Florida Power & Light Company 700 Universe Boulevard Juno Beach, Florida 33408 CONSERVATION EASEMENT THIS CONSERVATION EASEMENT {"Conservation Easement'D is given this.3L day of MAr4- , 2022, by Florida Power & Light Company, a Florida corporation ("Grantor"), having an address at 700 Universe Boulevard, Juno Beach, Florida 33408, Attention: Corporate Real Estate Department, to St. Lucie'County, a political subdivision of the State of Florida ("Grantee'D, having an address at 2300 Virginia Avenue, Fort Pierce, Florida 34982. As used herein, the term "Grantor" shall include any and all heirs, successors or assigns of the Grantor, and all subsequent owners of the "Conservation Area" (as hereinafter defined), and the term "Grantee" shall include any successor or assignee of the Grantee. WITNESSETH: WHEREAS, the Grantor is the owner of certain lands situated in St. Lucie County, Florida, and more specifically described in Exhibit "A" attached hereto and incorporated herein by this reference ("Property"); and WHEREAS, the Grantor is proposing the development of a solar energy center ("Project") on the Property, which is subject to the regulatory jurisdiction of the St. Lucie County Board of County Commissioners ("County'); and WHEREAS, the County approved the Conditional Use Permit and Major Site Plan for the Project pursuant to Resolution No. 2022-31 ("ResoIution'); and WHEREAS, the Resolution requires that Grantor maintain, in perpetuity, that portion of the Property designated as preserve area ("Conservation Area's as more particularly described in Exhibit "B" attached hereto and incorporated herein by this reference; and WHEREAS, the Resolution further requires that the Conservation Area be maintained in accordance with that certain Preserve Area Management and Monitoring Plan ("Management Plan") as more particularly described in Exhibit " C" attached hereto and incorporated herein by this reference; and WHEREAS, the Grantor is agreeable to granting and securing to the Grantee a perpetual Conservation Easement as defined in Section 704.06, Florida Statutes, over the Conservation Area. NOW, THEREFORE, Grantor hereby grants, creates, and establishes a perpetual Conservation Easement for and in favor of the Grantee upon the Conservation Area which shall run with the land and be binding upon the Grantor, and shall remain in full force and effect forever. OR BOOK 4799 PAGE 2912 The scope, nature, and character of this Conservation Easement shall be as follows: 1. Recitals. The recitals hereinabove set forth are true and correct and are hereby incorporated into and made apart of this Conservation Easement. 2. Purpose. It is the purpose of this Conservation Easement to retain land or water areas in their natural, vegetative, hydrologic, scenic, open, agricultural or wooded condition and to retain such areas as suitable habitat for fish, plants or wildlife. Those wetland and/or upland areas included in this Conservation Easement shall be maintained in the conditions required by the Management Plan. To carry out this purpose, the following rights are conveyed to Grantee by this easement: a. To enter upon the Conservation Area upon at least 24 hours prior notice and at reasonable times, with any necessary equipment or vehicles to enforce the rights herein granted in a manner that will not unreasonably interfere with the use and quiet enjoyment of the Property by Grantor; and b. To enjoin any activity on or use of the Conservation Area that is inconsistent with this Conservation Easement and to enforce the restoration of such areas or features of the Conservation Area that may be damaged by any inconsistent activity or use. 3. Prohibited Uses. Except for exotic vegetation removal, replanting with appropriate native vegetation, vine control, removal of trash and debris or other maintenance and monitoring activities described herein that are permitted or required by the Resolution or the Management Plan, the following activities are prohibited in or on the Conservation Area: a. Construction or placing of buildings, roads, signs, billboards or other advertising structures on or above the ground; ; b. Dumping or placing of soil or other substance or material as landfill, or dumping or placing of trash, waste, or unsightly or offensive materials; C. Removal or destruction of trees, shrubs, or other vegetation, except for the removal of exotic or nuisance vegetation in accordance with the Management Plan; d. Excavation, dredging, or removal of loam, peat, gravel, soil, rock, or other material substance in such manner as to affect the surface; e. Surface use except for purposes that permit the land or water area to remain in its natural or enhanced condition; and f. Activities detrimental to drainage, flood control, water conservation, erosion control, soil conservation, or fish and wildlife habitat preservation including, but not limited to, ditching, diking and fencing. OR BOOK 4799 PAGE 2913 4. Grantor's Reserved Rights. Grantor reserves all rights as owner of the Property, including the right to engage in uses of the Conservation Area that are not prohibited herein, including the right to construct, operate and maintain utilities, and which are not inconsistent with any County rule, criteria, permit and the intent and purposes of this Conservation Easement. 