A RESOLUTION GRANTING A MAJOR ADJUSTMENT TO AN EXISTING
CONDITIONAL USE PERMIT FOR DEVELOPMENT OF AN 18,000 SQ. FT. T-
HANGER AND THREE 3,600 SQ. FT.AIRPLANE HANGERS AND ASSOCIATED SITE
IMPROVEMENTS WITHIN THE TREASURE COAST INTERNATIONAL AIRPORT
(FKA ST. LUCIE COUNTY INTERNATIONAL AIRPORT), IN THE U, UTILITIES
ZONING DISTRICT, FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY,
FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
the testimony and evidence, including but not limited to findings in the staff report, has
made the following determinations:
1. Pursuant to Section 3.01.03(W)(7)(a) of the St. Lucie County Land Development
Code, effective August 1, 1990, the Treasure Coast International Airport (FKA St.
Lucie County International Airport) is considered an existing Conditional Use.
2. Amanda Gagnon of MBV Engineering, on behalf of APP Jet Center, presented a
petition for a Major Adjustment to the existing Conditional Use Permit for the
Treasure Coast International Airport to develop an 18,000 sq. ft. t-hanger, three
3,600 sq. ft. airplane hangars, and associated site improvements, to be known as
the SLC Airport APP Center, in the U, (Utilities) Zoning District for the property
located at 2916 Curtis King Blvd., as legally described in Part "B" and depicted on
the attached map as Exhibit "A".
3. The Development Review Committee has reviewed the proposed Major
Adjustment to an existing Conditional Use Permit and found it to be in substantial
conformity with the overall Airport Master Plan.
4. St. Lucie County Planning and Development Services staff has performed the
required land use analysis for this application.
5. On June 6, 2023, this Board held a public hearing on the petition, after publishing
a notice of such hearing and notifying by mail all owners of property within 500 feet
of the subject property.
6. The Major Adjustment to the existing Conditional Use Permit, with the conditions
therein, is consistent with the goals, objectives and policies of the St. Lucie County
Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the
St. Lucie County Land Development Code.
7. The proposed project, with conditions therein, will not have an undue adverse
effect on adjacent property, the character of the neighborhood, traffic conditions,
parking, utility facilities, or other matters affecting the public health, safety, and
general welfare.

8. The proposed project will be serviced by adequate public facilities and services.
9. A Certificate of Capacity, in accordance with Section 5.08.04, will be required for
authorization of a Minor Site Plan for the project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St.
Lucie County, Florida:
A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, an
Adjustment to the Treasure Coast International Airport Conditional Use Permit that
allows for development of the SLC Airport APP Center on the property described
below, in Part "B", is hereby approved subject to the following conditions:
Planning and Development Services Department — Planning Division
1) Prior to Minor Site Plan approval, existing and proposed handicap spaces
must be demonstrated, and ADA spaces striped. Prior to the issuance of the
building permit, the building official may require an additional ADA space
adjacent to the t-hangers.
2) Prior to Minor Site Plan approval, the parking calculations shall be corrected
(0.65 spaces per 1,000 sq. ft.), affirming use of the fitted curve calculations.
Environmental Resources Department
3) Prior to any ground disturbance or impacts to any vegetation, a vegetation
removal permit or exemption shall be issued by the Environmental Resources
Department per LDC 6.00.03.
4) Prior to commencement of development, including, but not limited to clearing,
filling, excavation, grading, or planting of vegetation, as defined in LDC
2.00.00, an updated 100% gopher tortoise survey conducted by a state
certified gopher tortoise agent may be required per Florida Fish and Wildlife
Conservation Commission (FWC) protocol, as these surveys are only valid for
90 days.
Airport Department
5) Prior to issuance of a site development permit, the FAA - Obstruction
Evaluation / Airport Airspace Analysis (OE/AAA) shall be completed; In
administering Title 14 of the Code of Federal Regulations (14 CFR) Part 77,
the prime objectives of the FAA are to promote air safety and the efficient use
of the navigable airspace. To accomplish this mission, aeronautical studies
are conducted based on information provided by proponents on an FAA Form
7460-1, Notice of Proposed Construction or Alteration. Circular 70/7460-1 M,

Obstruction Marking and Lighting, describes the standards for marking and
lighting structures such as buildings, chimneys, antenna towers, cooling
towers, storage tanks, supporting structures of overhead wires, etc.
6) Prior to issuance of a site development permit, the Federal Aviation
Administration (FAA) - Formal Environmental Review shall be completed.

7) Prior to issuance of the site development permit, the survey shall be updated
to reflect the standard for the oval reinforced concrete pipe size of 19"x30".

8) Prior to issuance of a site development permit, the developer shall secure an
amended lease that encompasses the complete project boundary or revise
the Minor Site Plan for consistency with the existing lease.

C. The approvals and authorizations granted by this Resolution are for the purpose
of obtaining a Site Plan approval, Building Permit or Zoning Compliance from St.
Lucie County and are not assigned to any other party or institution. Should the

petitioners choose or decide to assign this development to another entity or
individual, a minor adjustment to the Conditional Use Permit shall be required.
D. The approvals and authorizations granted by this Resolution shall expire on
June 6, 2024, unless a Building Permit or Certificate of Zoning Compliance is
obtained for the uses described in Part "A" above, or an extension has been
granted in accordance with Section 11.07.05(F), St. Lucie County Land
Development Code.
E. The conditions set forth in Part "A" are an integral non -severable part of the site
plan approval granted by this resolution. If any condition set forth in Part "A" is
determined to be invalid or unenforceable for any reason and the developer
declines to comply voluntarily with that condition, the site plan approval granted by
this resolution shall become null and void.
F. The Conditional Use Permit approval granted under this Resolution remains
subject to any and all necessary development permits and construction
authorizations from the appropriate State and Federal regulatory authorities,
including but not limited to; the Federal Aviation Administration, Treasure Coast
International Airport, United States Army Corps of Engineers, the Florida
Department of Environmental Protection, and the South Florida Water
Management District, prior to the issuance of any local building permits of
authorizations to commence development activities on the property described in
Part B.
G. This Resolution shall be recorded in the Public Records of St. Lucie County.
