A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
ST. LUCIE COUNTY GRANTING A CHANGE IN ZONING FROM THE AG-
5 (AGRICULTURAL — 5 1 DU/5AC) ZONING DISTRICT TO THE CPUB
(CONSERVATION PUBLIC) ZONING DISTRICT FOR A PROPERTY
LOCATED IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
The property owner, Florida Power & Light Company, and representative Joshua I. Long,
AICP, with Gunster Law Firm, petitioned for an Amendment to the Official Zoning Atlas to
change the zoning from the AG-5 (Agricultural — 5 ldu/5ac) Zoning District to the CPUB
(Conservation Public) Zoning District in St. Lucie County, Florida, for the property legally
described in Paragraph "A" and depicted on the attached map as Exhibit "A".
2. On January 20, 2022, the St. Lucie County Planning and Zoning Commission held a public
hearing on the petition, after publishing a notice at least 10 days prior to the hearing and
notifying by mail all owners of property within 500 feet, and a sign placed on the subject
property and recommended that the Board of County Commissioners approve the change
in zoning from the AG-5 (Agricultural — 5 ldu/5ac) Zoning District to the CPUB
(Conservation Public) Zoning District.
3. On March 1, 2022, this Board held a public hearing on the petition, after publishing a notice
at least 10 days prior to the hearing and notifying by mail all owners of property within 500
feet, and a sign placed on the subject property.
4. The proposed change in zoning has satisfied the requirements of Section 11.06.03 of the
St. Lucie County Land Development Code and is consistent with the goals, objectives,
and policies of the St. Lucie County Comprehensive Plan.
5. The proposed change in zoning is consistent with the existing and proposed use of
property in the surrounding area.
6. A Concurrency Deferral Affidavit, a copy which is attached to this Resolution as Exhibit
"B" was signed by the applicant on March 15, 2022.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:

A. The property on which the Change in Zoning from the AR-5 (Agricultural — 1 1du/5ac)
Zoning District to the CPUB (Conservation Public) Zoning District is being granted is
described as follows:
LEGAL DESCRIPTION:
Being a parcel of land lying in a portion of Sections 19 and 20, Township 37
South, Range 37 East, St. Lucie County, Florida, more particularly described
as follows.
Begin at the Northeast corner of Section 19; thence North 89042'03" East,
along the North line of Section 20, a distance of 1,260.00 feet; thence South
00012' 43" East, a distance of 2,978.03 feet; thence North 65"54'51" West,
a distance of 385.34 feet; thence South 86"12'33" West, a distance of
451.57 feet; thence North 27"45'06" West, a distance of 1,297.80 feet; thence
North 64028'39" West, a distance of 972.54 feet; thence South 46"32'56"
West, a distance of 480.70 feet to a point of curve to the right having a radius
of 373.57 feet and a central angle of 81 "14'24"; thence Westerly along the
arc a distance of 529.68 feet; thence North 07035'41" West, a distance of
45.46 feet; thence South 81 "28'09" West, a distance of 37.79 feet to the
intersection with a non -tangent curve concave to the East, having a radius
of 373.57 feet, the chord of which bears North 21 "15'58" East, 67 4.21 feet;
thence Northeasterly along the arc of said curve, a distance of 840.74 feet
through a central angle of 128'56'57"; thence North 85"44'27" East, a
distance of 344.17 feet; thence North 07"42'51" East, a distance of 245.88
feet; thence North 14"46'25" West, a distance of 587.02 feet; thence North
45"38'24" West, a distance of 170.13 feet to the North line of Section 19; thence
North 89"43'08" East, along the North line of Section 19, a distance of 1,542.08
feet to the POINT OF BEGINNING.

B. The St. Lucie County Planning and Development Services Director shall be authorized to
amend the Official Zoning Map to change the zoning of the property herein described,
from the AG-5 (Agricultural — 5 1 du/5ac) Zoning District to the CPUB (Conservation Public)
Zoning District and to make a notation of the reference to the date of adoption of this
Resolution.
C. A copy of this Resolution shall be mailed, return receipt requested, to the owner and agent
of record as identified on the application.
D. This Resolution shall be recorded in the Public Records.