5. No Dedication. No right of access by the general public to any portion of the Property or the Conservation Area is conveyed by this Conservation Easement. 6. Grantee's Liability. Grantee shall not be responsible for any costs or liabilities related to the operation, upkeep or maintenance of the Conservation Area. 7. Acts Beyond Grantor's_ Control. Nothing contained in this instrument shall be construed to entitle Grantee to bring any action against Grantor for any injury to or change in any portion of the Property other than the Conservation Area, or portion thereof, which is in noncompliance with the Resolution or the Management Plan, that results from natural causes beyond Grantor's control, and not initiated by Grantor, including but not limited to fire, flood, storm and earth movement. Should any portion of the Conservation Area be injured or changed from natural causes, including but not limited to fire, flood, storm and earth movement, resulting in the Conservation Area, or portion thereof, becoming noncompliant with the Resolution or the Management Plan, Grantor shall be provided notice and a reasonable opportunity to restore the affected Conservation Area to a condition that satisfies the Management Plan requirements prior to the Grantee bringing any action for noncompliance with the Resolution or the Management PIan. 8. Property Taxes. Grantor shall keep the payment of taxes and assessments on the Conservation Area current and shall not allow any mechanics or materialmen's lien on the Conservation Area superior to this Conservation Easement. In the event Grantor fails to extinguish or obtain a subordination_ of such lien, in addition to any other remedy, Grantee may, but shall not be obligated to, elect to pay the; lien on behalf of Grantor and Grantor shall reimburse Grantee for the actual and reasonable amount paid by Grantee, together with Grantee's actual and reasonable attorney's fees and costs, with interest at the maximum rate allowed by law, no later than thirty (30) days after evidence of such payment was delivered to Grantor. In the event the Grantor does not so reimburse Grantee,,the debt owed to Grantee shall constitute a lien against the Conservation Area which shall automatically relate back to the recording date of this Conservation Easement. Grantee may foreclose this lien on the Conservation Area in the manner provided for mortgages on real property. 9. Enforcement bN Grantee.. Enforcement of the terms, provisions and restrictions of this Conservation Easement shall be at the reasonable discretion of Grantee, and any forbearance on behalf of Grantee to exercise its rights hereunder in the event of any breach hereof by Grantor, shall not be deemed or construed to be a waiver of Grantee's rights hereunder. 10. Maintenance Obli ations of Grantor. Grantor shall maintain in perpetuity, the Conservation Area in accordance with the Management Plan. Such maintenance shall include, but is not limited to, exotic vegetation removal, replanting with appropriafe native vegetation, vine control, and removal of trash and debris. The maintenance schedule should be so as to keep the Conservation Area ecologically functional and high quality, as well as a minimum 90% free of exotic vegetation. OR BOOK 4799 PAGE 2914 I a I1. Asst,,, ment. Grantee will hold this Conservation Easement exclusively for conservation purposes. Grantee will not assign its rights and obligations under this Conservation Easement except to another organization or entity qualified to hold such interests under the applicable state laws. 12. Severability. If any provision of this Conservation Easement or the application thereof to any person or circumstances is found to be invalid, the remainder of the provisions of this Conservation Easement shall not be affected thereby, as long as the purpose of the Conservation Easement is preserved. 13. Terms and Restrictions. Grantor shall insert the terms and restrictions of this Conservation Easement in any subsequent deed or other legal instrument by which Grantor divests itself of any interest in the Property. 14. Written Notice. All notices, consents, approvals or other communications hereunder shall be in writing and shall be deemed properly given if sent by United States certified mail, return receipt requested, addressed to the appropriate party or successor -in - interest. 15. Modifications. This Conservation Easement may be amended, altered, released or revoked only by written agreement between the parties hereto or their heirs, assigns or successors -in -interest, which shall be filed in the public records in St. Lucie County, Florida. 