HomeMy WebLinkAboutPDS-23-045 - A-1 Roof Trusses Expansion aka A-1 Roof Trusses PDS ORDER 2023-045 File Number: MJSP-2304-000019 AN ORDER GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO A MINOR SITE PLAN KNOWN AS A-1 ROOF TRUSSES EXPANSION (AKA A-1 ROOF TRUSSES) ON APPROXIMATELY 23.11 ACRES OF PROPERTY LOCATED GENERALLY AT 4451 ST. LUCIE BOULEVARD IN ST. LUCIE COUNTY, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Minor Adjustment to the A-1 Roof Trusses Expansion Minor Site Plan submitted by Engineering Design & Construction, Inc on behalf of Betkor Properties, LLC and the comments made by the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. A-1 Roof Trusses, represented by Engineering Design & Construction, Inc., is requesting a Minor Adjustment to a previously approved Minor Site Plan known as A-1 Roof Trusses Expansion to incorporate various as-built site plan amendments during the most recent expansion to document a nominal reduction in the final building site footprint, adjust the truck parking/drive-aisle west of Building A, retain existing parking within the right-of-way for a finite period under a revocable license agreement, reaffirm the linked landscape requirements upon parking phase-out, and incorporate a 25ft. x 25ft. concrete patio area with connecting sidewalk for employees. The subject property is zoned IL, Industrial Light, which is compatible with the IND, Industrial Future Land Use designation. 2. On December 5, 2000, the Board of County Commissioners approved Resolution 00-136 granting Major Site Plan approval for A-1 Roof Trusses to construct a 151,900 square foot manufacturing plant. In 2002 the applicant constructed 100,150 sq. ft. of the approved roof truss manufacturing plant. 3. On March 23, 2016, the Planning & Development Services Director approved PDS Order 16-017, granting a Minor Adjustment to the existing Major Site Plan to construct a 9,920 sq. ft. two-story office, and 18,930 sq. ft. storage facility, utilizing originally authorized space. 4. On January 14, 2020, the Board of County Commissioners approved Resolution 2020-05 granting a Major Adjustment to a Major Site Plan to add 4.53 +/- acres and 71,890 sq. ft. of manufacturing space to the existing site. The expansion represents an 179,313 sq. ft. build-out with associated staging and loading areas on the site. On June 1, 2021, the Board of County Commissioners adopted Ordinance 2021-14 which expanded the Minor Site Plan threshold for Targeted Industry projects to 500,000 sq. ft., therefore the subject Site Plan is now considered a Minor Site Plan. 6. The St. Lucie County Development Review Committee has reviewed the Minor Adjustment to the Minor Site Plan, as depicted on Exhibit C, for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Order. 7. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 8. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 9. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 10. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the existing Minor Site Plan project to be known as A-1 Roof Trusses Expansion, as depicted in Exhibit C, is hereby approved as shown on the site plan drawings for the project prepared by Engineering Design & PDS Order 2023-045 Page 3 File No.: MJSP-2304000019 Construction, Inc., dated May 30, 2023 and date stamped received by the St. Lucie County Planning & Development Services Department on July 3, 2023, subject to the following conditions: Planning and Development Services — Planning Division 1. The property owner(s), the developer, his successors or assigns shall file the parcel combination of Parcels 1432-221-0001-0006 & 1432-211-0002-0002 prior to the issuance of the final Certificate of Occupancy for the expansion. 2. The modified drive-aisle and staging area west of Building A shall be maintained in a manner that provides an unencumbered fire-access aisle. (New) Environmental Resources Department 3. Prior the final Certificate of Occupancy for the expansion, all Category I listed] invasive plant species shall be verified to have been eradicated from the site. [Land Development Code Section 7.09.05]. 4. Any future clearing activities shall be performed outside of scrub jay nesting season (March 1-June 30). 5. Prior to any future development activities, including, but not limited to clearing, filling, excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, a Vegetation Removal Permit or Exemption shall be issued by the Environmental Resources Department per LDC 6.00.03. (New) 6. The site landscaping shall remain in compliance with the landscape plan associated with the previously approved A-1 Roof Trusses Expansion Major Adjustment to Major Site Plan (Resolution 2020-05, Book 4373 Page 775, recorded 01/23/202). (New) C. The approvals and authorizations granted by this Order shall expire on July 19, 2025, unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Adjustment approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit PDS Order 2023-045 Page 4 File No.: MJSP-2304000019 by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. F. A Certificate of Capacity Exemption, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning & Development Services Department Director on July 19, 2023. G. This Order shall become effective upon the date of recording. H. A recorded copy of this Order shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director.
