HomeMy WebLinkAboutPDS-23-016 - Savanna Club On-Site Sales and Leasing OfficePDS ORDER 2023-016 File No. EDO-2301000022 AN ORDER GRANTING A STATUTORY EXTENSION PROVIDED BY SECTION 252.363 FLORIDA STATUTES TO THE APPROVED MINOR ADJUSTMENT TO THE PLANNED UNIT DEVELOPMENT SITE PLAN FOR THE SAVANNA CLUB ON -SITE SALES AND LEASING OFFICE. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for an extension timely submitted by Dean, Mead, Minton & Zwemer, on behalf of Savanna Eagles Retreat LLC., and has made the following determinations: On April 6, 2016, the PDS Director approved PDS Order 16-018 authorizing a Minor Adjustment to the Final Planned Unit Development (PUD) Site Plan for the construction of a 1,760 square foot sales and leasing office. The subject 0.29 acre property is zoned PUD (Planned Unit Development) and is located at 3412-3416 Crabapple Drive. 2. The Planning and Development Services Director previously granted through PDS Orders 18-025, 2020-002, 2020-086 and 2021-052 Emergency Disaster Order extensions due to the threat of Hurricanes Irma, Maria, Dorian and Isaias to the State of Florida. 3. On September 23, 2022, Executive Order (EO) 22-218 was issued declaring a state of emergency in the state of Florida due to the threat of Hurricane Ian and later amended by Executive Order (EO) 22-219 to encompasss the entire State of Florida. 4. On November 7, 2023, the Governor issued Executive Order (EO) 22-253 due to the threat of Subtropical Storm Nicole and later extended by Executive Order (EO) 23-02, for a total state of emergency period of one hundred and nineteen (119) days. The eligible tolling period for this emergency declaration is one hundred and seventy-eight (178) days plus the two six (6) month periods. The current expiration date is April 17, 2023, with an extension sought through October 12, 2024. 5. Section 252.363 Florida Statutes provides that any local government issued development order or permit may be extended from the period remaining for the duration of the emergency declaration plus six (6) months. 6. Section 252.363 Florida Statutes requires that a specific written notice be filed with the issuing authority within ninety (90) days after the termination of the declaration of emergency. The applicant applied for this extension on January 27, 2023. 7. Planning Staff performed an analysis of the project and determined that the extension is consistent with all the original St. Lucie County Development Orders granting extensions depicted on the attached Exhibit A. Pursuant to Section 252.363 Florida Statutes of the State of Emergency Act the approval for the project known as Savanna Club On -Site Sales & Leasing Office has been found to be eligible for a statutory extension. The approval granted under PDS Order No. 2021- 021 is extended from its last scheduled date of expiration April 17, 2023, and now shall expire October 12, 2024, for the property described in Part B, is hereby approved with the following conditions: 1. The hours of operation for the sales and leasing office shall be 8:00 a.m. to 5:00 p.m., Monday through Saturday. 2. All real estate transactions at the sales and leasing office shall consist of properties within the Savanna Club PUD. No exterior real estate sale transaction shall be permitted. 3. There shall be no outdoor storage of equipment or materials on the property, with the exception of garbage and recycling receptacles during pick-up day(s). 4. All exterior lighting shall consist of wall mounted fixtures only. Footcandle readings shall not exceed 0.01 foot candle readings at all property lines. 5. The exterior signage shall consist of one (1) monument (ground) sign as depicted on the site plan. No other exterior signs shall be installed on the property. 6. The sales and leasing office building shall be constructed with similar design of the existing single family residences in the community, utilizing comparable exterior materials and colors. 7. Prior to the issuance of a Certificate of Occupancy, a bike rack shall be installed on the subject property, between the building and the 8-foot wide sidewalk. 8. The issuance of a County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 9. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which this development order extension is being granted is described as follows: LEGAL DESCRIPTION: BEING ALL OF LOTS 1 AND 2, BLOCK 77, ACCORDING TO THE PLAT OF FAIRWAYS AT SAVANNA CLUB REPLAT NO. 1, AS RECORDED IN PLAT BOOK 57, PAGE 39 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. PARCEL NUMBERS: 3424-800-0198-000-1 AND 3424-800-0199-000-8 C. The approval granted by this administrative order shall expire on October 12, 2024, unless building permits are issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. E. The conditions set forth in Part A are an integral non -severable part of the site plan approval as granted by this administrative extension. If any condition set forth in this order is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. F. A copy of this extension shall be placed on file with the St. Lucie County Planning and Development Services Department. G. This order shall be recorded in the Public/Records of St. Lucie County.
