HomeMy WebLinkAboutPDS-23-019 - Soldevilla Administrative Variance at 7017 Gullotti Place PDS NO. 2023-019 File No. VAR-2208-000018 AN ORDER GRANTING ADMINISTRATIVE VARIANCE APPROVAL FOR PROPERTY LOCATED AT 7017 GULLOTTI PLACE, IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for an administrative variance, including, but not limited to the staff report and made the following determinations: 1. Dianne Soldevilla petitioned for an Administrative Variance to allow for an existing covered screened porch, after modifications, to encroach into the required minimum 20-foot side yard setback by no more than 7.00 feet, providing a 13.00-foot side yard setback for this structure within the AR-1 (Agricultural, Residential — 1 du/ac) Zoning District. 2. On February 22, 2023, Planning & Development Services staff notified by mail all owners of property within 500 feet of the petition site and the applicant installed a sign on the subject property in accordance with Land Development Code Section 11.00.03. 3. The Administrative Variance provides for a 35% reduction of the minimum required side yard (setback), allowing a reduction from 20 feet to 13 feet for a (previously constructed) covered screened porch. The encroachment into the minimum required side yard (setback) is up to 7.00 feet for a corner of a covered screened porch, which is angled toward the side yard property line and will be modified as depicted on the boundary survey dated March 17, 2010, with field data updated August 10, 2018, and digitally signed on February 8, 2023, attached herein as "Exhibit A". 4. After consideration of staff's analysis found in a memorandum dated March 13, 2023, entitled Dianne Soldevilla Administrative Variance— 7017 Gullotti Place., SFRVAR-2302- 000003, including exhibits and the standards of review for granting administrative variances set out in Land Development Code Section 10.01.14.C., the Planning & Development Services Director has made the following determinations: The requested administrative variance meets the standards of review as set forth in Section 10.01.14.C. of the St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because: a) There were no objections made from the public in regard to the proposed administrative variance; b) The requested encroachment will not have an undue adverse effect on adjacent property, does not encroach into any easements, common areas, or environmentally sensitive areas; c) The request does not impair or otherwise injure other property values or improvements MICHELLE R.MILLER,CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY File No.: SFVAR-2302-00000: FILE 9 5169919 03/23/2023 04:31:02 PM PDS No. 2023-019 March 13, 2023 OR BOOK 4965 PAGE 1921-1923 Doc Type:ORD Pagel RECORDING: $27.00 in the area in which the subject property is located; d) The request is the minimum variance that will make possible the reasonable use of the existing structure; and e) The requested variance does not result in an encroachment of any more than thirty- five (35) percent(%) into the side yard. NOW, THEREFORE, BE IT ORDERED by the Planning & Development Services Director: A. Pursuant to LDC Section 10.01.14.C., the Dianne Soldevilla Administrative Variance is hereby approved as described herein. The administrative variance approval provides the setback variance for the specific footprint and the type of structure shown on the approved survey. It also does not reduce or waive any other required setbacks for any future structures or additions. Upon issuance of the building permit pursuant to this administrative variance approval, the variance remains for the type of structure in the specific footprint in perpetuity, and runs with the land. B. The property on which this approval is being granted is generally described as: ST LUCIE GARDENS 24 36 40 BLK 2 S 165 FT OF N 330 FT OF LOT 6 (1.25 AC) PARCEL ID: 3414-501-1006-100-8 C. This Order shall become effective upon the date indicated below. An appeal from the Planning & Development Services Director's action may be submitted within thirty (30) days, in accordance with Section 10.01.14.C.9. of the St. Lucie County Land Development Code.
