HomeMy WebLinkAbout23-162 • RESOLUTION NO. 2023-162 File No: PD-2307-000028 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA FOR A MAJOR ADJUSTMENT TO THE KINGSGATE CENTER PLANNED NON-RESIDENTIAL DEVELOPMENT (PNRD) FOR PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, and has made the following determinations: 1. PSC Storage Holdings, LLC presented a petition for a Major Adjustment to allow household self-storage as an eligible Conditional Use within the existing Planned Non-Residential Development(PNRD)Zoning District known as Kingsgate Center located on the southwest corner of Orange Avenue and Kings Highway, as described in Section B and depicted on Exhibit A. 2. On December 3, 2019,the Board of County Commissioners approved Resolution No. 2019- 264 to amend the Official Zoning Atlas from RM-11 (Residential, Multiple-Family—11)to the PNRD (Planned Non-Residential Development) Zoning District and authorize a Preliminary/Final PNRD site plan to be known as Kingsgate Center on the subject 11.41- acre site. 3. On November 17, 2021, the Kingsgate Center Plat was recorded in Plat Book 99, Pages 24- 25. 4. On April 27, 2023, the Planning & Development Services Director approved PDS Order 2023-009 for a Minor Adjustment to the Final PNRD to provide Tesla electric vehicle charging stations for Wawa, located on Lot 1. 5. On September 19, 2023, this Board held a public hearing on the petition for which public notice was published in the St. Lucie News Tribune, a sign was erected on the property, and a notice was mailed to all property owners within 500 feet at least 10 days prior to the hearing. 6. The Amendment to introduce household self-storage as an eligible Conditional Use within the Kingsgate Center PNRD is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.06.03 of the St. Lucie County Land Development Code. 7. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. RECORDING: $44.00 The analysis is found in the Planning and Development Services Department memorandum titled Major Adjustment to Kingsgate Center Planned Non-Residential Development (PNRD), dated September 5, 2023. 8. The proposed Major Adjustment will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 9. A Concurrency Certificate shall be evaluated and required with each future site plan proposed within the Kingsgate Center PNRD. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 (B)(7) of the St. Lucie County Land Development Code, the proposed Major Adjustment to allow household self-storage as a Conditional Use in the Kingsgate Center PNRD is in substantial conformity with the approved PNRD and is hereby approved, for the property described in Paragraph B. B. The property on which this Major Adjustment to the Planned Non-Residential Development (PNRD) is being granted is described as follows: LEGAL DESCRIPTION: KINGSGATE CENTER LOTS 2, 3, 4 & TRACT 1 Location: Southwest corner of Orange Avenue and Kings Highway. Parcel ID Numbers: 2311-801-0004-000-8, 2311-801-0001-000-7, 2311-801-0003-000-1 2311-801-0005-000-5 (Amendment not including Wawa, Lot 1 Parcel ID:2311-801-0002-000-4) C. The revision to the list of eligible permitted and conditional uses for the Kingsgate PNRD is attached to this Resolution as Exhibit "B". D. The Certificate of Capacity, authorized through Resolution 2019-264, shall remain for Lot 1, subject to the conditions and restrictions set forth in Resolution 2019-264. Future development within the Kingsgate Center PNRD shall require a Certificate of Capacity, where required. E. A copy of this Resolution shall be mailed to the owner and agent of record as identified on the application. F. This Resolution shall be recorded in the Public Records of St. Lucie County.
