FOR A PROPERTY CONSISTING OF 40.90-ACRES LOCATED ON THE NORTH SIDE OF ORANGE AVENUE, WEST OF THE FLORIDA TURNPIKE. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Lot Split submitted by Agricoastal Growers, Inc., evaluated the comments of the St. Lucie County Development Review Committee, and made the following determination: 1. The Lot Split application is approved for the property consisting of 40.90-acres, which holds a zoning designation of AG-2.5 (Agricultural-2.5), located on the north side of Orange Avenue, and legally described as follows: LEGAL DESCRIPTION (PARENT TRACT): THE WEST 1/2 OF THE EAST 1/2 OF THE NORTHEAST 1/4 OF SECTION 8, TOWNSHIP 35 SOUTH, RANGE 39 EAST, ST. The Development Review Committee has reviewed the lot split application for the subject property and found it to meet the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.03.04(D) of the St. Lucie County Land Development Code. 3. Planning staff has provided an analysis of the eligibility for a one-time split of Parcel ID: 1326-111-0002-000-9, pursuant to Section 11.03.04 of the St. Lucie County Land Development Code. The analysis can be found in the memorandum dated October 24, 2022, entitled AgriCoastal Growers Lot Split (LS-1202226269). NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Agricoastal Growers, Inc. Lot Split is hereby approved by the Planning and Development Services Director as shown on the boundary survey prepared by Michael T. Owen, PSM, of EDC Inc., dated September 9, 2022, subject to the following conditions of approval: 1. Within 30 days of this Lot Split approval, the applicant shall record two (2) warranty deeds with the St. Lucie County Clerk of Court public records, in accordance with the revised survey dated September 9, 2022, prepared by Michael T. Owen, PSM, and as follows: a. Parcel "A": Warranty Deed shall reflect the newly created legal description, consisting of +/-20.90 acres, and; b. Parcels "B": Warranty Deed shall reflect the newly created legal description, consisting of +/-20.01 acres. 2. Within 90 days of Site Plan approval, the applicant, property owner, developer, successors, or assigns, shall convey to St. Lucie County, in a manner or form acceptable to the County Attorney, 30 feet of right-of-way along the frontage of Orange Avenue. 3, Within 90 days of Site Plan approval, the applicant, property owner, developer, successors, or assigns shall obtain a revocable license agreement for the existing fence in the right-of-way donation area. 4. No further division of the property is permitted unless a final record plat is submitted in accordance with Section 11.03.04 of the Land Development Code. B. St. Lucie County is not responsible for the maintenance, up -keep, or improvement of any private drives, roads, streets, easements, or rights -of -way providing ingress and egress or drainage service to the subject property. C. A copy of this Order shall be attached to the boundary survey described in Part "A" and shall be placed on file in the Planning and Development Services Department.
