AN ORDER GRANTING APPROVAL FOR A MAJOR
ADJUSTMENT TO MINOR SITE PLAN TO BE KNOWN AS
CONTENDER BOATS (FKA CHIQUITA CITRUS PACKING /
INDIAN RIVER CITRUS) FOR A PROPERTY LOCATED AT 350
MIDWAY ROAD, FORT PIERCE, FL.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the application for Major Adjustment to a Minor Site Plan submitted by EDC, Inc. on behalf of
Contender Boats, Inc, and the comments made by the St. Lucie County Development Review
Committee on this application and has made the following determinations:
1. EDC, Inc. filed an application on behalf of Contender Boats, Inc. for a Major Adjustment
to the Minor Site Plan to be known as Contender Boats (FKA Chiquita Citrus Packing /
Indian River Packers), to expand the manufacturing facility to add two buildings totaling
139,860 sq. ft., add a 1,200 sq. ft. containment area, and add resin tanks.
2. In January 1987, the Board of County Commissioners approved the Chiquita Citrus
Packing Site Plan via Resolution 87-17. The site plan encompassed 26.16 acres(net) and
provided for 86,080 sq. ft. containing a fruit processing warehouse, fruit coloring structure
and a 4,000 sq. ft. office. Phase 1 included left and right turn lanes on Midway Road, a
stormwater pond and 125 parking spaces.
3. In January 1988, a Minor Site Plan Adjustment was approved to expand the office by
2,400 sq. ft., add a truck wash area, and add 12 parking spaces.
4. In June 1988, a Minor Site Plan Adjustment was approved to add 9,600 sq. ft. of
warehouse space and add 10 parking spaces.
5. In May 1989, a Minor Site Plan Adjustment was approved to add a 2,400 sq. ft. office
addition while providing an additional 7,800 sq. ft. warehouse.
6. In September 1989, a Minor Site Plan Adjustment was approved to add a "truck bin
drench" area for the purpose of spaying fungicide on trucks loaded with fruit.
7. In July 1996, a Minor Site Plan Adjustment was approved to revise the Truck Drench
building. This revised site plan accounted for 98,080 sq. ft. for the citrus processing and
packing facility. This plan provided 156 parking spaces and truck loading.
8. In August 2000, a Minor Site Plan was approved via CD 00-015 for The Packers of Indian
River—Plat One.
9. In September 2000, "The Packers of Indian River- Plat One"was approved and recorded,
with most of the project site within "Lot 1", totaling 19.47 acres with Tract A, 6.43 acres,
dedicated to support stormwater to the platted lands. The site survey listed the building
area as 98,597 sq. ft.
10. In January 2005, GM 05-001 authorized a "Replat" for The Packers of Indian River- Plat

the abutting cul-de-sac.
11. In December 2020, Contender Boats, Inc. acquired the property, and launched
renovations to develop a boat manufacturing facility.
12. The St. Lucie County Development Review Committee has reviewed the proposed Major
Adjustment to the Minor Site Plan and found it to meet the technical requirements of the
St. Lucie County Land Development Code, and to be consistent with the St. Lucie County
Comprehensive Plan, and to have satisfied the standards of review set forth in Section
11.02.07, Standards for Site Plan Review, subject to the conditions set forth in Part "A" of
this Order.
13. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
14. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
15. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
16. The proposed project is served by Fort Pierce Utilities Authority (FPUA) for water and
wastewater services.
17. Planning Staff has performed a detailed analysis of the project and determined it to be
consistent with Sections 11.02.04(C) and 11.02.07, Standards for Site Plan Review of the
St. Lucie County Land Development Code, and has been found to generally consistent
when the conditions outlined below are required. The analysis is found in the Staff Report
for the Contender Boats Master Site Plan - Major Adjustment to a Minor Site Plan (SPMJ-
3202226333-26333), dated September 29, 2023.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the Major
Adjustment to the Contender Boats Minor Site Plan is hereby approved as shown on the
site plan drawings prepared by EDC, Inc., dated June 3, 2022, and date stamped received
by the St. Lucie County Planning and Development Services Department on July 19, 2022,
as depicted in Exhibit"A" subject to the following conditions:
Planning and Development Service Department, Planning Division:
1. Prior to the issuance of a Site Development Permit, the Site Plan shall provide a
pedestrian link(asphalt, concrete or similar)to allow for direct movements to/from the
building(s) served.
2. Prior to the issuance of a Certificate of Occupancy, a sidewalk connection from the
proposed loading space(s) to the building entrance shall be constructed.
Environmental Resources Department:
3. Prior to issuance of a Vegetation Removal Permit or Exemption, whichever occurs first,
a gopher tortoise survey conducted by a state certified gopher tortoise agent may be

