PIERCE, 34982, IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for an administrative mobile home setback variance, including but not limited to the staff report, and made the following determinations: On May 10, 2022, Griselda Zelaya, submitted for an Administrative Variance to allow a replacement mobile home to encroach two feet, five inches (2'5") into the required minimum fifteen foot (15) side yard setback, providing a twelve foot, seven inch (127") side yard setback within the CO (Commercial Office) Zoning District. 2. Planning & Development Services staff has reviewed the proposed Administrative Setback Variance petition and found it to meet the standards of review as set forth in Section 10.01.14.13 of the St. Lucie County Land Development Code. 3. Staff performed a detailed analysis of the petition and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning & Development Services Department memorandum dated July 7, 2022, entitled Griselda Zelaya, Administrative Mobile Home Setback Variance (AV-2205- 000015). 4. The requested encroachment will not have an undue adverse effect on adjacent properties, does not encroach into any easements or common areas, does not conflict with other codes, and otherwise meets the intent and purpose of the general standards for issuing a variance according to Section 10.01.14.B. NOW, THEREFORE, BE IT ORDERED by the Planning & Development Services Director of St. Lucie County, Florida: A. Pursuant to Land Development Code Section 10.01.14.13, the Griselda Zelaya Administrative Variance is hereby approved as shown on the illustration provided by Ms. Griselda Zelaya, dated May 10, 2022, and attached herein as "Exhibit A," subject to the following condition: The Administrative Variance permitting an encroachment into the required fifteen foot (15') side yard setback by two feet, five inches (2'5") for a total side setback of twelve feet, seven inches (127") shall be valid for 12 months and shall automatically expire unless a building permit is issued within 12 months for Unit #72.
