HomeMy WebLinkAboutPDS-23-072 - Mainstreet Village at PGA-Phase 19 A a A A A A A • A A 0 0 0 0 A 11111117,11 MA WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Site Plan submitted by Redtail Design Group, Inc., acting as an agent for owner Brandywine I I I LLC, reviewed the comments of tht St. Lucie County Development Review Committee on this application, and made the following determinations: 1 . Brandywine Three (111) LLC has proposed a Minor Site Plan known as Mainstreet Village at PGA — Phase 1, on Lot 3 Mainstreet Village Phase 2, in order to construct two retail buildings totaling 20,000 square feet along with paved parking, stormwater facilities, required landscaping, and bicycle/pedestrian facilities. Mainstreet Village is a commercial subdivision located between Commerce Center Drive and Reserve Boulevard/St. Lucie West and bounded on the east by 1-95. The property is zoned CG (Commercial, General) and is described in Section B below. 2. On July 20, 1999, through Resolution 99-147, the Board of County Commissioners amended Resolution 97-162 that approved a Major Site Plan for this commercial subdivision within the Reserve Development of Regional Impact (DRI), to be known as Mainstreet Village S/D in the Reserve DRI. 3. On December 20, 2000, a plat including the project, entitled "Reserve Commercial Tract A North Mainstreet Village Phase 1 was recorded in Plat Book 39 Page 22 and 22K 4. On March 22, 2011, the St. Lucie County Planning and Development Services Department granted a Minor Adjustment to reduce the original 13-lot commercial subdivision to a 12-lot commercial subdivision. 5. On March 2, 2017, the St. Lucie County Planning and Development Services Director granted a Minor Adjustment to a Major Site Plan to reconfigure nine lots, add an access tract and provide eleven on -street parking stalls within the existing right-of-way of the commercial subdivision. 6. On May 3, 2018, the St. Lucie County Planning and Development Services Director granted a Minor Adjustment in order to adjust lot lines, lot areas, lot numbering and consolidate previously designed lots, The proposed adjustment reconfigured Lot 3, combined Lots 4, 5, 6, and 7 into a reconfigured Lot 4, and renumbered Lots 9 and 8 to *age 1 MICHELLE R. The proposed adjustment is consistent with the general purpose goals, objectives, and standards of the Final Development Order, Resolution No. 12-004 for the Development of Regional Impact known as the Reserve. 8. The Development Review Committee has reviewed the site plan and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 9. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 9. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 10.The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan known as Mainstreet Village at PGA Village Phase 1, is hereby approved as shown on the site plan, attached as Exhibit "A" and dated May 10, 2023; the landscape plan, attached as Exhibit "B" and dated January 23, 2023; and architectural elevations, attached as Exhibit "C" for the project prepared by Redtail Design Group and dated August 1, 2023; and the certificate of capacity, attached as Exhibit "D". The approval is subject to the following conditions: 1) Prior to the issuance of a building permit, the developer or assigns shall provide an executed copy of a final utility service agreement. 2) The Certificate of Capacity shall remain effective for the period of the Site Plan including all requested extensions. If this Resolution or the development authorizations granted by it are allowed to expire a new Certificate of Capacity will be required prior to any new development authorizations. 3) Prior to the approval of any construction authorizations or building permits, final engineering plans shall be reviewed and approved by the St. Lucie County Engineering and Water Quality Division. 4) A Site Development Permit is required prior to performing site improvement activities. In accordance with the permit and Land Development Regulations, the applicant shall retain the Engineer of Record for site inspections and final certification. 5) Prior to commencement of development, including, but not limited to clearing, filling, Page 2 File No.: MNSP 2302-000059 PDS 2023-072 excavation, grading, or planting of vegetation, as defined in LDC 2.00.00, the applicant shall provide a revised tree survey and tree mitigation plan depicting the cabbage palm of mitigation threshold. 6) Prior to the issuance of a Vegetation Removal Permit or Exemption, a gopher tortoise survey per Florida Fish and Wildlife Conservation Commission protocol shall be provided to the Environmental Resources Department. Should the survey show impacts to gopher tortoises a Florida Fish and Wildlife Conservation Commission permit shall be required. 7) Prior to issuance of a Certificate of Occupancy all Category I listed invasive species shall be eradicated from the site. 8) Prior to the final authorization of the infrastructure improvements, all required landscaping along the interior and exterior roadways shall be installed according to the approved landscape plan. 9) The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. B. The property on which this Minor Site Plan approval is being granted is described as follows: LEGAL DESCRIPTION MAINSTREET VILLAGE PHASE 2 (PB 77-17) LOT 3 Parcel ID # 3327-808-0002-000-7 C. The approvals granted by this administrative order shall expire twenty-four(24) months from the effective date, unless a Building Permit is obtained, or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The conditions set forth in Section "A"are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Section "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. E. The developer is advised as part of this site plan approval that any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, the St Lucie County Fire District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Section "B". Issuance of this permit by the County does not in any Page 3 File No.: MNSP 2302-000059 PDS 2023-072 way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. F. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Section "A" above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. G. A copy of this Order shall be attached to the site plan drawings, described in Section "A" and attached as Exhibit"A", which plan shall be placed on file with the St. Lucie Planning and Development Services Department and copies provided to the developer and agent of record as identified on the site plan applications. H. The Certificate of Capacity, attached as Exhibit "D", shall be valid for the same period as this Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. I. This Order shall be recorded in the Public Records of St. Lucie County.
