A RESOLUTION APPROVING A VARIANCE FOR
CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and
evidence, including, but not limited to the staff report, has made the following determinations:
1. Petition of Gary Sofen of Laurel Road, LLC for a variance from the provisions of LDC
Section 7.05.06.(C.)(2.)(f.)(3.) — Driveway Requirements, proposing a driveway with left
turn movements, on a corner lot, 103.1 feet from the base building line representing a
246.9 feet reduction from the required 350 feet. The subject property, and project known
as Naco Road Contractor Trades, is located at 2306 Naco Road in the IL (Industrial,
Light) Zoning District.
2. On August 30, 2023, this Board held a public hearing on the petition, after publishing a
notice of such hearing, installing a sign on the property, and notifying by mail all owners
of property within 500 feet of the subject property.
3. After consideration of the testimony presented during the public hearing, including staff
comments, exhibits, and the standards of review for granting variances set out in Section
10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made
the following determinations:
The requested variance has met the standards of review as set forth in Section
10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan, because:
a. The granting of the requested variance arises from conditions that are unique
and peculiar to the land as the subject parcel meets the required lot size and
dimensional criteria for IL (Industrial, Light) Zoning District but cannot satisfy the
minimum 350 feet distance from the base building line to the driveway to allow
for left turn movements, the subject parcel abuts a parcel in the municipality of
St. Lucie Village, the parcel slopes along Naco Rd. making it difficult for a
driveway to be placed closer to the west property line on the west side of the
property, and allowing left turn movements into and out of the driveway along
Naco Road will prevent vehicles from making a U-turn in the intersection of N.
Old Dixie Hwy. and Naco Road and avoid routing traffic through residential
neighborhoods in order to access the property by right turns.
b. With the conditions set forth below, the granting of the requested variance will not
impair or otherwise injure other property or improvements in the area in which the
subject property is located.

c. The granting of the requested variance is the minimum necessary that will make
reasonable use of the land and building.
d. The requested variance meets the general spirit and intent of the St. Lucie
County Land Development and the St. Lucie County Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
Florida:
A. The petition of Gary Sofen of Laurel Road, LLC for a variance from the provisions of
LDC Section 7.05.06.(C.)(2.)(f.)(3.) — Driveway Requirements, proposing a driveway with
left turn movements, on a corner lot, 103.1 feet from the base building line representing
a 246.9-foot reduction from the required 350 feet for the property depicted on the
attached boundary survey as Exhibit "A" and attached proposed site plan as Exhibit "B",
and described below, as shown on the boundary survey created by Alexander J. Piazza
PSM, Inc., submitted to the Planning and Development Services Department and date
stamped on September 30, 2009, is approved subject to the following conditions:
1) The development and use of the property shall proceed in accordance with the
proposed site plan titled "Proposed Contractors Trades Building Expansion Site
Plan" and dated March 2023, containing a proposed 10,012.4 sq. ft. addition, for
Specialty Trade Contractor uses (Institute of Traffic Engineers Land Use Code 180)
and the associated trips projected. A Traffic Impact Statement completed by Stephen
Cooper, P.E. & Associates, Inc., and dated November 21, 2022, estimates the net
daily, AM, and PM peak trips potentially generated due to the proposed development
are 108, 22 (17 In/5 Out) and 24 (9 In/15 Out) trips respectively.
Legal: THE FOLLOWING DESCRIBED PROPERTY SITUATE, LYING AND BEING IN
ST. LUCIE COUNTY, FLORIDA:
FROM A RAILROAD SPIKE AT THE INTERSECTION OF THE CENTERLINES
OF PAVEMENT OF OLD DIXIE HIGHWAY (SR 605) AND NACO ROAD, SAID
POINT BEING 642.6 FEET NORTH AND 1943.2 FEET EAST OF A COQUINA
ROCK MARKING THE SOUTHWEST CORNER OF THE NE 1/4 OF SECTION
33, TOWNSHIP 34 SOUTH, RANGE 40 EAST, ST. LUCIE COUNTY,
FLORIDA, RUN THENCE NORTH 89 DEG. 30 MIN. WEST, ALONG THE
CENTERLINE OF NACO ROAD, 35.15 FEET TO A POINT; THENCE NORTH
19 DEG. 46 MIN. WEST PARALLEL TO THE CENTERLINE OF PAVEMENT
OF OLD DIXIE HIGHWAY, RUN 53.30 FEET TO A CONCRETE MONUMENT
ON THE NORTH RIGHT OF WAY LINE OF NACO ROAD AND THE WEST
RIGHT OF WAY LINE OFOLD DIXIE HIGHWAY, AND THE POINT OF
BEGINNING OF THE LANDS HEREIN DESCRIBED.
FROM THE POINT OF BEGINNING CONTINUE NORTH 19 DEG. 46 MIN.
WEST, ALONG THE WEST RIGHT OF WAY LINE OF OLD DIXIE HIGHWAY,
BEING 33 FEET WESTERLY OF, AND PARALLEL TO THE CENTERLINE
THEREOF, RUN 250.0 FEET TO A CONCRETE MONUMENT; THENCE
NORTH 89 DEG. 30 MIN. WEST PARALLEL TO THE CENTERLINE OF NACO
ROAD, RUN 250.0 FEET TO AN IRON PIPE; THENCE SOUTH 19 DEG. 46

B. Based on the evidence presented, and on the conditions set forth, this variance is
approved.
C. This variance shall expire twelve months from the date of adoption unless a building
permit is approved or an extension is granted in accordance with Section 10.01.06, of
the St. Lucie County Land Development Code.
D. This Order shall become effective upon the date indicated below. An appeal from the
Board of Adjustment's action may be processed within thirty (30) days following the
rendition of the decision of this order in accordance with Section 10.01.07, of the St.
Lucie County Land Development Code.
E. This Order shall be recorded in the public records of St. Lucie County.
