LUCIE COUNTY, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Minor Adjustment to a Major Site Plan submitted by EDC Inc., on behalf of Stonemont Financial Group, and the comments made by the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. Stonemont Financial Group, represented by David Baggett, PE of Engineering Design & Const., Inc., applied for a Minor Adjustment to a Major Site Plan to add office space and accommodate final construction plan modifications to an approved 1,348,220 sq. ft. warehouse logistics center, increasing the approved floor area to 1,360,485 sq. ft. on the subject property generally at the intersection of Orange Avenue and Rock Road in the IL (Industrial, Light) zoning district on approximately 103.5 acres of land as described in Part A. 2. On November 2, 2021, the Board of County Commissioners approved Resolution 2021- 390 granting a Major Site Plan known as South Florida Logistics Center to construct 1,348,220 sq. ft. of warehouse distribution space on the subject property. 3. The St. Lucie County Development Review Committee has reviewed the Minor Adjustment to the Major Site Plan, as depicted on Exhibit C, for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Resolution. 4. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County 00 Comprehensive Plan and the Code of Ordinances of St. Lucie County. 0 U o 5. Prior to issuance of a Vegetation Removal Permit or Exemption, whichever comes firsl an approved landscape plan shall be provided to the Environmental Resource Department consistent with LDC Section 7.09.04. The Landscape plan must include ai eight ft. (8') high opaque fence/masonry wall with associated landscaping along the wes perimeter along Rock Road where adjacent to an existing residence per LDC 7.09.04.E The opaque fence or wall shall be articulated per LDC 7.09.04.A. Within ninety (90) days of site plan approval, the property owner(s), the developer, the successors or assigns shall convey to St. Lucie County in a manner or form acceptabl to the St. Lucie County Attorney, additional right-of-way along Rock Road and Orang Avenue. A revised survey verifying existing right-of-way dimensions shall be provide along with the required sketch and legal descriptions, prepared by a Florida license surveyor and mapper. (In Progress) 9. The approvals and authorizations granted by this Order shall expire on November 2, 2023 unless a building permit is secured or a site plan extension is granted in accordance wit[ Section 11.02.06(B)(2), St. Lucie County Land Development Code. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non -severable part of the site plan approval granted by this Order. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. F. A revised Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning & Development Services Department Director on October 18, 2022. G. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part "A" above, all such appeals must be filed in writing with the County Administrator within thirty (30) days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. H.