16. Extinguishment. This Conservation Easement can only be terminated or extinguished, whether in whole or in part, by judicial proceedings in a court of competent jurisdiction. Grantor believes that any changes in the use of neighboring properties will increase the benefit to the public of the continuation of this Conservation Easement, and Grantor and Grantee intend that any such changes shall not be deemed to be circumstances justifying the termination or extinguishment of this Conservation Easement. In addition, the inability of Grantor to conduct or implement any ok all ;of the uses allowed under the terms of this Conservation Easement, or the unprofitability of doing so, shall not impair the validity of this Conservation Easement or be considered grounds for its termination or extinguishment. TO HAVE AND TO HOLD unto Grantee forever. The covenants, terms, conditions, restrictions and purposes imposed with this Conservation Easement shall be binding upon Grantor, and shall continue as a servitude running in perpetuity with the Property. The proposed Bluefield Preserve Solar Energy Center would consist of an approximately 74.5-megawatt (MW) solar photovoltaic energy center located on approximately452-acres with associated road and stormwater infrastructure as well as a collector yard. This Preserve Area Management and Monitoring Plan (PAMMP) addresses the delineation of the preserve area, prohibited activities, and monitoring and maintenance for the preserve areas. Existing Conditions The existing site is an abandoned citrus grove that has recently been converted to pasture and is currently used to graze cattle. Although all citrus trees havel been removed, remnant agricultural furrows and irrigation ditches are still present throughout the site. The site consists of various pasture grasses with exotic species encroaching along the banks of existing ditches and furrows. Approximately 6.21 acres of pine flatwoods also exist on -site. Native trees were surveyed, and results are discussed further below. A USGS Topographic Map shows the site elevation to be approximately 55-60 feet (Appendix A - Figure 2). The US Department of Agriculture (USDA)/Natural Resources Conservation Service (NRCS) Soll Survey of St. Lucie County, Florida, maps the following soils on the property: (1) Anclote sand, depressional, (21) Lawnwood and Myakka sands, (24) Myakka fine sand, (29) Pendarvis and pomello sands, 0 to 5 percent slopes, (40) Samsula muck, depressional, (50) Waveland and Immokalee fine sands, and (51) Waveland- Lawnwood complex, depressional. A copy of the USDA/NRCS soils map is attached as Appendix A - Figure 3. The existing land use and cover types found on -site were mapped using the Florida Land Use, Cover and Forms Classification System (FLUCFCS) developed byl the Florida Department of Transportation (FDOT). Project land use and cover types were assessed through a combination of desktop aerial analysis and field reconnaissance assisted by hand-held GPS. A FLUCFCS map of the site is attached (Appendix A - Figure 4). Due to the use of the project site for agricultural purposes, few natural communities are present. FLUCCS 118 — Residential, rural (t Z91 acres) An area at the entrance to the project site contains a building used as an office/shop for the previous site activities. FLUCCS 211 — Improved Pasture (t 424.32 acres) Improved pastures were observed throughout the entirety of the site, with these areas frequently grazed by cattle_ Vegetation observed in these areas primarily consist of smutgrass (Sporobolus indicus), bromsedge bluesteam (Andropogon virginicus), tropical soda apple (Solanum viarum), caesarweed (Urena lobato) and with intermittent cabbage palms (Sabal palmetto) and live oak (Quercus virginiano). A powerline extending east to west along the entrance road was also observed. FLUCCS 411— Pine Flatwoods (t 6.21 acres) Pine flatwoods are found in the southeastern portion of the site. These areas are characterized primarily by slash pine (Pines elliotti) and dense saw palmetto (Serenoo repens), with gallberry (llexglabra), muscadine (Vitisrotundifolia), broomsedge bluestem, catbrier(smilax spp.) like oak (Quercus virginiano), and laurel oak (Quercus laurifolla) are also present. 2 1 P a g e OR BOOK 4799 PAGE 2855 Bluefield Preserve Solar Energy Center Preserve Area Management and Monitoring Plan FLUCCS510—AgriculturaiDitches and Furrows (f 1818 acres) Due to ongoing agricultural practices within the site, irrigation ditches and furrows are a prominent feature found throughout the project boundaries. Ditches (t 7.7 acres) were typically 20 feet wide and interconnected. Vegetation observed was limited and included torpedograss (Panicum repens), cattail (Typha spp.), Peruvian primrose -willow (Ludwigia peruviana), spikerush (Eleocharisspp.) and pennywort (HydrocoW spp.) As well as floating aquatic species including duckweed (Lemna minor), water lettucel (Pistia stratiotes) and water hyacinth (Eichhornia crassipes). Additional vegetation