AN ORDER GRANTING AN ADMINISTRATIVE VARIANCE
FOR PROPERTY LOCATED AT 9413 HORTON AVE.
IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
application for an administrative variance and the staff report and made the following
determinations:
1. Alberto Ruiz filed a Petition for an Administrative Variance from the provisions of Section
7.04.01 (Table 7-10) Lot Size and Dimensional Requirements of the St. Lucie County Land
Development Code (LDC) for a proposed single-family home to encroach up to 13 feet into
the required minimum 50-foot front yard (setback) for property located at 9413 Horton Ave.,
Fort Pierce, FL.
2. The subject parcel is in the AR-1 (Agricultural, Residential — 1) Zoning District, however, the
property does not meet the 1-acre minimum lot area for this zoning district. A non-conforming
lot of record search was performed by the County, and it was determined that the lot is in the
same configuration as of June 1, 1984, and is a buildable Non-conforming Lot of Record.
3. On July 24, 2023, Planning & Development Services staff notified by mail all owners of
property within 500 feet of the petition site and the applicant installed a sign on the subject
property in accordance with LDC Section 11.00.03.
4. The Administrative Variance provides for a 26 percent (26%) reduction of the minimum
setback, from 50 feet to 37 feet. The encroachment into the minimum front setback is for a
length of approximately 180 feet, generally parallel to the front property line, for the proposed
dwelling depicted on the boundary survey dated October 11, 2023, attached as Exhibit "A".
5. Whereas, LDC Section 10.01.14.C., authorizes the Planning and Development Services
Director to grant variances of up to thirty-five percent (35%) of the minimum front, side and
rear side yard setbacks within the AR-1 Zoning District upon demonstration by the applicant
of the standards established by LDC Section 10.01.14.C.3.
6. The requested variance meets the standards of review as set forth in LDC Section
10.01.14.(C.) and is not in conflict with the goals, objectives, and policies of the St. Lucie
County Comprehensive Plan, because:
a) No objections were received from the public in regard to the relief requested;
b) The encroachment will not have an undue adverse effect on adjacent property, does not
encroach into any easements, common areas, or environmentally sensitive areas;
c) The encroachment does not impair or otherwise injure other property values or
improvements in the area in which the subject property is located; and

d) The request is the minimum variance that will make possible the reasonable use of a
single-family home.
NOW, THEREFORE, BE IT ORDERED by the Planning & Development Services Director:
A. Pursuant to LDC Section 10.01.14.C., the requested variance to allow a front setback of 37
feet in the AR-1 Zoning District for a single-family dwelling located at 9413 Horton Ave. is
hereby approved subject to the conditions set forth in paragraphs 1 through 4 below.
1. This variance applies only to construction of the principal structure, a single-family
dwelling, for the specific footprint shown on the approved survey. The variance remains
for the type of structure in the specific footprint in perpetuity and runs with the land.
2. The approval of this variance does not reduce or waive any other required setback for any
other structure or addition to the principal structure.
3. Prior to the issuance of building permits, the survey must be updated to provide the
following additional information:
a. The dimensions of the driveway.
b. The actual elevation of the drain field and the Finished Floor Elevation (FFE) of the
proposed dwelling. The proposed FFE per the submitted plans shows the minimum
requirement of 1.5 feet above the benchmark specified on the plans. The actual FFE
of the dwelling must show compliance with the drainage requirements of the Land
Development Code.
c. Additional topographic elevations showing adequate drainage for future construction.
4. The property on which this approval is being granted is generally described as:

5. This Order shall become effective upon the date indicated below. An appeal from the
Planning & Development Services Director's action may be submitted within thirty (30)
days, in accordance with LDC Section 10.01.14.C.9.
6. This Order shall be recorded in the Public Records of St. Lucie County.
