Home My WebLink About23-236 RESOLUTION 23-236 A RESOLUTION ACCEPTING THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT PERPETUAL FLOWAGE AND CULVERT EASEMENT FOR THE C-23/24 STA AND AUTHORIZING THE CHAIR TO EXECUTE THE AGREEMENT AND FURTHER AUTHORIZING THE COUNTY ATTORNEY TO EXECUTE THE AGREEMENT BY APPROVING IT AS TO FORM AND CORRECTNESS WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. Acceptance of the Perpetual Flowage and Culvert Easement with the South Florida Water Management District for the construction, operation, maintenance, alteration, repair and patrol of the underground culverts for the C-23/24 STA and associated drainage facilities more fully described in the Perpetual Flowage and Culvert Easement and associated exhibits; to accept the permanent overflow, flood and submergence of the easement premises. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: 1. The Board hereby accepts and approves the Perpetual Flowage and Culvert Easement with the South Florida Water Management District to construct, operate and maintain the C-23/24 STA and associated drainage facilities and to allow flow per the agreement. 2. The Board hereby authorizes the Chair to execute the above-referenced agreement and further authorizes the County Attorney to execute the agreement by approving it as to form and correctness.