along the banks of the ditches included caeserweed, Brazilian pepper (Schinus terbinthifolia), muscadine, and wax myrtle (Morello cerifera). Smaller agricultural furrows (t 11.1 acres) were typically less than 6 feet wide and vegetation was limited to a few species. Observed vegetation included soft rush (luncus effusus), duck potato (Sagittaria latifolia) and smartweed. FLUCCS 530—Reservoirs (+2.04 acres) Multiple smalll ponds were found onsite and were utilized as stock ponds for the irrigation ditches. These areas were characterized by open water with steep embankments and little to no vegetation. Vegetation observed consisted of duckweed. The presence of wetlands was evaluated based on the Florida unified wetland delineation methodologies in accordance with Chapter 62-340, Florida Administrative Code (FAC) and the U.S. Army Corps of Engineers (USACE) 1987 Wetland Delineation Manual, and regional supplement. These methods take in to account the prevalence of wetland vegetation, hydric soil indicators, and wetland hydrology. Surface waters include both natural and man-made bodies of water such as streams, lakes, ponds, canals, and ditches. A Wetlands and Surface Waters Map Is attached (AppendixA - Figure 5). FLUCCS 617 — Mixed Wetland Hardwoods (t Z09 acres) This habitat was observed within the north central area of the site adjacent to an agricultural ditch. Woody vegetation observed within the swamp canopy and midstory primarily includes sweetbay (Magnolia virginiana), red maple (Acer rubrum), wax ,myrtle and pop ash (Fraxinus carohniana). Additional vegetation observed includes jointed spikerush (Eleocharis interstincta), Virginia chain fern (Woodwardia virginica), Brazilian pepper, Japanese climbing fern (Lygodium japonicum), swamp fern (Telmatoblechnum serrulatum), pennywort, dayflower (Cestrum diurnum), smartweed, pickerelweed (Pontederia cordota), and duck potato FLUCCS 618— Mixed Shrubs (t 1.42 acres) A bay swamp was observed within the central -northern area of the site adjacent to an irrigation ditch. The fringe oflthis area contained little to no vegetation with soils disturbed from cattle usage. Woody vegetation observed within the swamp canopy and midstory primarily includes sweetbay (Magnolia virginiana), with other species present intermittently including red maple (Acer rubrum), wax myrtle, and pop ash (Fraxinus caroliniana). Additional vegetation observed includes spikerush, Virginia chain fern (Woodwardia virginica), Brazilian pepper, Japanese climbing fern, swamp fern (Telmatoblechnum serrulatum), pennyIwort, dayflower (Cestrum diurnum), smartweed, pickerelweed (Pontederia cordata), and arrowhead (Sogittaria spp.). FLUCCS 643 — Wet Pasture (t 4.02 acres) Wet pasture exists along the eastern boundary extents as you get closer to the large adjacent bottomland swamp and slough. This pasture contained high densities of soft rush, bushy bluestem (Andropogon glomeratus), smutgrass and broomsedge bluestem. Preserve Areas Appendix A - Figure 6 and 7 identifies the areas to be preserved as part of the Bluefield Preserve Solar Energy Center development. FPL is proposing to preserve 100 percent of the mixed wetland hardwoods, mixed shrubs, and wet pasture, while preserving roughly 94 percent of the pine flatwood community, respectively. Barricading and Signage FPL will ensure the preserve areas are protected with physical barriers during clearing and construction activities in accordance with the following guidelines: • Barricades (not including silt fencing) will be high visibility orange safety fence with a final height of at least 4 feet above the ground. Barricades will not be attached to vegetation. • Barricades and silt fencing will be upright and maintained intact for the duration of construction. • Native vegetation (not approved for removal as part of development plan) will be retained in their undisturbed state. • Preserve areas will be posted with sign marked, "Preserve Area" (Appendix A - Figure 8). Prohibited Activities Prohibited activities in the preserve areas Include, but are not limited to, the following: • Dumping or placing soil or other substances, such as garbage, trash, and cuttings • Removing or destroying native trees, shrubs, for other native vegetation • Planting within the preserve areas except as provided for by permit • Excavating, dredging, or removing soil materials • Diking or fencing ■ Performance of other activities detrimental to drainage, flood control, water conservation, erosion control, or fish and wildlife conservation and preservation Onsite fuel tanks will not be located within 50 feet of a preserve area and will be removed upon completion of construction work. Development activities, such as the construction of building pads for inverters or substations, access paths, or culverts for surface water management, will not alter the hydrology of adjacent preserve areas, nor will any activities increase non -point source pollution In the preserves. 