AN ORDER OF THE PLANNING & DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY GRANTING APPROVAL FOR A
MINOR ADJUSTMENT TO THE ST. LUCIE BUSINESS PARK
STORAGE PNRD (PLANNED NON-RESIDENTIAL DEVELOPMENT)
FOR A PROPERTY LOCATED ON THE WEST SIDE OF BUSINESS
PARK DRIVE, LOT #1 OF ST. LUCIE BUSINESS PARK
SUBDIVISION, IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
application fora Minor Adjustment to the approved St. Lucie Business Park Storage Planned Non-
Residential Development (PNRD), submitted by Kenneth R. Carlson -Architect, P.A. on behalf of
St. Lucie Self Storage, LLC, and has made the following determinations:
1. Kenneth Carlson -Architect, P.A. Design Planning Interiors, submitted a Minor Adjustment
to the approved St. Lucie Business Park Storage PNRD on behalf of St. Lucie Self
Storage, LLC. The project seeks approval to increase the building height from 40 feet to
45'5" (west elevation), increase in the parapet height to 47"1" to 49'8" 1/2" (south, east,
and north elevations), adjust the building gross area from 88,270 square feet to 89,342
square feet, relocate the sidewalk entrance and handicapped parking space five (5) foot
access aisle north of the handicapped parking space, remove the roll-up door on the south
building entrance, and relocate the emergency exit door to the west portion of the building.
The subject project is located on the west side of Business Park Drive on Lot#1 of the St.
Lucie Business Park subdivision within the Planned Non-Residential Development
(PNRD) Zoning District.
2. On December 14, 1988, the Board of County Commissioners granted approval through
Resolution No. 88-365 for a change in zoning from CG (Commercial, General) to the
PNRD (Planned Non-Residential District) Zoning District for a property to be known as St.
Lucie Commerce Park Storage PNRD.
3. On September 15, 2009, the Board of County Commissioners granted approval through
Resolution No. 09-008 for a four-story 88,270 square foot self-storage facility to be known
as St. Lucie Business Park Storage Preliminary and Final PNRD.
4. The Planning and Development Services Director granted site plan extensions through
PDS Order numbers 09-024, 11-003 (PDS Order 11-003 amended through PDS Order
11-007) 12-012, 12-039, 16-006, 16-041, 17-039, 18-011, 18-055, 19-009 (PDS Order 19-
009 amended through PDS Order 19-027), 2020-056, and 2021-034. Through these
orders, the site plan was extended from its original expiration date of September 15, 2011,
to April 30, 2030.
5. The St. Lucie County Development Review Committee has reviewed the adjusted Site
Plan and found it to meet the technical requirements of the St. Lucie County Land

Development Code, St. Lucie County Comprehensive Plan, and has satisfied the
standards of review set forth in Sections 11.02.05 B. 2. (Substantial Conformity)& E. Minor
Adjustments, and 11.02.07, Standards for Site Plan Review, subject to the conditions set
forth in Part "A" of this Order.
6. Planning staff performed a detailed analysis of the project and found it to be consistent
with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis
can be found in the Planning and Development Services memorandum titled St. Lucie
Business Park Storage - Minor Adjustment to St. Lucie Business Park Storage Planned
Non-Residential Development (SPMn-2202226307), dated November 15, 2023.
7. The proposed Minor Adjustment to St. Lucie Business Park Storage PNRD will not have
an undue adverse effect on adjacent properties, the character of the neighborhood, traffic
conditions, parking, utility facilities, or other matters affecting public health, safety, and
general welfare.
8. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
9. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
10. The project will have water and wastewater service provided by Port St. Lucie Utilities.
NOW, THEREFORE, BE IT ORDERED by the St. Lucie County Planning and Development
Services Director:
A. Pursuant to Sections 11.02.05.E. and 11.02.07 of the St. Lucie County Land Development
Code, the Minor Adjustment to the St. Lucie Business Park Storage PNRD is hereby
approved as shown on the site plan drawings, prepared by Kenneth R. Carlson -Architect,
P.A., dated August 10, 2022, subject to the following conditions:
1. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plant
species shall be eradicated from the site.
2. A Site Development Permit is required prior to performing site improvement activities.
In accordance with the permit and Land Development Regulations, the applicant shall
retain the Engineer of Record for site inspections and final certification.
3. The exterior door on the south side of the building (labeled as "stair#1" on the original
site plan prepared by Friscia Engineering) and being relocated to the west side of the
building per the site plan adjustment(as prepared by Kenneth Carlson -Architect, P.A)
shall remain as exit discharge only.
4. Prior to commencement of development, including but not limited to; clearing, filling,
excavation, grading, or planting of vegetation, as defined in LDC 2.00.00., a vegetation

