WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
testimony and evidence, including but not limited to the staff report, has made the follom
determinations:
1. The applicant, William Haines, petitioned a Major Adjustment to the approved Lone Pine
Planned Unit Development (PUD) Final Site Plan to relocate the approved driveway
location to serve Lot 13. The property is located within the PUD (Planned Unit
Development) Zoning District. The subject property is located on the south side of Lone
Pine Drive, at the end of the street, west of Oleander Avenue in Fort Pierce, as depicted
on Exhibit A and described in Part B.
2. On August 17, 2004, the Board of County Commissioners approved Resolution 04-095,
authorizing the Lone Pine PUD rezoning and Final Planned Development Site Plan for a
23-lot single-family residential project. The PUD approval is subject to seven (7)
conditions of approval, including that "The driveway locations shall be located in the
areas depicted on the site plan. No alterations may be permitted without a modification
to the PUD plan being reviewed and approved by the Board of County Commissioners."
3. On August 9, 2022, this Board held a public hearing on the petition, for which public
notice was published in the St. Lucie News Tribune, a sign was erected on the property,
and a notice was mailed to all property owners within 500 feet at least 10 days prior to
the hearing.
4. The proposed Major Adjustment to the Lone Pine PUD Final Site Plan is not in conflict
with the Goals, Objectives, and Policies of the St. Lucie County Comprehensive Plan and
have satisfied the requirements of Section 11.02.07 of the St. Lucie County Land
Development Code.
5. Planning Staff has performed a detailed analysis of the project and determined it to be
consistent with the St. Lucie County Land Development Code and Comprehensive Plan,
and in Substantial Conformity with the previously approved PUD. The analysis is found
in the Planning and Development Services memorandum titled Lone Pine PUD - Major
Adjustment to the Planned-Unit Development (PUD) Haines Driveway Relocations, Lot
13 - MJSP-2206-000097, dated July 25, 2022.
6. The proposed Major Adjustment to the Lone Pine PUD(Planned Unit Development) Final
Site Plan will not have undue adverse effect on adjacent property, the character of the

neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the
public health, safety, and general welfare.
7. The St. Lucie County Development Review Committee has reviewed the Major
Adjustment to the Lone Pine PUD (Planned Unit Development) Final Site Plan,
particularly the driveway relocation plan for Lot 13 as depicted on Exhibit B and found it
to meet all technical requirements and is consistent with the Future Land Use Map of the
St. Lucie CountyComprehensive Plan, subject to the conditions set forth in PartAof this

Resolution.
8. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
9. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.02.05 (B)(7) of the St. Lucie County Land Development Code,
the proposed Major Adjustment is in substantial conformity with the Lone Pine PUD is
hereby approved, as depicted on Exhibit "B" and shown on the site drawings for the
project dated July 4, 2022, and date stamped received by the St. Lucie County Planning
& Development Services Department on July 5, 2022, for the property described in Part
B below subject to the following conditions:
1. The previously approved driveway location is abandoned and an easement, or similar
perpetual agreement, is provided by the Homeowners Association for the revised
driveway location.
2. The Conditions of approval contained in Resolution 04-095 shall remain.
B. The property on which this Major Adjustment to the Lone Pine Planned Unit Development
(PUD) is being granted is described as follows:

Overall PUD: Lone Pine Subdivision, according to the Plat thereof, as recorded in Plat Book
51, Page(s) 20-25, Public Records of St. Lucie County
Specific Scope of Adjustment: LONE PINE SUBDIVISION LOT 13 and the Common Area
Tract immediately adjacent to the lot providing driveway access, according to the Plat thereof,
as recorded in Plat Book 51, Page(s) 20-25, Public Records of St. Lucie County
Parcel Identification Number: 3409-505-0018-000-3

C. The approvals and authorizations granted by this Resolution shall remain valid for the
duration of the Lone Pine PUD Final Site Plan.
D. The developer is advised as part of this Major Adjustment approval that the property
owner(s), developer, etc. including any successors in interest, shall obtain all applicable
development permits and construction authorizations from the appropriate State and
Federal and local regulatory agencies including, but not limited to, the United States Army
Corps of Engineers, the Florida Department of Environmental Protection, Florida
Department of Transportation, South Florida Water Management District, and the St. Lucie
County Environmental Resources, Public Works, and Building Departments prior to the
commencement of any development activities on the property described in Part B.
Issuance of this permit by the County does not in any way create any rights on the part of
the developer to obtain a permit from a state or federal agency and does not create any
liability on the part of the County for issuance of this permit if the developer fails to obtain
requisite approvals or fulfill the obligations imposed by a state or federal agency or
undertake actions that may result in a violation of state or federal law.
E. The conditions set forth in Part A are an integral non-severable part of the site plan
approval granted by this Resolution. If any condition set forth in Part A is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the site plan approval granted by this resolution shall become null and
void.
F. A Certificate of Capacity exemption, a copy of which is attached hereto as Exhibit C and
made as part hereof the Resolution, was granted by the Planning & Development Services
Department Director on August 16, 2022.
G. This Resolution shall become effective upon the date of recording. Should the property
owner, developer or authorized agent wish to appeal any condition described in Part A
above, all such appeals must be filed with the applicable Court. Should an appeal to this
Resolution be filed, no permitting reviews or further administrative action shall take place
on the processing of this development project until the appeal is resolved.
H. A recorded copy of this Resolution shall be attached to the site plan drawings described
in Part A, which plan shall be placed on file with the St. Lucie County Planning &
Development Services Department Director.