1 Management and Maintenance Except for approved restoration, management, and (maintenance activities, preserve areas will be left undisturbed. Maintenance of preserve areas will be in accordance with this PAMMP. FPL accepts responsibility for perpetual maintenance and management of the preserve areas and will enforce the conditions of the conservation easement, environmental resource permits, and other conditions of this PAMMP. Invasive and Exotic Vegetation Exotic vegetation in the preserve areas will be removed by the least ecologically damaging method available. Such methods include roller chopping, hand pulling, hand spading, chainsaw use, and/or treatment with appropriate herbicide. Exotic species will be removed or treated in accordance with the project's vegetation removal permit. Exotic and in species will be managed in perpetuity, as necessary. Exotic vegetation includes category I and II pest plants on the most recently available Florida Exotic Pest Council list (Appendix B). Supplemental Planting In accordance with St. Lucie County Land Development Code, Section 6.02.03E and Comprehensive Plan, Policy 6.1.14.1, supplemental planting of a twenty-five (25) and fifty (50) foot wide upland buffer, on all sides of the existing Category III and Category I wetland preserve areas adjacent to development will be performed, respectively (see Appendix A —Figure 7). Approximately 139,000 square feet of upland buffer will be planted. Supplemental planting may also be done pursuant to voluntary environmental enhancement activities. In either circumstance, this will consist of native plant species indicative of the existing adjacent plant communities. If no adjacent reference community is present, native plants will be chosen that are appropriate for the existing site conditions. This will ensure preserve areas maintain appropriate plant associations. The following Table 1 presents recommended plant types, sizes, and spacings for replanting of wetland buffers. Dead or diseased plant material may be removed if the material creates a safety hazzard to facility infrastructure or if the material detracts from the continued health of the preserve area. Monitoring and Maintenance Plan Preserve areras will be monitored annualy for the;presence of exotic vegetation. Monitoring will be performed via pedestrian transect surveys through each of the preserve areas. Monitoring personel will note the type, approximate coverage, and locations of exotic vegetation observed during the survey. The first monitoring event (Time Zero) will be conductedlimmediately following site construction and will be conducted at one-year intervals for a period of five years. Reports will be provided to St. Lucie County Environmental Resources Department and FPL's Operations and Management team within 30 days of completion of field monitoring and will include remedial actions, iff neccesary. The proposed monitoring timeline is as follows: • Time zero monitoring: January 2023 • Year one monitoring: January2024 • Year two monitoring: January2025 • Year three monitoring: January2026 • Year four monitoring: January2027 • Year five monitoring,: January2028 Exotic and nuisance plant species found within thel preserve areas will be treated with herbicide or physically removed. A USGS Topographic Map shows the site elevation to be approximately 55-60 feet (Figure 2). The existing site primarily comprises an abandoned citrus grove that has been converted to pasture. Although all citrus trees have been removed, remnant agricultural furrows and irrigation ditches are still present throughout the site. The site consists of various pasture grasses with exotic species encroaching along the banks of existing ditches and furrows. Approximately 6.21 acres of pine flatwoods also exist on -site. Native trees were surveyed, and results are discussed in further detail below. i The proposed Project will consist of an approximately 74.5-megawatt (MW) solar photovoltaic energy center located on approximately 452-acres, with associated road and stormwater infrastructure as well as a collector yard. This report describes the existing vegetation, habitats, and wildlife found on the site as well as the steps used to avoid and minimize impacts to these natural features. Field work was conducted between October 2020 and August 2021 with full protocol caracara surveys conducted from January to April 2021. Project land use and covertypes were assessed through a combination of desktop aerial analysis and field reconnaissance assisted by hand-held GPS. A FLUCFCS map of the site is attached (Figure 4). Due to the use of the site for agricultural purposes, few natural communities are present. FLUCFCS 118 — Residential, rural (t 2.91 acres) An area at the entrance to the project site contains a building used as an office/shop for the previous agricultural site activities. FLUCFCS 211— Improved Pasture (t 414.32 acres) Improved pastures were observed throughout the entirety of the site. Vegetation observed in theselareas primarily comprised smutgrass (Sporobolus indicus), with smaller amounts of broomsedge bluesteam (Andropogon virginicus), tropical soda apple (Solanum vlarum) and caesarweed (Urena lobato).