A RESOLUTION ACCEPTING THE FLORIDA DEPARTMENT
OF TRANSPORTATION AMENDMENT NUMBER ONE (1)
MAINTENANCE MEMORANDUM OF AGREEMENT (FM#
230262-5-52-01) FOR IMPROVEMENTS ON THE PEDESTRIAN
OVERPASS BRIDGE NO. 949901 OVER STATE ROAD (SR) 70
(OKEECHOBEE ROAD) AND AUTHORIZING THE CHAIR
AND CLERK OF THE CIRCUIT TO EXECUTE THE
AGREEMENT AND FURTHER AUTHORIZING THE COUNTY
ATTORNEY TO EXECUTE THE AGREEMENT BY
APPROVING IT AS TO FORM AND CORRECTNESS
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has
made the following determinations:
1. The Florida Department of Transportation ("Department") and St. Lucie
County ("Agency") entered into a Maintenance Memorandum of Agreement
("MMOA"), dated 02/24/2005 ("Agreement") for the purposes of requiring the
Agency to maintain Pedestrian Overpass Bridge No. 949901.
2. Pursuant to the Agreement, the parties agreed that the Agency shall maintain
the Pedestrian Overpass Bridge No. 949901 over State Road (SR) 70
hereinafter referred to as "Improvements" withing the project limits along SR
70 at Mile Post (M.P.) 14.257 as described in Exhibit A of the MMOA.
3. The Agency intends to undertake the Improvements on the Pedestrian Overpass
Bridge No. 949901 over State Road (SR) 70 pursuant to Permit # 202 1 -K-490-
00013, within the Department's right-of-way and the Agency intends to
undertake the Improvements as set forth in Exhibit B (Plans) of the MMOA and
add additional Department termination conditions to the Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
St. Lucie County, Florida:
1. The Board hereby accepts and approves Amendment Number One (1) to the
Maintenance Memorandum of Agreement, FM #230262-5-52-01, with the State
of Florida Department of Transportation.
2. The Board hereby authorizes the Chair and the Clerk of Court to execute the
above -referenced agreement and further authorizes the County Attorney to
execute the agreement by approving it as to form and correctness.
