HomeMy WebLinkAbout23-081 RESOLUTION NO. 23-081 A RESOLUTION OF THE ST. LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS SITTING AS THE COMMISSION OF THE ST. LUCIE COUNTY WATER AND SEWER DISTRICT, AUTHORIZING THE REVISIONS OF THE UNIFORM SERVICE POLICY FOR CUSTOMERS WITHIN THE ST. LUCIE COUNTY WATER AND SEWER DISTRICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Ordinance No. 04-023, (the"District Ordinance") the St. Lucie County Board of County Commissioners("Board")created the St. Lucie County Water and Sewer District ("District") for the purpose of providing water, wastewater, and reclaimed water service within the boundaries of the District; and WHEREAS, on August 2, 2005, in Resolution No. 05-277, the Board, sitting as the Commission of the St. Lucie County Water and Sewer District ("Commission") adopted the existing Uniform Service for the utility services furnished to the customers of the District; and WHEREAS, on October 23, 2012, the Board adopted Resolution No. 12-173 amending the Uniform Service Policy; and WHEREAS,the Board,on the advice and recommendation of its utility staff and technical advisors has proposed an amendment to the Uniform Service Policy to amend the section "Adjustment of Bill for Meter Error"based on a recent court case and finds that such revisions are just and equitable and in the public interest. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida, sitting as the Commission of the St. Lucie County Water and Sewer District: Section 1. ADOPTION OF AMENDMENT TO UNIFORM SERVICE AND UNIFORM EXTENSION POLICIES FOR THE DISTRICT. The Amendment to the Uniform Service Policy attached as Exhibit "A" to this Resolution is hereby adopted. Section 2. SEVERABILITY. If any section, paragraph, sentence, clause, phrase, or word of their Resolution is for any reason held by a court to be unconstitutional, inoperative, or void, such holding shall not affect the remainder of this Resolution. Section 3. EFFECTIVE DATE. This Resolution shall become effective on July 1, 2023. Section 4. ADOPTION. In meter tests made by SLCU, the accuracy of the meter and its performance in service shall be judged by its average error rate. The average meter error shall be considered to be the average of the errors at the test rate flows in accordance with the American Waterworks Association (AWWA) standards. Fast Meter - Whenever a meter tested is found to register fast in excess of the tolerance provided in the AWWA standards, SLCU shall credit the Customer's account in the amount billed in error for the period since the last test; said period not to exceed six (6) months except that if it can be shown that error was due to some cause, the date of which can be fixed. The over charge shall be computed back to but not beyond such date. The credit shall be exclusive of any minimum fee. Slow meter - Whenever a meter tested is found to register slow in excess of the tolerance provided in the AWWA standards, SLCU will not back bill the Customer for the lost revenue unless it can shown that the customer tampered with the water meter. Non -Registering Meter - In the event of a non -registering meter, the Customer may be billed for the periods) when the meter was determined to be non-registering,based on the highest amount of monthly water usage registered when the meter was registering water use in the six (6) months prior to the first period when the meter was non -registering times the number of non -registering months .
