A RESOLUTION APPROVING A VARIANCE FOR CERTAIN PROPERTY
LOCATED IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the
testimony and evidence presented, including, but not limited to the staff report, has
made the following determinations:
The Petition of David White for a Variance from the provisions of St. Lucie
County Land Development Code Section 7.04.01 — Area, Yard, Height & Open
Space Requirements (Table 7-10), to allow a mobile home to encroach into the
minimum required 25-foot front yard setback by 11-feet, providing a total 14-foot
front yard setback, and within the minimum required 15-foot rear yard setback by
5-feet, providing a total 10-foot rear yard setback for the mobile home; and to
allow the attached stairs to encroach into the minimum required 25-foot front yard
setback by 14.7 feet, providing a total 10.3-foot front yard setback, and within the
minimum required 15-foot rear yard setback by 8.6-feet, providing a total 6.4-foot
rear yard setback for the attached stairs, within the RS-3 (Residential, Single -
Family - 3) Zoning District.
2. On April 27, 2022, the Board of Adjustment held a public hearing on the petition,
after publishing a notice of such hearing in the St. Lucie News Tribune, installing
a sign on property, and notifying by mail all owners of property within 500 feet of
the subject property and voted to continue the public hearing to a date certain on
June 22, 2022 to allow the Board of County Commissioners an opportunity to
review and make a determination on the concurrently submitted Class "A" Mobile
Home Permit application.
3. On June 7, 2022, the Board of County Commissioners held a public hearing on a
Class "A" Mobile Home Permit, after publishing a notice of such hearing in the St.
Lucie News Tribune, installing a sign on property, and notifying by mail all
owners of property within 500 feet of the subject property and voted to grant
approval of the Class "A" Mobile Home Permit.
4. On June 22, 2022, the Board of Adjustment held the continued public hearing on
the petition after consideration of the testimony presented during the public
hearing, including staff comments, exhibits, and the standards of review for
granting Variances set out in Section 10.01.02 of the St. Lucie County Land
Development Code, the Board of Adjustment has made the following
determinations:
a. The Board of County Commissioners reviewed and granted approval of
the Class "A" Mobile Home Permit application.

b. The proposed detached single-family dwelling and attached accessory
stairs meet the standards of review for Variance Petitions.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie
County, Florida:
A. The Petition of David White, for a Variance from the provisions of St. Lucie
County Land Development Code Section 7.04.01 — Area, Yard, Height & Open
Space Requirements (Table 7-10), to allow a mobile home to encroach into the
minimum required 25-foot front yard setback by 11-feet, providing a total 14-foot
front yard setback, and within the minimum required 15-foot rear yard setback by
5-feet, providing a total 10-foot rear yard setback for the mobile home; and to
allow the attached stairs to encroach into the minimum required 25-foot front yard
setback by 4.7 feet, providing a total 10.3-foot front yard setback, and within the
minimum required 15-foot rear yard setback by 8.6-feet, providing a total 6.4-foot
rear yard setback for the attached stairs, for the property depicted on the
attached boundary survey as Exhibit "A" and more specifically described as
follows:
LEGAL DESCRIPTION:
The North Y2 of Lot 10, Block 15, INDRIO UNIT NUMBER ONE, according to the
map or plat thereof as recorded in Plat Book 5, Page 42, public records of Saint
Lucie County, Florida; more particularly described as follows:
Beginning at the Northwest corner of said Lot 10, run thence Easterly along the
North line of said Lot 10 a distance 160.56 feet, more or less, to the Northeast
corner of said Lot 10; thence run Southerly along the East line of said Lot 10 a
distance of 53.52 feet to a point; thence run Westerly parallel with the North and
South lines of said Lot 10 to a point on the West line of said Lot 10, which is
53.52 feet from the Northwest corner of said Lot 10; thence run Northernly along
the West line of said Lot 10 to the Northwest corner of said Lot 10, being the
Point of Beginning.
Containing 8,028 square feet (0.18-acres)

B. Based on the evidence presented, this Variance is approved with the condition
that the property owner obtain a building permit.
C. This Variance shall expire twelve (12) months from the date of adoption, unless a
building permit is issued or an extension is granted in accordance with Section
10.01.06, of the St. Lucie County Land Development Code.

D. This Order shall become effective upon the date indicated below. An appeal from
the Board of Adjustment's action must be filed with the courts of the State of
Florida within thirty (30) days following the rendition of the decision of this order
in accordance with Section 10.01.07, of the St. Lucie County Land Development
Code.
E. This Order shall be recorded in the public records of St. Lucie County.
