AN ORDER GRANTING A STATUTORY EXTENSION PROVIDED BY SECTION
252.363 FLORIDA STATUTES TO THE APPROVED MAJOR SITE PLAN AND
CONDITIONAL USE KNOWN AS AVIATION MANAGEMENT & REPAIRS FOR
PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request for a development order extension timely submitted by Darren Guettler, of Velcon
Engineering & Surveying and has made the following determinations:
On June 12, 2018, Darren Guettler, PE, of Velcon Engineering & Surveying, LLC, on behalf
of Fort Pierce FBO, LLC. presented a petition for a Major Site Plan, to be known as Aviation
Management & Repairs, to develop an Aviation Maintenance, Repair and Overhaul (MRO)
facility in the U, (Utilities) Zoning District for the property located at 4510 Tailwinds Drive.
2. On October 1, 2019, The Board of County Commissioners granted approval through
Resolution 2019-191 for a Major Site Plan and Conditional Use Adjustment to be known as
Aviation Management & Repairs to develop an Aviation Maintenance, Repair and Overhaul
(MRO) hangar within the Treasure Coast International Airport (FKA St. Lucie County
International Airport), for a 62,400 square foot MRO facility, which encompassed a 52,800
square foot hangar (58-feet in height), a 9,600 square foot two-story office building, and
support site improvements.
3. On May 1, 2021, Velcon Engineering & Surveying submitted a Minor Adjustment to the
Conditional Use and a Minor Adjustment to the Major Site Plan, on behalf of Aviation
Management & Repairs, Inc., for an Aviation Maintenance, Repair and Overhaul (MRO)
facility, for the project known as Aviation Management & Repairs. The proposed adjustment
seeks to maintain the previously approved 52,800 square foot one-story hangar (58-feet in
height) and reduce the approved two-story office building to one-story, while maintaining the
9,600 square foot gross floor area in the U (Utilities) Zoning District for the property located
at 4510 Tailwinds Drive.
4. On February 2, 2022, Executive Order 22-27 was issued declaring a state of emergency in
the state of Florida due to record -breaking freezing temperatures. Executive Order 22-28
amended Executive Order 22-27 to upgrade the state of emergency declaration to
encompass the entire state of Florida. The eligible tolling period for this emergency
declaration is sixty (60) days plus six (6) months.
5. On September 14, 2022, the Public Works Engineering Division issued a Site Development
Permit for the project, acknowledging the subject EDO and extension eligibility.
6. On November 7, 2022, Governor Desantis filed Executive Order 22-253, issuing Executive
Order 22-253 declaring a state of emergency for St. Lucie County for a period of sixty (60)

days due to the extreme fluctuations in weather conditions from Tropical Storm Nicole. This
state of emergency expired on January 6, 2023, making the state of emergency sixty (60)
days total.
7. On November 10, 2022, Governor Desantis filed Executive Order 22-256, amending
Executive Order 22-253 declaring a state of emergency for the state of Florida for a period
of sixty (60) days due to the extreme fluctuations in weather conditions from Hurricane
Nicole. This state of emergency expired on January 9, 2023, making the state of emergency
sixty (60) days total.
8. On November 21, 2022, Governor Desantis filed Executive Order 22-268, amending
Executive Order 22-219 declaring a state of emergency for the state of Florida for a period
of sixty (60) days due to the extreme fluctuations in weather conditions from Hurricane Ian.
This state of emergency expired on January 20, 2023, making the state of emergency sixty
(60) days total.
9. Section 252.363 Florida Statute provides that any local government issued development
order or permit may be extended from the period remaining for the duration of the
emergency declaration plus six (6) months.
10. Section 252.363 Florida Statutes requires that a specific written notice be filed with the
issuing authority within ninety (90) days after the termination of the declaration of
emergency. The applicant applied for this extension on May 18, 2022. Processing the
request was inadvertently delayed due to incorrect system entry.
11. Planning Staff performed an analysis of the project and determined that the extension is
consistent with the original St. Lucie County Development Orders granting extensions
depicted on the attached Exhibit A. Further analysis is found in the memorandum titled
Aviation Management & Repairs Executive Order Extension, dated April 12, 2023.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St.
Lucie County, Florida:
A. Pursuant to Section 252.363 of the Florida Statutes State of Emergency Act, the Major Site
Plan and Conditional Use approval for the project known as Aviation Management &
Repairs has been found to be eligible for a statutory extension. The approval granted under
PDS Order No. 2021-021 is extended from its last scheduled date of expiration, May 21,
2022, and now shall expire July 19, 2023, for the property described in Part B, is hereby
approved with the following conditions.
All previous conditions of approval applicable to the subject property, as contained in the
above referenced Development Orders, have been consolidated as contained herein.

Prior to the issuance of a building permit, the applicant shall provide a Developer Agreement
with the St. Lucie County Utilities Department for the reservation of capacity for water and
wastewater services.
2. Prior to the issuance of a Building Permit, the applicant shall provide an updated survey.
3. Prior to issuance of a Certificate of Occupancy all Category I listed invasive species shall be
eradicated from the site.
4. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall provide
a gopher tortoise survey for the proposed development area.
B. The property on which this Development Order Extension is being granted is described as
follows:

C. This Development and Conditional Use Site Plan statutory extension approval shall expire
on July 19, 2023, unless a permit is issued and active or an extension has been granted in
accordance with Section 11.02.06, St. Lucie County Land Development Code.
D. The conditions set forth in PartA are an integral non -severable part of the site plan approval
as granted by this administrative extension. If any condition set forth in PartA is determined
to be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, this development order extension approval granted by this
Order shall become null and void.
E. The Certificate of Capacity granted by the Planning and Development Services Director
shall remain valid for the period of this development order. If this order expires or otherwise
terminates, the Certificate of Capacity shall automatically terminate.
F. A copy of this statutory extension shall be placed on file with the St. Lucie County Planning
and Development Services Department.
This order shall be recorded in the Public Records of St. Lucie County.
