LUCIE BOULEVARD, FORT PIERCE, FLORIDA WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Adjustment to a Major Site Plan submitted by RDD Management Services, Inc., on behalf of International Airport Business Park of St. Lucie County, LLC, and the comments made by the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. On May 10, 2021, RDD Management Services, Inc. filed an application on behalf of International Airport Business Park of St. Lucie County, LLC for a Minor Adjustment to the Major Site Plan known as the St. Lucie County International Airport Business Park, to add three (3) fueling stations (6 fueling positions) and two (2) air/vacuum service stalls to the approved services station and 2,400 square foot convenience store, modification of the parking and landscape design, and eliminating the phased construction plan. The proposal also provides utilities and off-site improvements to Cayuga Avenue and St. Lucie Boulevard. 2. On August 16, 2005, the Board of County Commissioners approved Resolution 05-149, granting a Major Site Plan for the construction of a 27,578.40 square foot flex business/industrial space and a 2,400 square foot convenience store and service station for a total of 29,978.40 square feet of space for the property described in Part "B", within the IL (Industrial, Light) Zoning District, located at 3251 St. Lucie Boulevard. 3. The Major Site Plan approved by Resolution 05-149 was extended by numerous administrative and statutory extensions between May 2007 and August 2021, via PDS Orders as highlighted in the most recently approved order, PDS 2021-038, and highlighted in the Staff Report referenced in Paragraph 10, below. 4. The St. Lucie County Development Review Committee has reviewed the proposed Minor Adjustment to the Major Site Plan and found it to generally meet the technical requirements of the St. Lucie County Land Development Code and Comprehensive Plan, and to have satisfied the standards for Site Plan Review set forth in Section 11.02.07, subject to the conditions set forth in Part "A" of this Page 1 PDS Order No. 2022-007 File No.: SPMn-5202126045 Order. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 7. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring properties, in accordance with applicable district regulations. 8. The proposed project will be served by Fort Pierce Utilities Authority (FPUA) for water services and wastewater services. 9. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the Standards for Site Plan Review outlined under Sections 11.02.04(C) and 11.02.07 of the St. Lucie County Land Development Code, subject to the conditions set forth in Part "A" of this Order. The analysis is found in the Staff Report titled SLC International Airport Business Park - Minor Adjustment to the Major Site Plan (SPMn-5202126045), dated August 1, 2022. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the Minor Adjustment to the SLC International Airport Business Park Major Site Plan is hereby approved as shown on the site plan drawings prepared by RDD Management Services, Inc., dated April 3, 2021 (Revised on July 27, 2022), and date stamped received by the St. Lucie County Planning and Development Services Department on July 27, 2022, as depicted in Exhibit "A", subject to the following conditions: 1. Prior to the issuance of the first Certificate of Occupancy (CO) for the proposed project, the petitioner, successors, or assigns, shall construct a left turn lane for the proposed project on St. Lucie Boulevard. 2. Prior to the issuance of the first Certificate of Occupancy (CO) for the proposed project, the petitioner, successors, or assigns, shall construct a 6-foot-wide sidewalk along the project's frontage on St. Lucie Boulevard. 3. Prior to issuance of a Certificate of Occupancy (CO) all Category I listed invasive plants shall be eradicated from the site. Page 2 PDS Order No. 2022-007 File No.: SPMn-5202126045 4. The revocable license agreement for the fence across Cayuga Avenue right-of-way will be terminated upon issuance of the Certificate of Occupancy (CO). 5. Prior to the issuance of the first Certificate of Occupancy (CO) for the proposed project, the petitioner, successors, or assigns, shall combine the subject parcels (Parcel LD.'s. 1428-702-0634-000-5 & 1428-702-0232-000-7), via a Unity of Title. 6. Should a Major Adjustment to the Major Site Plan be proposed in the future, the project design shall be modified to adhere to Section 7.05.06(C)(2) of the St. Lucie County Land Development Code. B. The property on which this Minor Adjustment to Major Site Plan is being granted is described as follows: LEGAL DESCRIPTION: LOTS 1 THROUGH 18, BLOCK 37, OF "SAN LUCIE PLAZA UNIT ONE", ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 5, PAGE 57, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, AND THE NORTH 1/2 OF VACATED HAWTHORNE ROAD RIGHT-OF-WAY ADJACENT ON THE SOUTH OF LOT 18, LESS THE NORTH 30 FEET OF LOT 1, THE EAST 3 FEET OF LOTS 1 THROUGH 18, AND THE EAST 3 FEET OF THE VACATED RIGHT-OF-WAY OF HAWTHORNE ROAD FOR ROAD RIGHT-OF-WAY. TOGETHER WITH: LOT 1, BLOCK 15A, OF "SAN LUCIE PLAZA UNIT ONE", ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 5, PAGE 57, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, AND THE SOUTH 1/2 OF THE VACATED RIGHT-OF-WAY OF HAWTHORNE ROAD ADJACENT ON THE NORTH OF LOT 1, LESS THE EAST 3 FEET OF LOT 1, AND THE EAST 3 FEET OF THE VACATED RIGHT-OF-WAY OF HAWTHORNE ROAD FOR ROAD RIGHT-OF-WAY. On August 9, 2021, the Planning & Development Services Director granted a Statutory Site Plan Extension, pursuant to Florida Statute Section 252.363, to the scheduled expiration date for the International Airport Business Park Major Site Plan, via PDS Order 2021-038, which shall now expire on July 6, 2029. D. The developer, including any successors in interest, is advised as part of this Minor Adjustment approval for the International Airport Business Park Major Site Plan, all applicable development permits and construction authorizations shall be obtained from the appropriate State, Federal, and Local regulatory agencies Page 3 PDS Order No. 2022-007 File No.: SPMn-5202126045 including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection (FDEP), South Florida Water Management District (SFWMD), and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part "B". Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part "A" above, all such appeals must be filed in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.04(8), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings described in Part "A", which plan shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the site plan application. G. The conditions set forth in Part "A" are an integral non -severable part of the site plan approval granted by this Order. If any condition set forth is Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. H. Pursuant to LDC Section 5.03.04(8)(1), a copy of the Certificate of Capacity Exemption is attached hereto as Exhibit "B" and made a part hereof the Order and was granted by the Planning and Development Services Department Director on August 16, 2005 and shall remain valid for the period of this approval.
