AN ORDER GRANTING APPROVAL FOR A MINOR
ADJUSTMENT TO THE MAJOR SITE PLAN KNOWN AS
KINGS HIGHWAY WAREHOUSE ON APPROXIMATELY
67.11 ACRES OF PROPERTY LOCATED AT 700 S. KINGS
HIGHWAY IN ST. LUCIE COUNTY, FL.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the application for Minor Adjustment to the Kings Highway Warehouse Major Site Plan
submitted by Jason A. Lewis, P.E. of Kimley-Horn & Associates on behalf of USEF Kings
Logistics Center Owner LLC. and the comments made by the St. Lucie County Development
Review Committee on this application and has made the following determinations:
1. The applicant, Jason A. Lewis, P.E., of Kimley-Horn Associates, on behalf of Kings
Highway Warehouse, is requesting a Minor Adjustment to the Kings Highway
Warehouse Major Site Plan to correct the Distribution Center's square footage from
658,000 to 664,176 square feet, reduce the total number of trailer parking spaces to
meet South Florida Water Management District (SFWMD) requirements and reserve a
portion of the auto parking spaces as "Future Parking" to be constructed if needed by
the Tenant. An updated landscape plan, revised site plan and traffic statement were
submitted to reflect the proposed modifications. The subject property is zoned IL
(Industrial, Light), with a Future Land Use designation of MXD (Mixed-Use Development)
located on the east side of Kings Highway (SR 713), just south of Orange Avenue (SR
68). The property lies within the Urban Service Boundary (USB).
2. On September 21, 2021, the Board of County Commissioners approved Resolution
2021-357 granting a Major Site Plan known as Kings Highway Warehouse to construct
658,000 sq. ft. of warehouse/distribution space on the subject property.
3. The St. Lucie County Development Review Committee reviewed the Minor Adjustment
to the Major Site Plan as depicted on Exhibit C, for the project and found it to meet all
technical requirements and to be consistent with the Future Land Use Map of the St.
Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this
Resolution.
4. The proposed project is consistent with the general purpose, goals, objectives, and
standards of the St. Lucie County Land Development Code, the St. Lucie County
Comprehensive Plan and the Code of Ordinances of St. Lucie County.
5. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities or other matters
affecting the public health, safety and general welfare.

6. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping and
screening.
7. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of
St. Lucie County, Florida:

B. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the
proposed Minor Adjustment to the Major Site Plan project known as Kings Highway
Warehouse, as depicted in Exhibit C, is hereby approved as shown on the revised site plan
drawings for the project prepared by Kimley-Horn & Associates., dated October 19, 2022
and received by the St. Lucie County Planning & Development Services Department on
March 6, 2023, subject to the following conditions, with editor notes regarding Conditions of
Approval found in Resolution 2021-357:
Environmental Resources Department:
Prior to initiation of any site development or issuance of a Vegetation Removal
Permit or Exemption, an After -the -fact Vegetation Removal Application along with
$230,277 shall be provided to the Environmental Resources Department for
utilization towards the pending acquisitions of the of the pending Environmentally
Significant Lands (ESL) purchase of a parcel along Ten Mile Creek and Jenkins
Road to satisfy the outstanding tree mitigation option outlined in LDC 6.00.05.D.3.
Should the pending sale not be approved/finalized, the provided funds shall go to the
St. Lucie County Tree Fine and Mitigation Fund for other future ESL, acquisitions,
and maintenance. (Completed)
2. Prior to the issuance of a Certificate of Occupancy, all Category I listed
invasive species shall be eradicated from site. (New)
3. Prior to a Vegetation Removal Permit or Exemption, listed species surveys including
but not limited to gopher tortoise surveys shall be updated as required per state
and/or federal survey protocol. Should any listed species be found as a result of
these updated surveys, appropriate per state and federal agencies shall be required.

4. Prior to issuance of a Vegetation Removal Permit or Exemption, a Category III
wetland waiver from the Environmental Resources Department for the proposed

impacts to the onsite isolated wetland shall be provided and approved by the
Environmental Resources Director. (Completed)
Planning & Development Services Department:
5. Prior to the issuance of respective Building Permit(s), all signage shall be reviewed
by the Planning and Development Services Department for compliance with St. Lucie
County Land Development Code. (Revised)
Public Works Department:
6. The applicant shall post a bond with the County for the design and construction of a
new traffic signal at the intersection of SR 713/South Kings Highway and Driveway 1,
within twenty-four (24) months of the approved site plan with a one (1) year extension
approved by the Public Works Department.
7. The applicant/owner shall vacate the blanket easements and establish new
easements as necessary and for offsite legal outfall prior to the issuance of the Site
Development and/or Building Permit. (Completed)
C. The approvals and authorizations granted by this Order shall expire on March 29, 2024,
unless a building permit is secured or a site plan extension is granted in accordance with
Section 11.02.06(B)(2), St. Lucie County Land Development Code.
D. The developer is advised as part of this Minor Adjustment to a Major Site Plan approval that
the property owner(s), developer, etc. including any successors in interest, shall obtain all
applicable development permits and construction authorizations from the appropriate State
and Federal and local regulatory agencies including, but not limited to, the United States
Army Corps of Engineers, the Florida Department of Environmental Protection, Florida
Department of Transportation, South Florida Water Management District, and the St. Lucie
County Environmental Resources, Public Works, and Building Departments prior to the
commencement of any development activities on the property described in Part A.
Issuance of this permit by the County does not in any way create any rights on the part of
the developer to obtain a permit from a state or federal agency and does not create any
liability on the part of the County for issuance of this permit if the developer fails to obtain
requisite approvals or fulfill the obligations imposed by a state or federal agency or
undertake actions that may result in a violation of state or federal law.
E. The conditions set forth in Part B are an integral non -severable part of the site plan approval
granted by this Order. If any condition set forth in Part B is determined to be invalid or
unenforceable for any reason and the developer declines to comply voluntarily with that
condition, the site plan approval granted by this Order shall become null and void.
F. A revised Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made
a part hereof the Order, was granted by the Planning & Development Services Department
Director on March 29, 2023, shall remain valid for the term of this Order.

G. This Order shall become effective upon the date of approval indicated below. Should the
property owner, developer or authorized agent wish to appeal any condition described in
Part "B" above, all such appeals must be filed in writing with the County Administrator within
thirty (30) days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie
County Land Development Code. Should an appeal to this Order be filed, no permitting
reviews or further administrative action shall take place on the processing of this
development project until the appeal is resolved.
H. A recorded copy of this Order shall be attached to the site plan drawings described in Part
B, which plan shall be placed on file with the St. Lucie County Planning & Development
Services Department Director.
I. This Order shall be recorded in the Public Records of St. Lucie County.
