LUCIE COUNTY, FLORIDA, AMENDING THE TEXT OF LAND DEVELOPMENT CODE SECTION 4.12.00, JENKINS ROAD AREA PLAN SPECIAL DISTRICT, PARTICULARLY SECTION 4.12.03. A. & B., TO REVISE MAP A, THE REQUIRED INTERNAL ROAD SYSTEM FOR THE JENKINS ROAD AREA PLAN, AND TO CREATE PROVISIONS TO ALLOW ALTERNATIVES TO THE REQUIRED ROAD DESIGN CROSS SECTIONS AS PART OF A PLANNED DEVELOPMENT; PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR ADOPTION; AND PROVIDING FOR CODIFICATION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, desires to encourage economic development through commercial and industrial development with access to the state Strategic Intermodal System; and WHEREAS, the Jenkins Road Area Plan encompasses an I-95 interchange; and WHEREAS, the Jenkins Road Area Plan has contemplated commercial and industrial development within the Plan area; and WHEREAS, the St. Lucie County continues to engage the community planning process and consider adopted and refined regulations for this area based on changes in technology, community goals, transportation needs and market demand; and WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: The KRE Group petitioned for an amendment to Land Development Code (LDC) Section 4.12.00, Jenkins Road Area Plan Special District, specifically proposing to modify Map A within Section 4.12.03. - Road and Trail System, A. The required internal road system for the Jenkins Road Area Plan and amending Subsection B. to create provisions to allow the Board of County Commissioners to approve alternatives to the required road design cross sections as part of a Planned Development. 2. This Board is authorized by Section 125.01(1)(h), Florida Statutes, to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and, 3. This Board is authorized by Section 125.01(1)(t), Florida Statutes, to adopt ordinances and resolutions necessary for the exercise of its powers and to prescribe fines and penalties for the violations of ordinances in accordance with law. On August 1, 1990 the Board of County Commissioners of St. Lucie County Florida adopted the St. Lucie County Land Development Code. 5. On February 6, 2007, the Board of County Commissioners of St. Lucie County Florida adopted the Jenkins Road Overlay as a Traditional Neighborhood Design (TND) code in response to significant residential development pressure in the subject area. 6. On January 6, 2015, the Board of County Commissioners of St. Lucie County Florida held an Adoption Hearing after due public notice and approved Ordinance 14-026, amending the Jenkins Road Area Plan Special District, to eliminate land use and zoning district (use) regulations and associated design standards while adopting a specific Road and Trail System and typical street sections (design) for future right-of-way improvements within the Area. 7. On October 20, 2022, the Planning and Zoning Commission held a public hearing on the proposed ordinance after publishing notice in the St. Lucie News Tribune at least 10 days prior to the hearing and recommended that the proposed ordinance be approved. 8. On November 1, 2022, this Board held its first public hearing on the proposed ordinance, after publishing a notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. 9. On November 15, 2022, this Board held its second public hearing on the proposed ordinance, after publishing a notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. 10. The proposed amendment to the St. Lucie County Land Development Code is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Comprehensive Plan and is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: A. The specific amendment to the St. Lucie County Land Development Code to read as follows in strikethrough and underline format: 4.12.03. Road and Trail System. A. Required road design cross sections: The required minimum standard cross sections for use in designing a road within the Jenkins Road Area Plan Special District are as follows-.. The Board of County Commissioners may authorize a modified roadway section as part of a Planned Development application, after receiving the recommendation of the Development Review Committee. Any proposed modifications shall consider the type and anticipated volume of vehicle, bicycle, and pedestrian movements as well as drainage and utility needs. 1. Jenkins/Taylor Dairy Road between the existing Jenkins Road at its intersection with Orange Avenue through the Jenkins Road Area Plan Special District to its intersection with Orange Avenue at Taylor Dairy Road__ The Board of County Commissioners may authorize a modified roadway section as part of a Planned Development application, after receiving the recommendation of the Development Review Committee. Any proposed modifications shall consider the tvoe and anticipated volume of vehicle, bicycle, and pedestrian movements as well as drainage and utility needs. Avenue Q extension from Angle Road west to Jenkins -Taylor Dairy Road, and from Jenkins -Taylor Dairy Road west to Kings Highway:, The Board of County Commissioners may authorize a modified roadway section as part of a Planned Development application, after receiving the recommendation of the Development Review Committee. Any proposed modifications shall consider the type and anticipated volume of vehicle, bicycle, and pedestrian movements as well as drainage and utility needs. TYPICAL 100' ROAD SECTION .VEM/E 0 EXI£N VXA Street trees shall be placed on each side of the multiuse path, shall not be installed in a utilities right-of-way or a utilities easement or in a manner that their root systems may be adversely affected by work in a utilities easement so as to threaten the health of the trees. Street trees shall be placed so their canopies shall not interfere with any power line, and shall be placed so that a maximum shading effect is achieved along the entire length of the multiuse path. Utilities easements shall be placed in relation to the street trees in a manner that achieves these design standards and avoids damage to trees as a result of the installation and maintenance of permitted utilities. 3. Road G from Kings Highway to Jenkins -Taylor Dairy Road and from Jenkins - Taylor Dairy Road to Road A, 80' Right -of -Way, with bicycle/pedestrian path:_ The Board of Countv Commissioners may authorize a modified roadway section as part of a Planned Development application, after receiving the recommendation of the Development Review Committee. Any proposed modifications shall consider the tvpe and anticipated volume of vehicle, bicycle, and pedestrian movements as well as drainage and utility needs. Roads D and E where Road D is between Garner Court and Avenue M, and Road E is between Orange Avenue and Angle Road:_ The Board of County Commissioners may authorize a modified roadway section as part of a Planned Development application after receiving the recommendation of the Development Review Committee. Any proposed modifications shall consider the type and anticipated volume of vehicle, bicycle, and pedestrian movements as well as drainage and utility needs. Road A and Selena Avenue/Mariah Circle extending Avenue D from Angle Road to Lamont Road/Johnson Pierce Road, and Johnson Pierce Road north to Road G--. The Board of County Commissioners may authorize a modified roadway section as part of a Planned Development application, after receiving the recommendation of the Development Review Committee. Any proposed modifications shall consider the type and anticipated volume of vehicle, bicycle, and pedestrian movements as well as drainage and utility needs. Any proposed modifications shall consider the type and anticipated volume of vehicle bicycle, and pedestrian movements as well as drainage and utility needs. C. Bicycle/Pedestrian multi-user trails shall be designed in accordance with the following minimum required cross sections and FDOT standards:. CONFLICTING PROVISIONS Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, County Ordinances and County Resolutions, or parts thereof, in conflict with this Ordinance are hereby superseded by this Ordinance to the extent of such conflict. SEVERABILITY If any portion of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstance. D. APPLICABILITY OF ORDINANCE This Ordinance shall be applicable in the unincorporated area of St. Lucie County. E. FILING WITH THE DEPARTMENT OF STATE The Clerk is hereby directed forthwith to send a certified copy of this Ordinance to the Bureau of Laws, Department of State, The Capitol, Tallahassee, Florida, 32304. F. EFFECTIVE DATE This ordinance shall take effect upon filing with the Department of State. G.
