HomeMy WebLinkAbout23-155 RESOLUTION NO. 2023-155 A RESOLUTION ACCEPTING THE FLORIDA DEPARTMENT OF TRANSPORTATION JOINT USE POND AGREEMENT FOR RECONSTRUCTION OF SR-713/KINGS HIGHWAY FROM NORTH OF COMMERCIAL CIRCLE TO NORTH OF ST. LUCIE BOULEVARD (ITEM/SEGMENT NUMBER FDIP: 438379-2-52-01) AND AUTHORIZING THE CHAIR TO EXECUTE THE AGREEMENT AND FURTHER AUTHORIZING THE COUNTY ATTORNEY TO EXECUTE THE AGREEMENT BY APPROVING IT AS TO FORM AND CORRECTNESS WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. The Florida Department of Transportation is constructing a transportation project for the reconstruction of SR-713/Kings Highway from north of Commercial Circle to north of St. Lucie Boulevard("Project"). 2. The Department owns State Road 713/Kings Highway ("SR 713") in St.Lucie County, Florida, and St. Lucie County owns St. Lucie Boulevard in St. Lucie County, Florida which intersects with SR 713 as depicted on "Exhibit A" attached. 3. The Department needs drainage to accommodate the widening of SR 713 pursuant to Department project number 438379-2-52-01 ("Project") and, after consideration of all relevant and necessary factors, has identified a property on the north side of St.Lucie Boulevard, as the best location for the drainage pond. As part of the project, St. Lucie Boulevard will be widened at the intersection with SR 713/Kings Highway, which will require the construction of onsite drainage. 4. The Department intends to construct a joint use pond drainage system and related drainage improvements(the"Pond System")on property which will be acquired by the Department as a Permanent Easement, and which is intended to accommodate joint drainage for SR 713/Kings Highway and a portion of St.Lucie Boulevard east of SR 713. See attached Exhibit A. 5. The Department shall provide the County with access rights to perform maintenance or repairs to the In Flow Pipe from St. Lucie Boulevard. The County agrees to maintain the In Flow Pipe from St.Lucie Boulevard in perpetuity for their continued use. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: 1. The Board hereby accepts and approves the Joint Use Pond Agreement with the State of Florida Department of Transportation. 2. The Board hereby authorizes and Chair to execute the above-referenced agreement and further authorizes the County Attorney to execute the agreement by approving it as to form and correctness.
