AN ORDER APPROVING A LOT SPLIT FOR A +/-32.49-ACRE
PROPERTY LOCATED ON ORANGE AVENUE WEST OF SOUTH
GRAVES ROAD, IN FORT PIERCE, FLORIDA.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
application for a Lot Split submitted for Howard Nelson, evaluated the comments of the
Development Review Committee, and made the following determinations:
The Lot Split application has been approved for the property consisting of +/-32.49 acres,
which has an AG-5 (Agricultural — 1du/5ac) zoning designation, and is legally described
and approved as follows:
LEGAL DESCRIPTION — OVERALL PARENT PARCEL
THE NORTH 22 FEET OF THE SW 1/4 OF THE SW 1/4 OF SECTION 12,
TOWNSHIP 35 SOUTH, RANGE 38 EAST, LESS AND ACCEPTING
THEREFROM THE EAST 150 FEET OF THE WEST 175 FEET OF THE NORTH
200 FEET OF THAT PART OF THE EAST 1/2 OF THE NW 1/4 OF THE SW 1/4
LYING SOUTH OF THE ORANGE AVENUE; ALL LYING AND BEING IN ST

2. The Development Review Committee has reviewed the subject Lot Split application and
found it to meet the technical requirements of the St. Lucie County Land Development

Code and has satisfied the standards of review set forth in Section 11.03.04(D) of the St.
Lucie County Land Development Code.
3. Planning staff provided analysis of the parcel's eligibility for a one-time lot split pursuant
to Section 11.03.04 of the St. Lucie County Land Development Code. That analysis can
be found in the memorandum entitled Nelson - Lot Split LS-2207-000007, dated January
11, 2023.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of
St. Lucie County, Florida:
A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Lot
Split for Howard Nelson is hereby approved by the Planning and Development Services
Director as shown on the boundary survey (Exhibit A) prepared by Alexander J. Piazza
PSM, dated November 30, 2022, subject to the following conditions:
Within 90 days of the Order effective date, the applicants, property owners,
developers, successors, or assigns, shall convey to St. Lucie County, in a manner or
form acceptable to the County Attorney, 5 feet of right-of-way along S. Graves Road.
2. Within 30 days of Lot Split approval, the applicant and/or property owner(s) shall
record warranty deeds recorded in the St. Lucie County Public Records reflecting the
two (2) newly created parcels, with legal descriptions in accordance with the survey
prepared by Alexander J. Piazza PSM.
3. No further division of the property is permitted unless a final record plat is submitted in
accordance with Section 11.03.04 of the Land Development Code.
B. St. Lucie County is not responsible for the maintenance, up -keep, or improvement of any
private drives, roads, streets, easements, or rights -of -way providing ingress and egress
or drainage service to the subject property.
C. A copy of this Order shall be attached to the boundary survey described in Part A and
shall be placed on file in the Planning and Development Services Department.
D. This Order shall be recorded in the Public Records of St. Lucie County.
