompasses paving forty-nine (49) parking spaces in the rear of the complex, previously approved as "Future Reserved Parking", and seven (7) new spaces adjacent the primary entrance, preserving trees were possible, installing complimentary landscaping and adjusting stormwater where necessary to support the site improvements. This modification will supply the complex with 317 paved parking spaces. The subject 17.05-acre property is located at 873 S. Kings Highway, Fort Pierce, within the IL (Industrial, Light) Zoning District. 2. On April 5, 2000, the Board of County Commissioners approved the Major Site Plan known as the First Source Commerce Park, containing 190,481 sq. ft. of space with up to 309 Parking Spaces on land referenced above and described in Part B. 3. October 20, 2006, the Planning and Development Services Director granted a Minor Adjustment to the Major Site Plan to amend Fire Pump System and Loading Area. 4. On November 16, 2006, the Planning and Development Services Director granted approval granted a Minor Adjustment to the Major Site Plan to allow walls in the loading area. 5. The Development Review Committee reviewed the proposed Site Plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 6. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department memorandum titled First Source Commerce Park Minor Adjustment to Major Site Plan (SPMn- 12202025906), dated April 25, 2022. 7. All reasonable steps have been taken to minimize any adverse effects of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. NOW, THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: A. Pursuant to Section 11.02.04 and 11.02.07 of the St. Lucie County Land Development Code, the Minor Adjustment to the Major Site Plan is hereby approved as shown on the Site Plan drawings prepared by Munson Design & Consulting, Inc., revised through January 20, 2022, and date stamped by the Planning & Development Services Department on January 21, 2022, subject to the following conditions: Environmental Resources Department 1) Within 90 days of site development permit or building permit approval, landscaping within the landscape buffers adjacent to the proposed parking areas shall comply with the original landscape plan as approved per the First Commerce Park major site plan (MJSP_04-0 23). Public Works Department 2) Prior to the issuance of a Site Development Permit, the construction plans shall provide: a. The published benchmark for site elevations. b. The current FIRM panel and revised date. c. The current pavement standard of SP-9.5. d. The parking detail to provide for full storage depth, with the wheel stop exclusive of the 16' of asphalt length. e. A table that identifies the existing, permitted allowable and proposed impervious area. Provide evidence of SFWMD permitted conditions for impervious area. If a permit modification and additional treatment is required, calculations shall be provided to the County for review. B. The property on which this Minor Adjustment to the Major Site Plan is being granted is described as follows: LEGAL DESCRIPTION: A PORTION OF A PARCEL OF LAND LYING IN THE SOUTHEAST 1/4 OF THE SOUTHEAST 1/4 OF SECTION 11, TOWNSHIP 35, SOUTH RANGE 39 EAST, ST. This Minor Adjustment to the Major Site Plan for the First Source Commerce Park shall expire within twenty-four (24) months of the effective date of this Order, unless a building or site development permit is issued or an extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Adjustment to the Major Site Plan approval for First Source Commerce Park, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. A copy of this Order shall be attached to the Site Plan drawings described in Part A, which then shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the Site Plan application. F. The conditions set forth in Part A are an integral non -severable part of the Minor Adjustment to the Major Site Plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Site Plan approval granted by this Order shall become null and void. A Certificate of Capacity Exemption, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning and Development Services Department Director, which shall remain valid for the period of Site Plan approval.
