LUCIE COUNTY, FLORIDA, PERTAINING TO AN APPEAL OF AN ADMINISTRATIVE DETERMINATION OF DENIAL FOR A REASONABLE ACCOMMODATION REQUEST TO HOUSE TEN (10) INDIVIDUALS AT PROPERTY LOCATED AT 201 SE BONITA COURT, PORT ST. LUCIE, FLORIDA, APPLIED FOR BY ANDREW HOOPER. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on testimony and evidence, including, but not limited to the staff report, has made the following determinations: On April 2, 2014, The Board of County Commissioners adopted Ordinance 13-016, creating Land Development Code Section 7.10.30 Reasonable Accommodation Procedures pursuant to Title II of the Americans with Disabilities Act and the Fair Housing Act. 2. On January 27, 2022, Andrew Hooper submitted an application for Reasonable Accommodation to house 10 individuals within a single-family structure on property located at 201 SE Bonita Ct., Port St. Lucie, FL. 3. For reasons stated in a letter dated April 7, 2022, the Planning & Development Services Department Director denied Andrew Hooper's Reasonable Accommodation request. 4. On April 19, 2022, Andrew Hooper requested to appeal the administrative determination in accordance with Land Development Code Section 7.10.30.6. 5. On June 7, 2022, the Board of County Commissioners of St. Lucie County, Florida, held a public hearing for the purpose of reviewing the subject appeal, of which due notice was published in the St. Lucie News Tribune, in accordance with public notice requirements within Land Development Code 11.00.03.B.1. 6. The Board of County Commissioners of St. Lucie County has found the requested Reasonable Accommodation and subsequent appeal by Andrew Hooper to be inconsistent with the standards set forth in Section 7.10.30 of the Land Development Code and has affirmed staff's recommendation of denial of the appeal request without prejudice, as stipulated in the Planning & Development Services Director's letter dated April 7, 2022, and the staff report for the appeal, dated May 8, 2022. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. The requested Reasonable Accommodation and subsequent appeal by Andrew Hooper is not in conformance with Section 7.10.30 of the Land Development Code as stipulated in the Planning & Development Services Director's letter dated April 7, 2022, and the Resolution No. 2022-95 Page 1 File No: RA - 2202226280 staff report for the appeal, dated May 8. 2022, and is denied without prejudice and the applicant allowed to reapply based off subsequent information. B. This Resolution shall be recorded in the Public Records. C.
