HomeMy WebLinkAbout22-007 - BoABOARD OF ADJUSTMENT RESOLUTION NO. 2022-007 File No.: BA-3202226360 A RESOLUTION APPROVING A VARIANCE FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: Petition of David and Sally Walsh, for a Variance to allow the flagstaff depth of a proposed flag lot to exceed five (5) times the required minimum road frontage. The applicant is proposing a 420.56-foot variance for the overall flagstaff depth of 720.56 feet, within the AG-5 (Agricultural - 5) Zoning District, as legally described in Paragraph B and depicted on the attached boundary survey as Exhibit A. 2. On April 27, 2022, this Board held a public hearing on the petition, after publishing a notice of such hearing in the St. Lucie News Tribune, installing a sign on the property and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The requested Variance has met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because, a. The Lot conforms to the minimum required land area and lot width per LDC Section 7.04.01; b. The Variance is not expected to impair an adequate supply of light or air to adjacent public streets, increase the danger of fire, or endanger the public safety. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. Petition of David and Sally Walsh, for a Variance from the provisions of St. Lucie County Land Development Code Section 2.00.00. (Flag Lot Definition), is approved to allow the flagstaff depth of a proposed flag lot to exceed five (5) times the required minimum road frontage. The applicant is proposing a 420.56-foot variance for the overall flagstaff depth of 720.56 feet, within the AG-5 (Agricultural - 5) Zoning District, for the property depicted on the attached boundary survey as Exhibit "A" and subject to the following condition: 1. A joint access easement designed for a single connection to Header Canal to serve the proposed lots is provided. File No. BA-32022e SAMICHELLE R. The property on which this Variance is being granted is described as follows: Legal: LOT 3, PERSNICKETY FARMS, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 66, PAGE 40, PUBLIC OF ST. LUCIE COUNTY, FLORIDA. Location: West of South Header Canal, approximately 1,108 feet north of Okeechobee Road in the Persnickety Farms Subdivision (Lot 3). Parcel ID Number: 3202-500-0003-000-5 C. Based on the evidence presented, this Variance to exceed five (5) times the required minimum road frontage is approved. D. This variance approval shall expire twelve (12) months from the date of adoption, unless a Site Plan Adjustment or Replat is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code. E. This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action must be filed with the courts of the State of Florida within thirty (30) days following the rendition of the decision of this Order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. F. This Order shall be recorded in the public records of St. Lucie County.
