HomeMy WebLinkAbout22-004 - BoABOARD OF ADJUSTMENT RESOLUTION NO. 2022-004 File No.: BA - 2202226278 A RESOLUTION APPROVING A VARIANCE FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: Petition of Jayson Oneschuk of Carr Investments Properties Inc. JR), for a Variance to install staircases for access to a mobile home to encroach 1.6 feet into the required 25- foot front yard setback and 3 additional feet into the required 15-foot rear yard, for a total front yard setback of 23.4 feet and a total rear yard setback of 7.9 feet (due to the previously approved encroachment of 4.1 feet into the rear yard setback as set forth in Resolution No. 2021-002), within the RMH-5 (Residential, Mobile Home - 5) Zoning District. 2. On February 24, 2021, the Board of Adjustment approved Resolution No. 2021-002 for a Variance to install a mobile home to encroach 4.1 feet into the required 15-foot rear yard setback, providing a total rear setback of 10.9 feet. 3. On April 27, 2022, this Board held a public hearing on the petition, after publishing a notice of such hearing in the St. Lucie News Tribune, installing a sign on the property and notifying by mail all owners of property within 500 feet of the subject property. 4. After consideration of the testimony presented during the public hearing, including staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The requested Variance has met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because, a. The Board of Adjustment approved the variance for the mobile home to encroach 4.1 feet into the required 15-foot rear yard setback: b. The Variance to allow staircases for pedestrian ingress and egress access into the mobile home, will not impair or injure other property or improvements in the neighborhood in which the subject property is located. c. The Variance requested is the minimum necessary to make possible the reasonable use of the land and mobile home. JR), for a Variance from the provisions of Section 7.04.01 (Table 7-10) - Lot Size and Dimensional Requirements of the St. Lucie County Land Development Code is approved to install staircases for access to a mobile home to encroach 1.6 feet into the required 25-foot front yard setback for a total front yard setback of 23.4 feet and 3 additional feet into the required 15-foot rear yard, for a total rear yard setback of 7.9 feet, for the property depicted on the attached boundary survey as Exhibit "A" and more specifically described as follows: Legal: LOT 1, BLOCK 7, GREEN ACRES UNIT THREE S/D, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 16, PAGE 28 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Address: 5132 Melissa Lane, Fort Pierce, FL. 34946 Parcel ID Number: 1430-702-0049-000-4 B. Based on the evidence presented, this Variance to encroach into the required minimum 25-foot front yard setback and 15-foot rear yard setback is approved. C. This variance approval shall expire twelve (12) months from the date of adoption, unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code. D. This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action must be filed with the courts of the State of Florida within thirty (30) days following the rendition of the decision of this Order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. E. This Order shall be recorded in the public records of St. Lucie County.
