HomeMy WebLinkAboutSLV - Emergency Measures. ,. „., ,.. AN ORDER OF THE TOWN OF ST. LUCIE VILLAGE MAYOR ORDERING CERTAIN EMERGENCY MEASURES IN THE TOWN OF ST. LUCIE VILLAGE (SUBTROPICAL STORM NICOLE) WHEREAS,. the Mayor of the Town of St. Lucie Village has made the following determinations: 1. Pursuant'to Section 870.042, Florida Statutes, the Mayor has the power to declare a state of local emergency within the Town of St. Lucie Village to provide for the health and safety of persons and property and to exercise the emergency powers conferred in Sections 870.041 - 870.047, Florida Statutes. 2. The National Hurricane Center has identified Subtropical Storm Nicole as a subtropical storm and has issued a Hurricane Watch for a portion of the east coast of Florida, including St. Lucie County. 3. The Governor of the State of Florida issued Executive Order 22-253 dated November 7, 2022, declaring a state of emergency for the entire State of Florida; and 4. Executive Order 22-253, in accordance with Section 252.38, Florida Statutes, authorizes local governments to take whatever action is necessary to ensure the health, safety and welfare of the community; and 5. The presence of Subtropical Storm Nicole has placed the Town of St. Lucie Village in a state of emergency, exposing the citizens thereof to the threat of imminent violence and to danger to life and property. 6. On November � 2022, at � .m., the Mayor declared a state of local i emergency in the Town of St. Lucie Village (copy attached). 7. In order to respond to such emergency, upon this declaration, the Mayor is authorized to initiate and take such actions authorized by Sections 870.041 - 870.047, Florida Statutes. 8. As a result of the effects of Subtropical Storm Nicole, there is a clear and present danger of civil disorder in the Town of St. Lucie Village and widespread disobedience of the law and it is necessary to order certain emergency measures as hereinafter defined in order to suppress the threat to public peace which now exists and to prevent substantial injury to persons or property. NOW, THEREFORE, I am issuing the following Order: 1. Effective November 2022, at measures are effective in the Town of St. Lucie Village: _.m., the following emergency (A) The sale or distribution of any alcoholic beverage, with or without the payment or a consideration therefor is prohibited. (B) The possession on any person in a public place of any portable container containing any alcoholic beverage is prohibited. (C) All places of public assemblage are closed except designated shelters. 2. This Order shall remain in effect for seventy-two (72) hours unless terminated, modified or extended. This Order shall automatically terminate upon a declaration terminating the state of local emergency or upon further directive of the Mayor or the Board of Aldermen. This Order may be modified at any time by subsequent Orders of the Mayor or the Board of Aldermen. This Order may be extended in not more than seventy-two (72) hour increments by subsequent directives issued by the Mayor with the concurrence of the Board of Aldermen by duly enacted ordinance or resolution in regular or special session. 3. This Order shall, within 3 days after issuance, be filed in the office of the Clerk of the Circuit Court and delivered to the appropriate news media for publication and radio and television broadcast thereof. In addition, this Order shall be available on a dedicated webpage accessible through a conspicuous link on the County's homepage. Signed this day of November, 2022, at _.m.
