LUCIE COUNTY GRANTING APPROVAL FOR A MAJOR ADJUSTMENT TO A MINOR SITE PLAN KNOWN AS FLORIDA COAST EQUIPMENT (AKA KUBOTA TRACTOR) WHEREAS, the St. Lucie County Planning & Development Services Director has reviewed the request for a Major Adjustment to a Minor Site Plan submitted by MDO Engineering Inc. and made the following determinations: 1. Marcos Montes De Oca, P.E. of MDO Engineering Inc. on behalf of SECP FTP LLC. (Successor to TYF Realty Holdings LLC) requested a Major Adjustment to the Minor Site Plan known as Florida Coast Equipment to affirm the as-built floor area of 13,548 sq. ft., modify a condition of approval and incorporate a stabilized area at the north side of the property to stage non-motorized equipment (i.e. trailers), not open for access to the public or deliveries, install a stabilized forklift access to this area and provide landscape screening for the additional operations area to support their retail sales and service establishment. The subject 4.81-acre property is located at the northeast corner of Orange Avenue and Loop Road and lies in the Jenkins Road Special Area Plan Zoning Overlay. The property is zoned IL (Industrial, Light) which is consistent with the MXD (Mixed Use Development) future land use and Fort Pierce Utilities Authority water and wastewater services are provided to the site. 2. On January 14, 2016, the Planning & Development Services Director approved PDS Order 16-003 which granted a Minor Site Plan for a 12,000 square foot retail sales and service facility for tractors and farm equipment. 3. The Development Review Committee has reviewed the Minor Site Plan for the proposed project pursuant to Section 11.02.03 and found it to meet technical requirements of Section 11.02.07 of the Land Development Code and to be consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan. 4. Planning staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services Department Memorandum entitled Florida Coast Equipment (AKA Kubota Tractor) —Major Adjustment to a Minor Site Plan dated September 29, 2022. 5. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 8. A Certificate of Capacity was issued in 2016 and remains valid for the scope of this adjustment, pursuant to Chapter V, St. Lucie County Land Development Code. NOW,THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida. A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Adjustment Minor Site Plan known as Florida Coast Equipment(Kubota Tractor) is hereby approved as shown on the Site Plan drawings prepared by Marcos Montes De Oca, P.E. of MDO Engineering Inc. dated March 25, 2022 and date stamped received by the St. Lucie County Planning & Development Services Department on April 4, 2022 for the property described in Paragraph B subject to the following conditions: 1. All repair activities shall occur within an enclosed building. 2. Amended: The outdoor storage of materials is prohibited with the exception of vehicles,tractors and trailers. Motorized vehicles pert shall be confined to and parked on a paved surface at all times. New equipment or trailers for sale may be staged on an unpaved surface, provided the alternative stabilized surface is approved by the Public Works Department, is in an area denoted on the site plan and remains exclusive of any landscape areas. 3. Prior to the issuance of an updated Zoning Compliance for use of the expanded operations area, a Site Development Permit shall be secured, completed, and successfully inspected. An updated survey, addressing all County Survey Comments dated May 2022, shall be submitted with the Site Development Permit. 4. Within 60 days of vegetation removal permit or exemption issuance, all Category I listed invasive plants shall be eradicated from the site. 5. Within 90 days of site development permit approval, landscaping for the remainder of the site shall comply with the previously approved Florida, Coast Equipment landscape plan (MNSP-720154883, PDS 16-003). The approvals granted by this administrative order shall expire on October 3, 2023, unless building permits are issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Site Plan Adjustment approval for Florida Coast Equipment, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law.