- Cabbage palms (Sabot palmetto) and live oaks (Quercus virginiana) were scattered throughout these upland fields. A powerline extending east to west along the entrance road was also observed. FLUCFCS 411— Pine Flotwoods (t 6.22 acres) Pine flatwoods are found in the southeastern portion of the site. These areas are characterized primarily by slash pine (Pinus elliotti) and dense saw palmetto (Serenoo repens), with scattered areas of gallberry (Ilex glabra), muscadine (Vitis rotundifolia), broomsedge bluestem, catbriar (smilaxspp.) live oak (Quercus virginiana), and laurel oak (Quercus laurifolia). Jurisdictional Wetlands and Surface Waters The presence of wetlands was evaluated based on the Florida unified wetland delineation methodologies in accordance with Chapter 62-340, Florida Administrative Code (FAC) and the U.S. Army Corps of Engineers (USACE) 1987 Wetland Delineation Manual, and regional supplement. These methods take in to account the prevalence of wetland vegetation, hydric soil indicators, and wetland hydrology. Surface waters include both natural and man-made bodies if water such as streams, lakes, ponds, canals, and ditches. A Wetlands and Surface Waters Map is attached (Figure5). FLUCFCS 510 — Agricultural Ditches and Furrows (f118.9 acres) Due to ongoing agricultural practices within the site, irrigation ditches and furrows are a prominent feature found throughout the project boundaries. Ditches (+ 7.7 acres) were typically 20 feet wide and interconnected. Although predominantly open water, vegetation observed within the larger ditches included torpedograss (Panicum repens), cattail (Typho spp.), Peruvian primrose -willow (Ludwigia peruviona), spikerush (Eleocharfs spp.) and pennywort (Hydrocotylespp.). Emergent aquatic species were also observed, and included duckweed (Lemna minor), water lettuce (Pistia stratiotes) and water hyacinth (Eichhornia crassipes). Additional vegetation along the banks of the ditches included caeserweed, Brazilian pepper (Schinus terebinthifolius), muscadine, and wax myrtle (Morelia cerifera). Smaller agricultural furrows (t 11.1 acres), likely remnants 7 1 P a g e OR BOOK 4799 PAGE 2880 FPL Bluefield Preserve Solar Energy Center Environmental Impact Report of past citrus operations, were typically less than 6 feet wide and observed vegetation was limited to soft rush (luncus effusus), duck potato (Sagittaria latifolia�, and smartweed. FLUCCS 530—Reservoirs (±2.04 acres) Multiple small,ponds were found onsite and were utilized as stock ponds for the irrigation ditches. These areas were characterized by open water with steep embankments and little to no vegetation. FLUCCS 617 — Mixed Wetland Hardwoods (± Z09 acres) This habitat was observed within the north central area of the site adjacent to an agricultural di Ich. Woody vegetation observed within the swamp canopy and midstory primarily includes sweetbay (Magnolia virginiana), red maple (Acerrubrum), wax myrtle, and pop ash (Fraxinus caroliniono). Additional vegetation observed includes jointed spikerush (fleocharis interstincto), Virginia chain fern (Woodwardia virginica), Brazilian pepper, Japanese climbing fern (Lygodium japonicum), swamp fern (Telmatoblechnum serrulatum), pennywort, dayflower (Cestrum diurnum), smartweed (Polygonum sp.), pickerelweed (Pontederia cordato), and duck potato. FLUCCS 618—Mixed Shrubs (±1.42 aces) A bay swamp was observed within the central -northern area of the site adjacent to an irrigation ditch. The fringe of'this area contained little to no vegetation with soils disturbed from cattle usage. Woody vegetation observed within the canopy and midstory primarily includes sweetbay (Magnolia virginiana), with other species present intermittently including red maple (Acer rubrum), wax myrtle, and pop ash (Fraxinus caroliniana). Additional vegetation observed includes spikerush, Virginia chain fern (Woodwardia virginica), Brazilian pepper, Japanese climbing fern, swamp fern (Tel►natoblechnum serrulatum), pennywort, dayflower (Cestrum diurnum), smartweed, pickerelweed (Pontederia cordata), and arrowhead (Sagittaria spp.). FLUCCS 643— Wet Pasture (± 4.02 acres) Wet pasture exists along the eastern boundary, closer to an adjacent, offsite bottomland swamp and slough. This pasture contained high densities of soft rush, bushy bluestern (Andropogon glomeratus), and broomsedge, bluestem. 