A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
ST. LUCIE COUNTY FOR A CHANGE IN ZONING FROM THE AG-1
(AGRICULTURAL — 1) ZONING DISTRICT TO THE CG (COMMERCIAL,
GENERAL) ZONING DISTRICT FOR +/- 2.96 ACRES OF PROPERTY
LOCATED IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
1. Bob Brett of RKM Development Corp. petitioned for an Amendment to the Official Zoning
Atlas to change the zoning designation from AG-1 (Agricultural — 1) to the CG
(Commercial, General) Zoning District in St. Lucie County, Florida, for the property legally
described in Paragraph "A" and depicted on the attached survey as Exhibit "A."
2. On October 20, 2022, the St. Lucie County Planning and Zoning Commission held a public
hearing on the petition after publishing notice in the St. Lucie News Tribune at least 10
days prior to the hearing, installing a sign on the property and notifying by mail all owners
of property within 500 feet of the subject property, and recommended that the Board of
County Commissioners approve the change in zoning from the AG-1 (Agricultural — 1)
Zoning District to the CG (Commercial, General) Zoning District.
3. On November 15, 2022, the Board of County Commissioners held a public hearing on the
petition, after publishing notice in the St. Lucie News Tribune at least 10 days prior to the
hearing, installing a sign on the property and notifying by mail all owners of property within
500 feet of the subject property.
4. The proposed change in zoning has satisfied the requirements of Section 11.06.03 of the
St. Lucie County Land Development Code and is consistent with the goals, objectives,
and policies of the St. Lucie County Comprehensive Plan.
5. The proposed change in zoning is consistent with the existing and proposed use of
property in the surrounding area.
6. A Concurrency Deferral Affidavit, a copy which is attached to this Resolution as Exhibit
"B" was signed by the applicant on July 11, 2022.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. The property on which the Change in Zoning from the AG-1 (Agricultural — 1) to the CG
(Commercial, General) Zoning District is being granted is described as follows:
Legal Description:
A PARCEL OF LAND LYING IN SECTION 2, TOWNSHIP 35 SOUTH, RANGE 39 EAST,
ST. LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF SAID SECTION 2; THENCE
S00°32'55"E, ALONG THE EAST LINE OF SAID SECTION 2, A DISTANCE OF 313.06
FEET; THENCE N89°26'56"W, LEAVING SAID SECTION LINE, A DISTANCE OF 50.01
FEET TO A POINT ON THE WEST RIGHT-OF-WAY LINE OF KINGS HIGHWAY (S.R.
713) (VARYING WIDTH RIGHT-OF-WAY) AS SHOWN ON THE FLORIDA
DEPARTMENT OF TRANSPORTATION RIGHT-OF-WAY MAP SECTION 94003-2512,
SAID POINT BEING THE POINT OF BEGINNING;
THENCE CONTINUE N89°26'56"W, LEAVING SAID RIGHT-OF-WAY LINE, A
DISTANCE OF 411.96 FEET; THENCE S00°42'22"E, A DISTANCE OF 313.03 FEET;
THENCE S89°26'56"E, A DISTANCE OF 411.10 FEET TO A POINT ON SAID WEST
RIGHT-OF-WAY LINE OF KINGS HIGHWAY (S.R. 713) (VARYING WIDTH RIGHT-OF-
WAY): THENCE N00°32'55"W. ALONG SAID WEST RIGHT-OF-WAY LINE, A
DISTANCE OF 313.01 FEET TO THE POINT OF BEGINNING.
CONTAINING: 2.957 ACRES (128,789.28 SQUARE FEET), MORE OR LESS.
Location: Southwest corner of the Kings Highway and Angle Road intersection.

B. The St. Lucie County Planning and Development Services Director shall be authorized to
amend the Official Zoning Map to change the zoning of the property herein described.
from the AG-1 (Agricultural — 1) Zoning District to the CG (Commercial, General) Zoning
District and to make notation of the reference to the date of adoption of this Resolution.
C. A copy of this Resolution shall be mailed to the owner and agent of record as identified on
the application.
D. This Resolution shall be recorded in the Public Records.