removal permit or exemption shall be issued by the Environmental Resources
Department per LDC 6.00.03.
5. Prior to issuance of the vegetation removal permit or exemption, a fee-in-lieu of
$121,180 shall be provided and paid to the County Tree Mitigation Fund or a total of
174 native canopy trees shall be planted at St. Lucie County approved sites in
accordance with LDC 6.00.05.D, each measuring 2.5" diameter-at-breast height
(DBH) and 12' in height per LDC 7.09.00.
The Conditions of Approval within Resolution No. 09-008 shall remain active with this
Site Plan modification, unless modified previously, with minor updates as denoted
below:
6. All previous conditions of approval applicable to the subject property, as contained in
the above referenced development orders have been consolidated as contained
herein. The property owner shall comply with all previous conditions of approval and
deadlines established by Chapter 11 of the Land Development Code and the Board of
County Commissioners, unless expressly modified herein.
7. No development permits shall be issued until complete sets of sealed constructible
final engineering plans, supporting calculations and survey data for the site work and
offsite improvements are approved by the Office of the County Engineer, Public Works
Department, Utilities Department, Environmental Resources Department, Planning
and Development Services, Fire Department, and any other agency that may be
determined by the Director of Planning and Development Services to be necessarily
involved in the review and approval of the constructible final engineering plans for the
site work and offsite improvements. The determination of whether or not plans
submitted by the applicant constitute a complete set of constructible plans shall be
made by the departments involved in the plan review within five business days of the
date the plans are received in the Department of Planning and Development Services.
8. Prior to the issuance of a Certificate of Occupancy, the developers, their successors
or assigns, shall either construct a 5-foot-wide sidewalk along the development
frontage on Business Park Drive in accordance with Section 7.05.04, or execute an
agreement to pay a fee-in-lieu of construction for sidewalks or multi-purpose paths and
remit to the County the required funds within 60 days after receiving final site plan
approval. The acceptable method of payment shall be a certified check payable to St.
Lucie County. A copy of the standard "Agreement" can be obtained by visiting the St.
Lucie County Public Works Department website at: http://www.stlucieco.gov/public
works/index.htm.
9. The developers, their successors or assigns, shall be required to have a traffic signal
warrant study conducted at the intersection of Business Park Drive and South US-1
between 180 days and 240 days after the issuance of a Certificate of Occupancy. If a
signal is warranted by that study, the developers, their successors or assigns, shall
design and install the traffic signal in coordination with FDOT.
10. Hours of operation shall be limited to between 6:00 a.m. and 10:00 p.m., seven days

per week.

12. Prior to issuance of a Certificate of Capacity, the applicant shall install all required
landscaping, irrigation, tree mitigation, tree relocation, and related improvements
shown in the approved plans (Condition of Approval modified to replace #11).
13. The issuance of a County development permit does not in any way create any rights
on the part of the applicant to obtain a permit from a state or federal agency and does
not create any liability on the part of the County if the applicant fails to obtain requisite
approvals or fulfill the obligations imposed by a state or federal agency or undertakes
actions that result in a violation of state or federal law.
B. The property on which this Minor Adjustment to the Planned Non-Residential
Development is being granted is described as follows:
LEGAL DESCRIPTION:
Lot 1, St. Lucie Business Park, less the south 19 feet, according to the plat thereof, as
recorded in plat book 28, pages 9 and 9a, public records of St. Lucie County, Florida. All
of the above located in Section 26, Township 36 South, Range 40 East. Containing 1.42
acres more or less.

Location: The west side of Business Park Drive, 610 feet west of the intersection
of US Highway#1 and Business Park Drive.
C. The approvals granted by this administrative order shall expire twenty-four (24) months
from the effective date, unless a Building Permit is obtained, or an extension is granted in
accordance with the provisions of Section 11.02.06 of the St. Lucie County Land
Development Code.
D. The developer, including any successors in interest, is advised as part of this site plan
approval, all applicable development permits and construction authorizations shall be
obtained from the appropriate State and Federal and Local regulatory agencies including,
but not limited to, the United States Army Corps of Engineers, the Florida Department of
Environmental Protection, and South Florida Water Management District, and the St.
Lucie County Environmental Resources, Public Works, and Building Departments, and
the St. Lucie County Fire District prior to the commencement of any development activities

on the property described in Part "B". Issuance of this permit by the County does not in
any way create any rights on the part of the developer to obtain a permit from a state or
federal agency and does not create any liability on the part of the County for issuance of
this permit if the developer fails to obtain requisite approvals or fulfill the obligations
imposed by a state or federal agency or undertake actions that may result in a violation of
state or federal law.
E. A copy of this Order shall be attached to the site plan drawings identified as Exhibit "A",
which plan shall be placed on file with the St. Lucie County Planning and Development
Services Department and mailed to the developer and agent of record as identified on the
site plan application.
F. The conditions set forth in Part "A" are an integral non-severable part of the site plan
approval granted by this Order. If any condition set forth in Part "A" is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the site plan granted by this Order shall become null and void.
G. The Site Plan, attached as Exhibit "A", shall be valid for the same period as this Order.
H. The Certificate of Capacity, attached as Exhibit "B", shall be valid for the same period as
this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
automatically terminate.
I. This Order shall become effective upon the date of approval indicated below. Should the
property owner, developer or authorized agent wish to appeal any condition described in
Part "A" above, all such appeals must be filled in writing with the County Administrator
within thirty (30) days of the rendering of this Order, as described in Section 11.02.03(B),
St. Lucie County Land Development Code. Should an appeal to this Order be filed, no
permitting reviews or further administrative action shall take place on the processing of
this development project until the appeal is resolved.
G. This Order shall bee recordedy� in the Public Records of St. Lucie County.