8 1 P a g e OR BOOK 4799 PAGE 2881 OR BOOK 4799 PAGE 2882 OR BOOK 4799 PAGE 2883 FPL Bluefield Preserve Solar Energy Center Environmental Impact Report Wetland Impacts and Permitting The existing surface water network of agricultural ditches and furrows has been taken into account during project design and existing ditch crossings have been used to the greatest extent practical to prevent additional fill within these surface waters. Direct impacts to approximately 47 percent of the on -site surface waters have been avoided by incorporatinglthe existing ditch system described above into the proposed stormwater management system. Measures to eliminate or reduce surface water impacts include use of agriculturally disturbed uplands for the location of the solar facility to the greatest extent practicable, use of existing pathways where feasible, ditch crossings for electrical cables via horizontal directional drilling (HDD), and limiting the amount of grading and impervious materials throughout the Project Site. However, given the distribution of on -site agricultural ditches/furrows, it was not possible to entirely avoid surface waters without greatly compromising the energy production capability of the facility. Therefore, one hundred (100) of these agricultural furrows, all less than 0.5 acres and approximately 11.1 acres total, will be permanently impacted. As is shown on the proposed stormwater I plans, due to the age of the existing stormwater infrastructure and inability to meet on -site stormwater needs, minimal impacts to the larger drainage ditches are proposed for the installation of culverts and bank stabilization. There are no proposed impacts to wetlands as they will be avoided. Project elevations will be maintained above the 100-year floodplain with minimal grading as required to provide positive site drainage. Wildlife and Listed Species The status and potential occurrence of wildlife species listed as endangered, threatened, or of special concern in the Project Site were determined by literature survey, agency records, agency websites, the Florida Natural Areas Inventory (FNAI) database (April 1, 2021), the U.S. Fish & Wildlife Service (USFWS) Information Planning and Conservation (IPaQ database (April 1, 2021), and several field assessments. Based on a review of these online resources, there are no documented occurrences of listed species within the project vicinity. A formal Audubon's crested caracara (Polyborus plancus audubonii7 survey was conducted from January through April 2021. Survey results concluded that suitable habitat is present within and surrounding the Study Area, and adult caracaras were observed flying back and forth across the Study Area. Perching was observed on a slash pine within the Study Area once during the study period, and on one occasion caracara were documented foraging within the fields of the Study Area. No caracara nests were observed within or adjacent to the Study Area and no juvenile caracaras were observed during any portion of the survey. Based on surveys conducted by Kimley-Horn from January 06, 2021 to April 29, 2021 and behavioral patterns observed throughout the season, no active nests are located within the Study Area, and the project area is utilized by caracara only for limited foraging, coordination with USFWS is ongoingto ensure potential impacts to federally listed species are avoided. Kimley-Horn field biologists have also conducted al 100% gopher tortoise survey (conducted by an authorized gopher tortoise agent), as well as a general species survey of the site in February 2021. Two (2) potentially occupied gopher tortoise burrows werellocated. Per FWC guidelines, construction activities must not occur within a 25-foot radius of a potentially occupied gopher tortoise burrow. The burrows are located within pine flatwoods proposed to be preserved. Thus, adverse effects to the gopher tortoise are not anticipated. An additional 100% survey will occur within 90 days of construction to ensure no additional tortoises are present within the project footprint. If burrows are discovered within the proposed project footprint, the appropriate permits will be obtained from FWC. 131Page OR BOOK 4799 PAGE 2886 oR BOOK 4799 PAGE 2887 FPL Bluefield Preserve Solar Energy Center Environmental Impact Report Kestrels were observed on -site, however this was during the winter months when the migrant subspecies is present in Florida. Therefore, surveys for the southeastern American kestrel were conducted in July and August 2021 to determine if the protected subspecies was using the site. No kestrels were observed during the July and August survey events. Trees proposed for trimming or removal will be inspected for nests and cavities prior to construction. Potential nest cavities will remain as the site will maintain foraging habitat. Tree clearing will occur in the pastures. No adverse effects are anticipated for this species. The project boundary is within the CFA of the "Lemkin Creek" and "Cypress Creek Bluefield Road" wood stork (Mycteria americana) colonies. The wet pasture and furrows onsite do not provide SFH for the wood stork. Areas considered SFH will be avoided and preserved. Species observed within the project site during these species surveys included; American crow (Corvus brachyrhynchos), American kestrel (Falco sparverius),�anhinga (Anhinga anhingo), bald eagle (Haliceetus leucocepholus), barn