HomeMy WebLinkAboutPDS-22-031 - Orchid Island Juice Company Expansion FKA Colonial EngineeringPDS Order 2022-031 File Number: MNSP-2206-000037 AN ORDER GRANTING A MINOR ADJUSTMENT TO THE ORCHID ISLAND JUICE COMPANY EXPANSION (FKA COLONIAL ENGINEERING) MINOR SITE PLAN FOR APPROXIMATELY 11.80 ACRES OF PROPERTY LOCATED AT 1650 DIGIORGIO ROAD IN ST. LUCIE COUNTY, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Minor (Previously Designated a Major) Site Plan for the project known as Orchid Island Juice Company Expansion, the comments of the Development Review Committee, and has made the following determinations: 1. Orchid Island Juice Company, a food product manufacturing operation, represented by Culpepper and Terpening, Inc., presented a petition for a Minor Adjustment to a previously approved Minor Site Plan known as Orchid Island Juice Company Expansion (FKA Colonial Engineering) to add subphase, Phase 1A, to reconfigure an existing parking lot and landscaping for a new loading dock ramp at Natalie's Orchid Island Juice Plant as part of a phased expansion plan up to a 132,168 square foot build -out located at 1650 DiGiorgio Road in the IL (Industrial, Light) zoning district on approximately 11.80 acres of land as described in Part "A". 2. On March 22, 1988, the Board of County Commissioners approved a Major Site Plan for Colonial Engineering to construct an 87,500 square foot warehousing and manufacturing plant. The applicant constructed approximately 55,500 square feet of the approved Colonial Engineering site plan. 3. On June 16, 2020, the Board of County Commissioners approved Resolution 2020-131, granting a Major Adjustment to a Major Site Plan for the facility expansion, in two (2) phases. 4. On June 1, 2021, the Board of County Commissioners adopted Ordinance 2021- 14 which expanded the Minor Site Plan threshold for Targeted Industry projects to 500,000 sq. ft., therefore the subject Site Plan is now considered a Minor Site Plan. 5. On June 15, 2022, Dennis Murphy of Culpepper and Terpening, representing the applicant, filed a request to exercise rights in accordance with the provisions of Executive Order Number 22-27, as issued by the Office of the Governor of the State of Florida on February 2, 2022, and as amended on February 3, 2022, to toll the period of the site plan approval granted by Resolution 2020-131. The Minor Adjustment requested on June 6, 2022, upon approval will extend the site plan approval for twelve (12) months, exceeding the eligible extension pursuant to Executive Order 22-27, therefore this PDS Order shall acknowledge the previously tolling period granted by the State for purposes of acting upon this Adjustment. 7. The St. Lucie County Development Review Committee has reviewed the Minor Adjustment to the Minor Site Plan, as depicted on Exhibit "C", for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part "B" of this Order. 8. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 9. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 10. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 11. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: A. The property on which the Minor Adjustment to the Minor Site Plan is being granted is described as follows: LEGAL DESCRIPTION FROM THE CENTER OF SECTION 28, TOWNSHIP 35 SOUTH, RANGE 40 EAST, RUN NORTH 0 DEGREES 02' 30" WEST ALONG THE 1/ 4 SECTION LINE 37 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE ON THE SAME LINE 717.80 FEET TO THE SOUTH LINE OF F.E.C. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the existing Minor Site Plan project to be known as Orchid Island Juice Company (AKA Natalie's OJ and FKA Colonial Engineering), as depicted in Exhibit "C", is hereby approved as shown on the site plan drawings for the project prepared by Culpepper & Terpening, Inc., dated May 11, 2020 and date stamped received by the St. Lucie County Planning & Development Services Department on May 12, 2020, with the addition of a Phase 1A subphase, approved as shown on the site plan drawings for the project prepared by Culpepper & Terpening, Inc., dated May 20, 2022 and associated Phase 1A landscape plan prepared by Greg Boggs, dated July 9, 2022, subject to the following conditions: 1. Prior to any ground disturbance or impacts to any vegetation, a vegetation removal permit or exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. 2. Prior to issuance of a vegetation removal permit or exemption, for Phases 1 B or 2, a 100 percent survey per Florida Fish and Wildlife Conservation Commission protocol for gopher tortoises shall be provided. A permit from Florida Fish and Wildlife Conservation Commission shall be obtained to relocate any tortoises located within 25 ft. of proposed construction activities. 3. Within 120 days of approval, all Category I listed invasive species shall be eradicated from the parcel per LDC 7.09.05. The ERD Director may extend the removal timeline up to the Certificate of Completion/Final Certification of Phase 1A or similar. 4. Prior to issuance of a Site Development Permit, the applicant shall provide an updated a survey prepared in accordance with applicable regulations, verifying existing drainage structures in contrast with proposed improvements in the Site Development Plan. The Plan shall also provide the existing impervious area and proposed impervious area for Phase 1A. C. The approvals and authorizations granted by this Order shall expire on August 11, 2023 unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. The developer is advised as part of this Minor Adjustment approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part "B" are an integral non -severable part of the site plan approval granted by this Order. If any condition set forth in Part "B" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit "B" and made a part hereof the Order, was granted by the Planning & Development Services Department Director on June 16, 2020 and shall remain valid for the period of this Order. G. A recorded copy of this Order shall be attached to the site plan drawings described in Part "B", which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. H. This Order shall become effective upon the date indicated below. An appeal of the Planning and Development Services Director's action may be processed within thirty (30) days in accordance with Section 11.11.02. A, of the St. Lucie County Land Development Code. I.
