WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Site Plan extension submitted by Abraham Chabab, Inc. on behalf of Dennis and Mark Chung of the Howard Group, Inc., reviewed the comments of the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. On December 13, 2006, the Growth Management Director approved a Minor Site Plan to be known as the Howard Group, for a 12,750 square foot light manufacturing facility for property located on the south side of Commercial Circe, approximately 2,090-feet west of Kings Highway in the IL (Industrial, Light) Zoning District. 2. On March 8, 2021, Abraham Chabab, Inc. submitted on behalf of Dennis and Mark Chung of the Howard Group, Inc., a Minor Site Plan application to be known as Hot Pie Warehouse. The Site Plan is to construct a new 11,850 sf2 warehouse/office building, with associated site improvements, to be located east of the existing 12,780 sfz warehouse/office building. The overall project site consists of three (3) lots (Lots 13, 14, and 15) totaling 1.70 acres, located within the IL (Industrial, Light) Zoning District. 3. On June 1, 2023, Abraham Chabab, PE., on behalf of the applicants, Dennis and Mark Chung of the Howard Group, Inc., requested a site plan extension in accordance with Section 11.02.06(B)(1)(4) for the Minor Site Plan titled "Hot Pie Warehouse — Minor Site Plan (MNSP3202125982)," dated August 20, 2021. The current expiration date is August 20, 2023, with an extension sought through August 20, 2024. 4. Planning staff performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis can be found in the Planning and Development Services Department memorandum titled "Hot Pie Warehouse - Minor Site Plan (EDO-2306000029)," dated July 12, 2023. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to 11.02.06 (B) of the St. Lucie County Land Development Code, the project known as Hot Pie Warehouse Minor Site Plan has been found to be eligible for an administrative extension. The approval granted under PDS Order 2021-044 is hereby extended from its scheduled date of expiration on August 20, 2023, and shall now expire August 20, 2024, for the property described in Part B, and is approved with the following conditions: Page 1 PDS No. 2023-054 File No.: MNSP-2306000029 Planning & Development Services Department: 1) Prior to the issuance of a Certificate of Occupancy the three (3) subject parcels shall be combined via Unity of Title, or similar instrument. Environmental Resources Department: 2) Prior to issuance of a Certificate of Occupancy all Category I listed invasive plants shall be eradicated from the site. B. The property on which this administrative extension to the approved Minor Site Plan is being granted is described as follows: LEGAL DESCRIPTION LOTS 13, 14 & 15, BLOCK "A" OF KINGS HIGHWAY INDUSTRIAL PARK UNIT ONE. ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 26, PAGES 16 & 16-A OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. SAID LANDS SITUATED IN ST LUCIE COUNTY, FLORIDA. ADDRESS(ES): 7469 & 7477 Commercial Circle, Fort Pierce, Florida 34951 PARCEL ID(S): 1335-801-0014-000-2, 1335-801-0015-000-9,1335-801-0016-000-6 C. This Minor Site Plan administrative extension approval shall expire on August 24, 2024, unless a building permit is issued and active or an extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The conditions set forth in Part "A" are an integral non -severable part of the site plan approval as granted by this extension. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, this development order extension approval granted by this Order shall become null and void. E. The Certificate of Capacity previously granted by the Planning and Development Services Director shall remain valid for the period of this development order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. F. A copy of this Order shall be attached to the site plan drawings described in Part "A", which shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed to the developer and agent of record as identified on the site plan applications.