owl (Tyto alba), belted kingfisher (Megaceryle alcyon), black -crowned night -heron (Nycticorax nycticorax), black vulture (Corogyps atratus), boat -tailed grackle (Quiscalus major), cattle egret (Bubulcus ibis), common grackle (Quiscalus quiscula), common ground dove (Columbina passerina), crested caracara (Caracara cheriway), eastern meadowlark (Sturnelia magna), glossy ibis (Plegadls falcinellus), gopher tortoise (Gopherus polyphemus), great blue heron (Arden herodfas), great egret (Ardea albs), killdeer (Charodrius vociferus), little blue heron (Egretta caerulea), loggerhead shrike (Lanlus ludovicianus), mourning dove (Zenaida macroura), northern cardinal (Cardinalls cordinalis), northern mockingbird (Mimus polyglottas), northern harrier (Circus hudsonius), pileated woodpecker (Dryocopus pileatus), red -shouldered hawk (Buteo lfneatus), red -tilled hawk (Buteo jarnaicensis), sandhill crane (Grus conadensis), snowy egret (Egretta thula), swallow-tailed kite (Elarroides fo�catus). tree swallow (Tachycineta bicolor), tricolored heron (Egretta tricolor), turkey vulture (Cathartes aura), white ibis (Eudocimus albus), and wood stork (Mycteria americaI o). Table 2 lists species that, based on field reconnaissance and databased reviews, may occur on -site or in the vicinity of the project site and their likelihood ofioccurrence. Note: coordination Is not required with FWC for Federally listed species. 161Page OR BOOK 4799 PAGE 2889 FPL Bluefield Preserve Solar Energy Center Environmental Impact Report Native Vegetation and Tree Survey Per the Land Development Code of St. Lucie County vegetation removal activities of native species in unincorporated areas require a Vegetation Removal Permit from the Public Works Director (Section 6.00.133). Section 6.00.05 stipulates that prior to removing any native vegetation, it must be demonstrated that efforts have been made to avoid or minimize impacts to these native species, with any areas of vegetation to be preserved designated by a protective I barrier. Mitigation may be required for the removal of healthy native vegetation meeting minimum size requirements set forth by the county in Table 1 of Section 6.00.05. A vegetation removal permit application was submitted to St. Lucie County on August 6`h, 2021. As described above, existing natural communities are limited within the project site due to the historic use of the property as a citrus grove and the recent reImoval of citrus trees and development of pastures. Therefore, the majority of the project site lacks native vegetation habitats. However, a small strand of pine fiatwoods exists, and several cabbage palms and;oaks are scattered throughout the pasture. A tree survey was conducted in May 2021 as required for St. Lucie County to identify protected trees within the development footprint. On the entire FPL-owned site, 308 trees were Identified as being of a size and species to meet the mitigation threshold for St. Lucie County (Table 3). These included cabbage palms of a size larger than 10 feet clear trunk, slash pine greater that 12 inches in diameter at breast height (dbh), live oak greater than 12 inches dbh, laurel oak greater than 12 inches dbh, red bay greater than 9 inches dbh, and red maple greater than 9 inches dbh (Figures 8 & 9). There are a total of 247 palm trees over 10' in height and 61 hardwoods with DBIi's exceeding the mitigation sizes listed in Section 6.00.05 Criteria Governing Approval of Vegetation Removal Permit of the St. Lucie County Land Development Code. Due to the potential for shading impacts caused by these trees, FPL is proposing the removal of 243 cabbage palms and 340" of hardwoods. The remaining 4 cabbage palms and 589" of hardwoods will be preserved as shown on the attached figures. Wetlands identified on -site are to remain. The existing surface waters are man-made for the purposes of drainage and irrigation associated with the historic use of the site as a citrus grove. Pasture grasses are abundant throughout the site and most of the ditches are full of water lettuce and exotics, while most of the furrows lack vegetation. Native trees are present throughout the site. Proposed impacts to surface waters are anticipated fir one hundred (100) of these agricultural furrows, all isolated and less than 0.5-acre (Category III per the County Comprehensive Plan Policy 6.1.14.1c), totaling approximately 11.1 acres. Additionally, due to the age of existing stormwater infrastructure and inability to meet on -site stormwater needs, minimal impacts to the larger drainage ditches are proposed for the installation of culverts and other minor improvements. Therefore, based on sections 10.2.2.1 and 10.2.2.2 of the ERP Applicants Handbook, Impacts to these will not require mitigation. There are no proposed impacts to wetlands as they will be avoided. Additionally, a 5.8-acre pine flatwoods natural area will be preserved as part of the proposed projects tree mitigation, to offset native vegetation impacts.
