ACRES, AND SUPERSEDING CORRESPONDING CONDITIONS CONTAINED
WITHIN PDS ORDER 2022-010 AS RECORDED AT O.R. BOOK 4794, PAGE 933,
PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA WITHIN THE IL
(INDUSTRIAL, LIGHT) ZONING DISTRICT, SITUATED IN ST. LUCIE COUNTY,
FLORIDA
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the application for a Lot Split submitted by Denice M. Selph ("Selph") and Custom
Built Marine, Inc. ("Custom Built Marine"), evaluated the comments of the St. Lucie County
Development Review Committee, and made the following determinations:
1. The Lot Split (Lot Line Adjustment) application is approved for the properties totaling 6.8
acres which hold the zoning designation of IL (Industrial, Light), located on the west side
of Hammond Road, and are legally described as follows:

2. The Development Review Committee has reviewed the lot split application for the
subject properties and found it to meet the technical requirements of the St. Lucie
County Land Development Code and has satisfied the standards of review set forth in
Section 11.03.04(D) of the St. Lucie County Land Development Code if the conditions
stated herein are met.

3. Planning staff has provided an analysis of the eligibility for a one-time split of Parcel ID:
1430-311-0015-000-7, pursuant to Section 11.03.04 of the St. Lucie County Land
Development Code. The analysis can be found in the memorandum dated November
23, 2022, entitled Selph, Denice M. — Custom Built Marine Lot Split (LS-3202025707).
4. Planning staff has further determined that the conditions, as set forth and assigned in
Part "A" below, for future development on or use of the respective properties related to
this lot split and subject to this PDS Order supersede those conditions set forth in the
Use Determination previously approved by PDS Order 2022-010 on March 4, 2022, as
recorded at O.R. Book 4794, Page 933, Public Records of St. Lucie County, Florida.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director
of St. Lucie County, Florida:
A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the
Selph, Denice M. — Custom Built Marine Lot Split is hereby approved by the Planning
and Development Services Director as shown on the boundary survey prepared by
Betsy Lindsay, Inc., Surveying and Mapping, revised September 22, 2022, as shown in
Exhibit A subject to the following conditions which must be met for future development
on or use of the respective properties:
1. Within 30 days of this Lot Split approval, Custom Built Marine, the purchaser of
the +/-1.61-acre western portion of Parcel 1, shall:
a. Record a Unity of Title combining the 1.61 acres of the former Selph Parcel
purchased by Custom Built Marine and which has no legal road frontage, with
Custom Built Marine's existing 4.19-acre Parcel. Failure to obtain a Unity of
Title as set forth in this subparagraph (A)(1)(a) shall be considered a violation
of section 11.03.04(D).
b. File a complete site development plan and zoning compliance application for
the site(s), to incorporate the land to be purchased from the Selph Property, to
establish a permitted Industrial Light, IL, use and accessory Security Quarters.
c. Submit a complete building permit application(s) for site improvements
consistent with the IL District.
2. Within 30 days of this Lot Split approval, there shall be two (2) warranty deeds
recorded in public records as described herein and generally shown in Exhibit B
and as follows:
a. Selph shall record a warranty deed for Parcel 1 Adjusted: Warranty Deed
from Selph to Custom Built Marine conveying the 1.61 acres from the Selph
Parcel, reserving the remaining one (1) acre Parcel to Selph, "Adjusted Selph
Parcel 1", as described in Exhibit B.
b. Custom Built Marine shall record a warranty deed for Parcel 2
Combined: Warranty Deed which shall reflect the newly created legal
description, combining the 1.61 acres of the former Selph Parcel purchased by
Custom Built Marine with Custom Built Marine's existing 4.19-acre Parcel,
creating a combined Parcel of 5.80 acres.
3. No further division of the property is permitted unless a final record plat is
submitted in accordance with Section 11.03.04 of the Land Development Code.

4. Any future reduction in the size of Parcel 1 Adjusted beyond this Lot Split approval
(except for right-of-way acquisition(s)) will invalidate the Use Determination
previously set forth in PDS Order 2022-010.
5. Prior to a Vegetation Removal Permit or Exemption, the purchaser of the 1.61-
acre western portion of Parcel 1 shall obtain an approved landscape plan
consistent with Land Development Code (LDC) 7.09.00.
6. Water service is available at this location via Fort Pierce Utilities Authority (FPUA).
Custom Built Marine shall provide an approved utility construction plan before
water service can be provided.
7. The conditions stated herein, supersede the conditions of PDS Order 2022-010.
B. Failure to comply with the conditions set forth in this PDS Order shall constitute a
violation of the St. Lucie County Land Development Code ("County LDC'), and may
result in code enforcement proceedings, in addition to any other rights or remedies
available to the County at law or equity.
C. St. Lucie County is not responsible for the maintenance, upkeep, or improvement of any
private drives, roads, streets, easements, or rights -of -way providing ingress and egress
or drainage service to the subject property.
D. A copy of this Order shall be attached to the boundary survey described in Part "A" and
shall be placed on file in the Planning and Development Services Department.
E. This Order shall be recorded in the Public Records of St. Lucie County.
