LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS IN OPPOSITION OF 2024 FLORIDA HOUSE BILL 479 THAT AMENDS FLORIDA STATUTES TO REVISE TRANSPORTATION AND DEVELOPMENT FUNDING SYSTEMS, INCLUDING IMPACT FEE CALCULATIONS AND REQUIREMENTS FOR ALTERNATIVE TRANSPORTATION SYSTEMS OR SIMILAR LEGISLATION THAT AMENDS FLORIDA STATUTES AS TO ALTERNATIVE MOBILITY FUNDING SYSTEMS AND CLARIFY IMPACT FEE REQUIREMENTS FOR DEVELOPERS AND LOCAL GOVERNMENTS. WHEREAS, in 1986, the County adopted a road impact fee to help fund capacity improvements to the County's road network to address the transportation impacts of growth within the County and was last updated in 2022; and WHEREAS, although the County currently has interlocal agreements in place, with the cities to collect County road impact fees, some expiring in 2026, there have been multiple instances in the past where the County has had to collect its impact fees directly from developers due to the city's termination of these agreements; and WHEREAS,the 2024 Legislature has voted favorably to support House Bill 479 ("HB 479"), which would amend Florida Statutes to revise transportation and development funding systems; and WHEREAS,under the requirements of HB 479, any collected fee must be pursuant to a plan based approach, if there is a revised interlocal agreement, or assessed through a mobility fee if there is no interlocal agreement, the County may have to abandon its well established impact fee program and adopt a mobility plan; and WHEREAS, under HB 479, if only the local government issuing the building permit may collect a road impact fee, the County may be unable to collect its impact fee within municipal boundaries, in whole or in part, should a city terminate its interlocal agreement; and WHEREAS, should the County be limited in its ability to adequately collect its road impact fees,it may be unable to fund needed capacity improvements or its Transportation Elements of its Comprehensive Plan, nor meet its adopted level of service; and WHEREAS,the requirements of HB 479 would interfere with the authority of counties to fulfill its responsibilities over the County Road System as established under Chapter 336, Florida Statutes. NOW, THEREFORE,BE IT RESOLVED,BY THE ST. LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS that the Board opposes 2024 Florida House Bill 479 or any other similar legislation. This resolution shall take effect on adoption.