required per Florida Fish and Wildlife Conservation Commission (FWC) protocol prior
to initiation of any clearing activities onsite.
4. Prior to issuance of a Certificate of Occupancy all Category I listed invasive plants shall
be eradicated from the site.
5. Within 90 days of Major Adjustment to Minor Site Plan, the landscape buffer along the
southern perimeter shall be installed in accordance with the approved landscape plan.

6. A Site Development Permit is required prior to performing site improvement activities.
In accordance with the permit and Land Development Regulations, the applicant shall
retain the FOR for site inspections and final certification.
7. A Road Improvement Agreement and appropriate bond will be required for all
permanent improvements within the Right-of-Way.
8. A fee-in-lieu of sidewalk along Environment Drive is required to be submitted for
approval by the Board of County Commissioners prior to issuance of a Site
Development Permit. Should the request not be approved by the Board, a sidewalk
would be required to be constructed.
B. The property on which this Major Adjustment to a Minor Site Plan is being granted is
described as follows:

Lot 1, the Packers of Indian River Plat One, according to the Map or Plat thereof as
recorded in Plat Book 39, Page 11, Public Records of Saint Lucie County, Florida.

C. The approvals granted by this administrative order shall expire twenty-four (24) months
from the effective date, unless a Building Permit is obtained, or an extension is granted in
accordance with the provisions of Section 11.02.06 of the St. Lucie County Land
Development Code.
D. The developer, including any successors in interest, is advised as part of this Major
Adjustment to the Contender Boats Minor Site Plan, all applicable development permits
and construction authorizations shall be obtained from the appropriate State, Federal, and
Local regulatory agencies including, but not limited to, the United States Army Corps of
Engineers, the Florida Department of Environmental Protection, and South Florida Water
Management District, and the St. Lucie County Environmental Resources, Public Works,
and Building Departments prior to the commencement of any development activities on
the property described in Part "B". Issuance of this permit by the County does not in any
way create any rights on the part of the developer to obtain a permit from a State or Federal
agency and does not create any liability on the part of the County for issuance of this
permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed
by a State or Federal agency or undertake actions that may result in a violation of State
or Federal law.
E. This Order shall become effective upon the date of approval indicated below. Should the
property owner, developer or authorized agent wish to appeal any condition described in
Part "A" above, all such appeals must be filed in writing with the County Administrator
within thirty (30) days of the rendering of this Order, as described in Section 11.02.04(B),

St. Lucie County Land Development Code. Should an appeal to this Order be filed, no
permitting reviews or further administrative action shall take place on the processing of
this development project until the appeal is resolved.
F. A copy of this Order shall be attached to the site plan drawings described in Part"A",which
plan shall be placed on file with the St. Lucie County Planning and Development Services
Department and mailed to the developer and agent of record as identified on the site plan
application.
G. The conditions set forth in Part "A" are an integral non-severable part of the site plan
approval granted by this Order. If any condition set forth is Part "A" is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the site plan approval granted by this order shall become null and void.
H. A Certificate of Capacity, a copy of which is attached hereto as Exhibit "B" and made a
part hereof the Order, was granted by the Planning and Development Services
Department Director.
This Order shall be recorded in the Public Records of St. Lucie County.
